Abstract

The increasing development of the economic and industrial sectors requires legal protection for this matter. Industrial design being the face of a franchise is something that can't be separated. To guarantee the existence of a franchise, an agreement is needed that contains a confidentiality license to protect the quality and the absence of plagiarism or counterfeiting. With a confidentiality clause, it can make the design secret of a franchise known only to the parties. However, in practice, violations of this clause often occur. The basic rules used as a reference in this writing are Law Number 31 of 2000 concerning Industrial Design and Government Regulation Number 42 of 2007.

Abstract

This writing was carried out using Normative legal research methods using legal case studies, such as legal reviews. This research also uses a prescriptive approach, this approach is carried out by reviewing all regulations related to legal case studies. The Trade Secrets Law was born because it aims to protect the confidentiality of a company so that it is not known by other companies. This is expected to avoid unfair competition. Trade secrets are part of Intellectual Property Rights. This trade secret can be given to information that is considered confidential, where the parties who have mastered the secret have taken steps that have been determined. Law No. 30 of 2000 concerning Trade Secrets is a complement to Law no. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. The concept of trade secrets itself was discovered by the Chinese around 3000 years BC. A form of legal protection between employers and employees is an employment agreement that contains confidentiality clauses.

Abstract

This research aims to socialize the procedures for holding criminal case trials at the District Court level to inmates. Community Service (PKM) at the Salemba Detention Center was carried out offline with the one-way presentation of material involving lawyers and students from PKBH Untar. The Criminal Procedure Code has explained the stages in a criminal case trial from the first instance, appeal, cassation, and judicial review to the implementation of the judge's decision. The research results show that this outreach is effective in increasing legal awareness and understanding of the trial process among inmates. Through this PKM, it is hoped that they can reduce their uncertainty and anxiety, as well as encourage active and cooperative involvement in the legal process. ABSTRAK Penelitian ini bertujuan untuk mensosialisasikan tata cara penyelenggaraan sidang perkara pidana di tingkat Pengadilan Negeri kepada para warga binaan. Pengabdian Kepada Masyarakat (PKM) di Rutan Salemba dilakukan secara luring dengan pemaparan materi searah yang melibatkan pengacara dan mahasiswa dari PKBH Untar. KUHAP telah menjelaskan tahapan - tahapan dalam sidang perkara pidana dari tingkat pertama, banding, kasasi, dan peninjauan kembali hingga pelaksanaan putusan hakim. Hasil penelitian menunjukkan bahwa sosialisasi ini efektif dalam meningkatkan kesadaran hukum dan pemahaman tentang proses persidangan di antara warga binaan. Melalui PKM ini, diharapkan dapat mengurangi ketidakpastian dan kecemasan mereka, serta mendorong keterlibatan aktif dan kooperatif dalam proses hukum.

Abstract

The Central Jakarta Class I Detention Center or known as the Salemba Detention Center is a place of detention and guidance for defendants or convicts. Where education for prisoners is one of their rights. Where there is a need to carry out counseling regarding the technicalities of trials due to the low knowledge and legal awareness of detainees. The target participants for the counseling are residents of the Salemba Detention Center. In this counseling, participants will be given material in one direction by the speakers, then followed by a question and answer discussion session regarding the material that has been presented. The implementation of this PKM helps increase understanding of the trial process that they will undergo in the future. This is certainly quite helpful, because some of them received wrong information from their fellow prisoners. Of course, in implementing this counseling, better presentation methods are needed to encourage a more interesting atmosphere for the inmates to pay attention to the explanation and not be reluctant to ask questions. ABSTRAK Rumah Tahanan Kelas I Jakarta Pusat atau disebut sebagai Rutan Salemba merupakan tempat penahanan dan pembinaan bagi para terdakwa atau terpidana. Dimana adanya edukasi untuk tahanan merupakan salah satu hak mereka. Dimana terdapat kebutuhan untuk melaksanakan penyuluhan mengenai teknis persidangan dikarenakan rendahnya pengetahuan dan kesadaran hukum para tahanan. Target peserta penyuluhan adalah warga binaan Rutan Salemba. Pada penyuluhan ini, peserta akan diberikan materi secara satu arah oleh para pembicara, kemudian dilanjutkan dengan sesi diskusi tanya jawab perihal materi yang telah disampaikan. Pelaksanaan PKM ini membantu meningkatkan pemahaman proses persidangan yang mana akan mereka jalani kedepannya. Hal ini tentunya cukup membantu, dikarenakan sebagian dari mereka memperoleh informasi yang keliru dari rekan sesama tahanan. Tentunya dalam pelaksanaan penyuluhan ini, metode penyajian yang lebih baik dibutuhkan agar mendorong suasana yang lebih menarik bagi para warga binaan untuk memperhatikan penjelasan dan tidak enggan dalam mengajukan pertanyaan.
