Abstract

Penelitian ini bertujuan untuk mengetahui: (1) Praktik jual beli air minum isi ulang di depot ADL water di tinjau dari hukum Islam, (2) Untuk mengetahui implementasi Keputusan Menteri Perindustrian dan Perdagangan Republik Indonesia No.651 MPP/KEP/10 tahun 2004 terhadap praktik jual beli air di depot ADL water. Metode yang digunakan dalam penelitian ini adalah deskriptif analisis kemudian menilai serta mengkaji permasalahan yang terjadi berdasarkan tinjauan hukum Islam dan Keputusan MENPERINDAG NO.651/MPP/KEP/10/2004. Jenis penelitian yang digunakan adalah penelitian lapangan, metode pengumpulan data adalah dengan cara observasi, dokumentasi, wawancara kepada pemilik usaha, konsumen depot air minum isi ulang ADL water dan dinas perdagangan Kabupaten Kuningan. Hasil penelitian menunjukan bahwa menurut hukum Islam ditinjau dari segi rukun jual beli sudah terpenuhi, yakni dengan adanya penjual, pembeli, akad dan barang yang dipejualbelikan. Akan tetapi jika ditinjau dari segi syarat sah jual beli belum terpenuhi dari sisi objek yang diperjualbelikan. Hal ini karena pihak penjual tidak mencantumkan hasil uji laboratorium kandungan air kepada konsumen juga menggunakan galon yang sudah bermerek.Dan dengan adanya KEPMENPERINDAG NO.651/MPP/KEP/10/2004 adalah agar kualitas mutu air minum isi ulang terjamin dan melindungi hak-hak konsumen.

Abstract

Notaris sebagai pejabat publik memiliki peran penting dalam memberikan pelayanan hukum kepada masyarakat, termasuk konsumen. Dalam pelaksanaan tugasnya, notaris wajib menjamin bahwa akta dan dokumen yang dibuat sesuai dengan ketentuan hukum yang berlaku. Namun, muncul pertanyaan mengenai sejauh mana notaris bertanggung jawab jika terjadi kerugian bagi konsumen akibat kesalahan atau kelalaian dalam pembuatan akta. Penelitian ini bertujuan untuk menganalisis pertanggungjawaban hukum notaris terhadap konsumen berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan studi literatur. Hasil penelitian menunjukkan bahwa notaris dapat dikenai pertanggungjawaban hukum jika terbukti melanggar kewajiban profesinya, terutama apabila terjadi kesalahan yang merugikan konsumen. Undang-Undang Perlindungan Konsumen memberikan dasar bagi konsumen untuk menuntut ganti rugi, termasuk hak atas keamanan, informasi yang benar, dan perlakuan yang jujur dari penyedia jasa, termasuk notaris. Selain itu, penelitian ini menemukan adanya kolaborasi antara Undang-Undang Jabatan Notaris dan Undang-Undang Perlindungan Konsumen dalam memastikan akuntabilitas dan perlindungan hukum bagi konsumen. Penelitian ini merekomendasikan agar notaris meningkatkan kepatuhan terhadap kode etik dan standar profesional dalam memberikan layanan kepada konsumen. Selain itu, konsumen perlu lebih memahami hak-haknya dan jalur hukum yang tersedia jika mengalami kerugian akibat tindakan notaris. Dengan demikian, hubungan yang adil dan seimbang antara notaris dan konsumen dapat tercipta, sejalan dengan prinsip perlindungan konsumen.

Abstract

Islamic banking relies on profit-sharing agreements as one of its fundamental financial instruments, adhering to the principles of justice and partnership in sharia law. However, disputes often arise between banks and customers regarding the distribution of profits and losses. This study examines the dispute resolution mechanisms for profit-sharing agreements within Islamic banking, focusing on litigation in religious courts and non-litigation processes such as mediation and arbitration. This research aims to evaluate the effectiveness and compliance of these mechanisms with Sharia principles while also proposing improvements to regulatory frameworks. A mixed-method approach was employed, combining normative juridical analysis and empirical research. The normative juridical method was used to review existing laws and regulations related to Islamic banking and dispute resolution. At the same time, the empirical data was gathered through interviews with key stakeholders such as banking practitioners, customers, and mediators involved in dispute resolution. The results indicate that non-litigation mechanisms, particularly mediation, are more efficient and cost-effective than litigation. However, there remains a need for greater public understanding and stronger institutional support to ensure the fairness and transparency of these processes. This research recommends enhancing dispute resolution systems in Islamic banking, aligning them more closely with legal and sharia standards.

Abstract

Sedekah Nurul Falah Al-Mubarok Bank appeared to provide account receivable transaction facilities based on qardh agreement sourced from the alms funds of its members. However, there are issues regarding the suitability of the agreement used with sharia principles. This study aims to determine and analyze the implementation of the qardh agreement in account receivable transaction at Nurul Falah Al-Mubarok charity bank in Bekasi regency based on the principles of Islamic law (fiqh muamalah). The method used was a qualitative approach with a case study. The main sources of data and information were obtained through in-depth interviews with administrators, members, foundation advisors, and religious leaders. The results of this study showed that this charity bank applies the concept of "from members, by members, for members," which is in line with the principle of al-Muslimuna Ala Syurutihim. The mechanism of account receivable transaction includes loan applications by members, installment agreements, and relief policies in the form of extensions or write-offs for members who experience difficulties. Funds are collected using a tabarru agreement, while the implementation of the qardh agreement consists of three stages, namely Completing the administration, The qardh agreement process, The loan repayment process. The results of the study showed that the practice of qardh agreement in account receivable transactions at this charity bank has generally fulfilled its pillars and requirements and avoids any additional costs (interest) on repayment, thus indicating that the qardh agreement applied is free from elements of maisir, gharar, and riba because it is in accordance with Islamic law and has been determined to be in accordance with sharia rules in the fatwa of the Indonesian Ulema Councils National Sharia Board (DSN-MUI) No. 19/DSN-MUI/IV/2001 concerning Al-Qardh.
