Abstract

General elections are a very important thing in democracy. Like two sides of a coin that cannot be separated from each other, the same applies to elections and democracy. The two cannot be separated. If there is a general election then there is democracy. The existence of an election supervisory institution (Bawaslu) which is regulated in Law of the Republic of Indonesia Number 7 of 2017 concerning General Elections is very important in determining the effectiveness of the election implementation process. The aim of the research is to find out the role and function of BAWASLU in holding General Elections and to find out the factors that influence the existence of Gorontalo Regency Bawaslu in holding General Elections. The role and function of Bawaslu in organizing General Elections is based on the position of the position in the form of authority and obligations, while function refers to the duties held by that position, so that the duties and functions of Bawaslu refer to the provisions of Law of the Republic of Indonesia Number 7 of 2017 concerning General Elections, namely in Paragraph 3 of Article 101 and Article 102 concerning duties, Article 103 concerning authority and Article 104 concerning the obligations of Regency/City Bawaslu. Factors influencing the effectiveness of the Gorontalo Regency Bawaslu in holding general elections. People who think pragmatically think that elections are only at the time of voting and do not focus on the programs offered by the people's representative candidates who are taking part in the elections.

Abstract

The importance of the function of elections, especially for changes in the country, is an important basis for many institutions to provide standards for democratic elections. This standard is important because it can be used as a benchmark for the success of the election itself. However, the most important thing of all is that elections must be able to provide guarantees of democratic legitimacy. To achieve this, transparency, accountability, credibility and integrity are needed in the implementation of the election itself so that people trust and believe in the election itself. Until now, effective election supervision is believed to be an instrument capable of providing guarantees for the implementation of democratic elections. This type of research is Sociological Juridical research and the approaches used by researchers in compiling this research are, among others: Statute Approach; case approach (case approach); and Comparative Approach. The results of this research show that in carrying out the supervision stages, Bawaslu has carried out outreach with all ASNs, signed MoU agreements and met with every OPD in every sub-district and neighborhood in Gorontalo City. However, every time the Bawaslu General Election is held, Bawaslu still receives reports of alleged violations from the public that ASN has violated the relevant regulations regarding ASN Neutrality which results in tarnishing democracy in terms of ASN neutrality, this arises because of the existence of inhibiting and supporting factors which can measure how far the success of their role is. owned by Bawaslu in upholding the principle of ASN Neutrality in the 2024 General Election.

Abstract

The phenomenon of exploitation of child buskers is one of the social problems that must be resolved by all groups, both the government and society. This exploitation of children is even carried out by their own parents. The focus of this research study is how the form of legal protection from child exploitation should children get education but only in the market. This study aims to determine the forms of child labor exploitation, the factors that influence working children, and to determine the negative impacts arising from child exploitation. In this study, normative research on written law was examined from various aspects such as aspects of theory, philosophy, comparison, structure/composition, consistency, general explanation. This method is considered suitable by researchers to be used in describing the problem of child exploitation in the Gorontalo district market. Based on the results of this study, biological parents are involved in the form of exploitation of children in the market. Factors that influence children to work in the market are economic factors, family factors, and environmental factors. And the negative impact arising from the exploitation of children in the market is the disruption of children's health, loss of desire to go to school, the emergence of psychological traumas in children. and the emergence of unrest in the community around the red light as well as the community around where the child workers themselves live.

Abstract

General elections in Indonesia have been held 12 times, namely in 1955, 1971, 1977, 1982, 1987, 1992, 1997, 1999, 2004, 2009, 2014 and 2019. And, the general election simultaneously and costing not a few lives occurred in 2019. Basically, the simultaneous general elections held in 2019 had many irregularities, especially the large number of members of ad hoc election organizers who fell ill and died. This happened in almost every region. Does the 2019 general election have anything to do with the increased workload of ad hoc election organizers due to the simultaneous implementation? Type of research uses normative legal research methods. It is called so, because normative research focuses on prescriptive research, using secondary data such as laws and regulations, legal theories, legal principles, and scientific works of legal scholars. The problems that occurred in the 2019 general election can be anticipated by making adequate regulatory modifications in order to create a rational, humane authority, and better election management than the previous period. There needs to be a guarantee of the quality of direct, general, free, secret, honest and fair elections. The implementation of simultaneous elections has provided a heavy workload, long implementation time and very tiring manual vote counting.
