Abstract

The principle of erga omnes, which signifies obligations binding on all parties, has traditionally been associated with international law and human rights. However, its application within state administrative courts remains an underexplored and provocative area of legal theory. This study delves into whether the erga omnes principle can be adapted to revolutionize Indonesia’s State Administrative Court (PTUN) system, drawing on Lawrence M. Friedman’s Legal System Theory as a framework. Friedman’s theory, which emphasizes the interaction of legal rules, legal culture, and the legal environment, offers an insightful lens to analyze the broader implications of applying erga omnes in the domestic administrative context. The findings suggest that while the erga omnes principle could significantly strengthen the role of state administrative courts in ensuring broader societal justice, its implementation presents notable challenges. These challenges include the difficulty in aligning domestic legal systems with the universal and binding nature of erga omnes, the risk of overwhelming courts with cases that require systemic change, and the potential for conflicting interpretations of the principle's scope. Despite these challenges, the study proposes that strategically applying erga omnes could enhance legal coherence, public trust, and accountability in administrative decision-making. This research challenges conventional thinking by proposing an audacious application of international legal principles to domestic administrative law. It provides fresh insights into how judicial reform could reshape the PTUN system, urging policymakers and legal scholars to rethink the boundaries of state administrative justice in Indonesia.

Abstract

Banyaknya jalan rusak dan banjir di provinsi Jawa Tengah menyebabkan banyak keluhan dari warga provinsi Jawa Tengah kepada pemerintah, ditambah dengan cuaca ekstrim yang tidak menentu mengakibatkan perbaikan dan perawatan infrastruktur tersebut perlu untuk dikaji lebih lanjut bagaimanakah upaya yang akan dilakukan oleh pemerintah untuk menangani sekaligus mencegah kejadian serupa kedepannya. Penelitian ini dilaksanakan dengan metode penelitian kualitatif yang mana dilakukan dengan wawancara guna meneliti kondisi objek yang alamiah. Dari berbagai kondisi tersebut, pemerintah tetap melaksanakan perbaikan juga perawatan infrastruktur dengan melakukan kajian lingkungan juga sosialisasi kepada masyarakat karena pengendalian diperlukan konsep pentahelix yang melibatkan pemerintah, masyarakat, dunia usaha (badan atau pelaku usaha), media dan akademisi.

Abstract

In Indonesia, currently many people still use fossil fuels as the main energy source, but with the use of fossil fuels, greater carbon dioxide emissions will be released into the atmosphere, ultimately causing climate change (global warming). To overcome this problem, Indonesia is now starting to adopt techniques that have been used by several countries, namely carbon capture. Carbon Capture and Storage or commonly called CCS or some call it CCUS (Carbon Capture, Utilization and Storage) is one solution to climate change which continues to worsen over time. Indonesia itself is currently preparing 15 projects that will develop and use CO2 capture technology. The research method in the research carried out is using a normative juridical approach. The normative juridical approach is carried out by examining legal principles, legal provisions, legislation and legal mechanisms. Based on the normative type of legal research, several normative approaches are also used, namely the Conceptual Approach and the Statutory Approach. ESDM Ministerial Regulation No. 2 of 2023 does not directly provide benefits to society. This regulation focuses on regulations and incentives for business actors in the upstream oil and gas sector to implement Carbon Capture and Storage (CCS) technology. In Presidential Regulation no. 14/2024 states that holding CCS can be based on three things Carrying out CCS or CCUS implementation in Indonesia begins after obtaining a storage permit for CCS implementation schemes based on permits, whereas for CCS implementation schemes based on cooperation contracts begins when the contractor obtains approval for the proposed field development plan or changes. There are a few things that Indonesia should do such as making a new regulation about funding, insentive and public participation.

Abstract

Penelitian ini mengkaji implementasi kebijakan buku murah dalam pemenuhan hak literasi publik di Kota Semarang dengan menggunakan pendekatan normatif-empiris dan teori utilitarianisme John Stuart Mill sebagai landasan analisis. Melalui survei dan analisis regulasi, ditemukan bahwa keterjangkauan buku masih menjadi hambatan utama bagi mahasiswa dan pelajar, meskipun minat baca masyarakat tergolong tinggi. Kebijakan Indonesia seperti Buku Sekolah Elektronik (BSE) belum mampu menghadirkan pemerataan akses literasi secara berkelanjutan. Sebaliknya, praktik India melalui NCERT, NBT dan mekanisme Low Price Edition menunjukkan model kebijakan yang lebih sistematis dan berdampak luas, termasuk penurunan harga sekitar 20% dan distribusi hingga 150 juta eksemplar. Hasil penelitian menunjukkan bahwa tingginya harga buku menciptakan ketimpangan akses terhadap literatur berkualitas dan mendorong strategi alternatif seperti: pinjam, membeli buku bekas, atau mengakses versi ilegal. Oleh karena itu, penelitian ini menawarkan skema kebijakan "60:40" sebagai solusi, yaitu pemerintah membeli 60% hak ekonomi buku untuk dicetak dalam versi murah, sementara penerbit tetap memproduksi 40% edisi premium. Skema ini dinilai sejalan dengan prinsip utilitarianisme yang menempatkan kebahagiaan intelektual sebagai kesenangan bermutu tinggi, sekaligus mewujudkan amanat UU Sistem Perbukuan untuk menyediakan buku yang bermutu, murah dan merata.

Abstract

Flats are essential infrastructure designed for various purposes, including providing adequate housing for low-income communities. However, policy implementation has yet to be fully effective, as shown by the Pekunden Public Rental Flats (Rusunawa Pekunden) in Semarang, which face issues such as the absence of targeted government policies to address stagnant living patterns of low-income residents and weak management structures. This study aims to: (1) examine the penetration of Singapore’s Housing and Development Board (HDB) Ethnic Integration Policy into Indonesia’s public housing regulations; And (2) analyze the application of Singapore’s housing concepts and policies to improve the effectiveness of flat management in Indonesia. This qualitative research adopts a literature review approach to explore concepts, regulations, and best practices in housing management. The findings indicate that socio-economic segregation can be mitigated through regulatory reforms, including requiring at least 20% of commercial flat floor area to be allocated to low-income residents within the same development. Moreover, adopting HDB principles highlights the importance of centralized management, transparent financing, and social integration policies. In conclusion, strengthening regulations, innovating financing mechanisms, and promoting community participation are key strategies for creating effective, inclusive, and sustainable vertical housing that meets Indonesia’s urban development needs.
