Abstract

Tujuan dalam penelitian ini adalah Untuk mengetahui peran dan tanggung jawab pemerintah dalam melindungi konsumen terhadap peredaran obat tradisional berbahan kimia, dan untuk mengetahui hambatan-hambatan dalam melindungi konsumen dari peredaran obat tradisional berbahan kimia. Bentuk penelitian yang digunakan adalah bentuk penelitian normatif, dimana penelitian ini menekankan pada penggunaan data sekunder atau berupa norma hukum tertulis, buku-buku pustaka, makalah, media internet dll. Bentuk-bentuk pelanggaran yang dilakukan pelaku usaha telah menimbulkan banyak kerugian yang diderita oleh konsumen, baik kerugian materil maupun immateril. Dengan demikian, pelaku usaha, baik produsen maupun distributor, seharusnya dapat melakukan kewajiban-kewajibannya yang harus ditaati dengan itikad baik dalam menjalankan usahanya. Hambatan dalam melindungi konsumen dari peredaran obat tradisional berbahan kimia yakni banyaknya industri kecil yang berskala besar yang belum terdaftar secara resmi di BPOM, pelaku usaha mengoplos jamu dengan mencampurkan bahan-bahan kimia yang berbahaya bagi kesehatan jika menggunakannya, pelaku usaha dengan sengaja menyembunyikan usaha nya dari masyarakat dan menjalani usaha nya dengan diam-diam serta adanya acuan yang tidak jelas dengan membuat label bertulis logo halal dalam setiap kemasan jamu.

Abstract

The purpose of this study is to examine how crime victims are treated by Indonesia's criminal justice system. This scientific study was written utilizing the normative legal research method, which employs a statutory approach (act approach). The study's findings demonstrate that Indonesia's criminal justice system, which is based on the Criminal Code (KUHAP), places an undue emphasis on offenders and minimal emphasis on victims. The absence of provisions in the Criminal Procedure Code that address the existence of victims of crime is one indication of this. As a result, the crime victim in this instance serves simply as a witness to establish the defendant's guilt in a court of law. In actuality, victims of crimes as much as criminals face the issue of justice and respect for human rights.

Abstract

The Article 54 of Law Number 35 of 2009 concerning Narcotics, Drug Rehabilitation is a repressive action carried out for Addicts and Victims of Narcotics Abuse. This rehabilitation is the restoration to the previous (original) position and the improvement of individuals, hospital patients or disaster victims so that they become useful human beings and can live in society. Rehabilitation actions are aimed at victims of drug abuse to restore or develop the physical, mental, and social abilities of the sufferer concerned. In addition to recovery, rehabilitation is also a treatment or treatment for drug addicts, so that they can recover from their addiction to narcotics. This research is focused on two problem formulations, namely how the legal status of rehab for addicts according to Law Number 35 of 2009. What are the steps of the Government's intervention in efforts to protect Drug Addicts. This research is normative research, which is descriptive analytical and sources of legal materials through primary, secondary, and tertiary legal materials. Legal data collection techniques through document studies (literature studies), such as books, papers, articles, journals, newspapers or works from experts. From the results of this study, the provision of rehabilitation is one of the main objectives in Law Number 35 of 2009 concerning Narcotics. Where Narcotics Addicts can be classified into 2 types, namely people who use Narcotics in a state of physical or psychological dependence and people who abuse Narcotics in a state of physical and psychological dependence.
