Abstract

The study in this paper seeks to understand various views and ideas about theories regarding the decision-making process in customary law, and what traditional elders consider when making decisions. The decision-making process in customary law is very necessary in resolving the problems of disputing parties. with considerations that can be legally justified. It should be noted that in Indonesia there is no form of law or legal product outside the applicable law, so even resolving customary cases is very difficult. The applicable or written legal provisions must be a reference or guideline that must be followed by the judge handling the case. Keywords: Decision Theory, Customary Law

Abstract

Kajian dalam penulisan ini berusaha untuk memahami berbagai pandangan dan pemikiran tentang perkembangan hukum pidana khususnya hukum pidana Indonesia, terhadap pertanggungjawaban pidana korporasi dalam tindak pidana judi online sesuai UU Nomor 1 Tahun 2024 layaknya perbuatan tindak pidana yang diatur dalam Kitab Undang-undang Hukum Pidana. Bentuk pertanggungjawaban pidana korporasi dalam tindak pidana judi online telah diatur oleh Undang­ undang Nomor 1 Tahun 2024 tentang Perubahan Kedua Atas Undang-undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik diatur dalam Pasal 27 ayat (2) dan ancaman pidana pada pasal 45 ayat (3).Kata Kunci: Pertanggungjawaban pidana Korporasi, Judi online, UU Nomor 1 Tahun 2024
