Abstract

The rise of corruption cases that occurred became a driving force for the author to conduct research on this case. By using normative juridical writing techniques, namely collecting secondary materials and also literature study. From the results of the research, bribery of funds itself is an act of giving money or receiving money or gifts carried out by government officials to do or not doing something that’s contrary to their obligations, In Indonesia itself, cases of bribery often occur, even though this action violates Law No. 20 of 2001. The case presented by the author with this article is the case of Attorney Farizal receiving a bribe of 440, but Prosecutor Farizal has been sentenced by the court to a fine of 250,000,000 and imprisonment for 5 years. It could be nice for us to be aware of the case bribes around us.

Abstract

Pernikahan antara orang yang berbeda agama merupakan masalah yang kompleks dan kontroversial di masyarakat kontemporer. Tujuan dari tulisan ini adalah untuk memeriksa pernikahan yang berbeda agama dari perspektif hukum dan filsafat. Dari sudut pandang hukum, analisis akan membahas hukum yang berlaku di berbagai negara, termasuk norma agama dan hukum positif yang mengatur pernikahan. Sebaliknya, analisis filsafat akan mempertimbangkan perdebatan etika dan moral yang berkaitan dengan kebebasan beragama, identitas, dan hubungan antarbudaya. Pernikahan yang berbeda agama sering kali menghadapi masalah dalam hal hukum, terutama di masyarakat yang memiliki norma agama tertentu. Pernikahan ini dilarang secara total di beberapa negara, tetapi diizinkan di lain dengan syarat tertentu. Dalam analisis ini, kami akan mempelajari bagaimana hukum dapat berfungsi untuk melindungi hak asasi individu dalam konteks pernikahan. Pernikahan yang berbeda agama menimbulkan pertanyaan filosofis.

Abstract

Due to the rise in cases of film piracy in Indonesia, this has motivated the writer to conduct research on this case. By using a qualitative descriptive writing method, the data is obtained from observations and also from literature studies. The concludes from the author's research, someone who uploads a film without any permission from relevant party can be declared as film piracy, but unfortunately there are still many people who even support this. Because if you watch through illegal websites it is free, but they arn’t aware that this act is a violation of the ITE Law. The main factor is that the perpetrators of piracy get a lot of profit from the audience, and also get a good response from the public who prefer to use illegal websites rather than using illegal websites. with a legal film player application. Stopping film piracy carried out by the LK 21 website has been terminated by blocking the lk 21 website by the Ministry of Communication and Informatics, for viewers to be wiser by watching films through the official site or application so that piracy does not occur.

Abstract

General Background: Accomplice liability under Article 56 of the Indonesian Criminal Code requires proof of intent, reflected in the accomplice’s knowledge and will to facilitate a crime. Specific Background: In Decision No. 882/Pid.B/2024/PN Mdn, the court concluded that intent in accomplice liability was not established, despite evidence showing the defendant knowingly created and transferred mobile banking accounts to a fraud perpetrator for financial gain. Knowledge Gap: Existing studies rarely examine inconsistencies between doctrinal constructions of intent and their judicial application in accomplice liability within fraud cases. Aims: This study analyzes how the element of intent in accomplice liability was assessed and whether the court’s reasoning aligns with criminal law doctrine. Results: Findings indicate that the defendant’s conduct demonstrates knowledge and purposeful assistance fulfilling the subjective elements of fraud under Article 378 KUHP and the intent requirement of Article 56 KUHP. Novelty: This study provides a doctrinal–case analysis showing that judicial misinterpretation of intent can blur the distinction between neutral acts and intentional facilitation. Implications: The results highlight the need for consistent judicial application of mens rea principles to maintain the integrity of criminal responsibility and prevent erroneous exclusions of accomplice liability. Highlights: The case reveals a doctrinal inconsistency in assessing intent for accomplice liability. Evidence shows the defendant’s actions met the subjective elements of fraud.
