Abstract

Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik pada Pasal 1 angka 21 bahwa yang dimaksud Orang adalah orang perseorangan, baik warga negara Indonesia, warga negara asing, maupun badan hukum, sehingga aturan tersebut dapat menjerat pelaku yang merupakan warga negara asing. Berdasarkan latar belakang masalah sebagaimana dikemukakan di atas, maka dapat dirumuskan beberapa masalah antara lain Bagaimanakah Pengaturan peretasan situs website menurut Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik? Dan Bagaimanakah akibat hukum bagi seorang peretas situs website yang merupakan warga negara asing? Metode penelitian yang digunakan adalah metode penelitian normatif yang bertumpu pada pendekatan konsep dan norma serta perundang undangan dengan teknik pengumpulan data melalui studi pustaka. Pengaturan peretasan situs website menurut Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik telah diatur dalam Pasal 30 ayat 1, 2 , dan 3 Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik sementara Akibat hukum bagi seorang peretas situs website yang merupakan warga negara asing dapat dikenakan sanksi berdasarkan Pasal 46 Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik Law Number 19 of 2016 concerning Information and Electronic Transactions in Article 1 number 21 that what is meant by Persons are individuals, both Indonesian citizens, foreign citizens, and legal entities, so that these rules can ensnare perpetrators who are foreign citizens. Based on the background of the problem as stated above, several problems can be formulated, including how are the arrangements for hacking websites according to Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions? And what are the legal consequences for a website hacker who is a foreign citizen? The research method used is a normative research method that relies on the approach of concepts and norms and laws with data collection techniques through literature study. Arrangements for hacking websites according to Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions are regulated in Article 30 paragraphs 1, 2 and 3 of Law Number 19 of 2016 concerning Amendments to Laws -Law Number 11 of 2008 Concerning Information and Electronic Transactions Temporary Legal consequences for a website hacker who is a foreign citizen may be subject to sanctions based on Article 46 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions

Abstract

Indonesia is a country of law that implements a democratic system. One form of democracy in Indonesia is the Election with the establishment of the Election Supervisory Body (Bawaslu) which has the authority to examine, review, and handle election violations. In the application of its authority, there is a lack of uniformity in the application of authority between the Gianyar Regency Bawaslu and the Bangli Regency Bawaslu in the 2024 Pilkada. Therefore, this study aims to determine the application of Bawaslu's authority in handling violations of the 2024 Pilkada in the Bali Province and the resolution of Pilkada violations committed by Bawaslu in the Bali Province in 2024. The research method used in this study is an empirical research method, namely field research that aims to intensively study the background of the current situation and social interactions of a social unit, individual, group, institution or community. The conclusion obtained in this study is that the application of Bawaslu's authority in handling Pilkada violations in the Province of Bali in 2024 in its implementation found that there was a lack of uniformity in the application of authority between Bawaslu Gianyar Regency and Bawaslu Bangli Regency where there was a violation of one person voting more than once and the resolution of the violations committed by Bawaslu Gianyar Regency was by means of a Re-vote while Bawaslu Bangli Regency did not conduct a Re-vote. The resolution of election violations is carried out by Bawaslu in the following ways: the stage of receiving reports/findings, the study stage, the results of the study, plenary meetings, follow-ups and recommendations if there is evidence of election violations consisting of violations of the election code of ethics, administrative election violations, and election crimes.
