Abstract

This study aims to analyze the role of prosecutors' investigators in uncovering corruption cases, as well as to find out the factors that hinder Gorontalo High Prosecutor's investigators in uncovering corruption cases in the raw water supply project in Bone Bolango Regency. The research method used is empirical legal research or non-doctrinal research, which is a type of legal research that looks at law from a perspective outside of legal science. The results of this study indicate that: (1) the role of the prosecutor in the most basic criminal field is to conduct investigations into special crimes and carry out prosecutions. The Gorontalo High Prosecutor's Office, after receiving information about an alleged corruption case, formed an intelligence team of inspectors to seek initial information in finding allegations of corruption, as well as coordinating with related parties, presenting technical experts to assess the procurement of goods used in the project. If there is a loss to the state, the high attorney will then issue an investigation order and make an investigation plan. (2) In carrying out investigations into criminal acts of corruption in the procurement of raw water in Bone Bolango Regency, there are two things that become obstacles to the Gorontalo High Court, namely the slow results of examinations from technical experts and the slow results of audits from BPKP. Penelitian ini bertujuan menganalisis peranan penyidik kejaksaan dalam mengungkap kasus korupsi, serta mengetahui faktor apa yang menjadi hambatan penyidik Kejaksaan Tinggi Gorontalo dalam mengungkap tindak pidana korupsi pada proyek pengadaan air baku di Kabupaten Bone Bolango. Metode penelitian yang digunakan adalah Penelitian hukum emperis atau penelitian non-doktrinal adalah tipe penelitian hukum yang melihat hukum dari sudut pandang diluar ilmu hukum. Hasil penelitian ini menunjukkan bahwa: (1) peran kejaksaan dalam bidang pidana yang paling mendasar adalah melakukan penyidikan terhadap tindak pidana khusus dan melakukan penuntutan. Kejaksaan Tinggi Gorontalo setelah mendapat informasi adanya dugaan tindak pidana korupsi membentuk tim intelejen pemeriksa untuk mencari informasi awal dalam menemukan adanya dugaan tindak pidana korupsi, serta melakukan koordinasi dengan pihak terkait, menghadirkan ahli teknis untuk menilai pengadaan barang yang digunakan dalam proyek tersebut. Jika terdapat kerugian negara kejaksaan tinggi kemudian mengeluarkan surat perintah penyidikan dan membuat rencana penyidikan. (2) Dalam pelaksaan penyidikan tindak pidana korupsi pada pengadaan air baku di Kabupaten Bone Bolango terdapat dua hal yang menjadi hambatan Kejaksaan Tinggi Gorontalo yaitu lambatnya hasil pemeriksaan dari ahli teknis dan Lambatnya hasil audit dari BPKP.

Abstract

Indonesia is still classified as a country that is in a position of corruption based on the results of the release of Transparency International Indonesia. Even in cases of criminal acts of corruption have reached remote areas. To suppress this rate, the central government to the regions then formed a Task Force for Sweeping Illegal Charges (Satgas Saber Extortion). Has a role to take action against and prevent the occurrence of criminal acts of corruption in the community. This study aims to determine the role of Saber Pungli in eradicating corruption. The research method used is normative-empirical legal research. The results of the study show that Saber Pungli is not yet optimal in carrying out corruption eradication work in the regions.

Abstract

In 2020, as a form of government concern for the high circulation of alcoholic beverages (Miras) in the Serambi Medina area, the Regional People's Representative Council (DPRD) of Gorontalo Province continues to revise the Regional Regulation on Alcoholic Beverages (Perda), which was previously Perda Number 16 of 2015 (concerning the Supervision and Control of Distribution of Alcoholic Drinks). Which is considered not strong enough to stem the circulation of liquor. The results of a 2018 study by the Ministry of Health's Ministry of Health (Kemenkes) research, alcohol consumption in Gorontalo is ranked fourth nationally, only losing to North Sulawesi, East Nusa Tenggara and Bali. The purpose of this study is to see that efforts to eradicate liquor in Gorontalo City are not in accordance with Adat Principles. The novelty of this research helps provide input for local governments to perfect the draft local regulation on controlling liquor in Gorontalo City.

Abstract

The rapid response to COVID-19 by central and local governments relies on Circular Letters, convenient policy tools requiring no external approval. Despite their ease of use, Circular Letters often trigger debates and legal disputes due to inconsistencies in content and legal status.The research methodology employed is normative legal research, conducted by examining library materials or secondary data. The findings of the study reveal that the existence of Circular Letters, which is a form of policy regulation, results from the discretionary power vested in the government. However, as discussed above, there is a lack of consistency among officials regarding the format and content of Circular Letters, leading to some Circular Letters containing legal norms that are generally binding on the public. In contrast, according to the Regulation of the Minister of State Apparatus Empowerment and Bureaucratic Reform of the Republic of Indonesia Number 80 of 2012 and the Regulation of the Head of the National Archives of the Republic of Indonesia No. 2 of 2014, Circular Letters are classified as administrative document products. Consequently, the implication of this research is that Circular Letters should only serve as internal communication tools, providing notifications within the internal organizational structure.

Abstract

The study examines the impact of regional regulations on motorized becak (Bentor) transportation, focusing on Regional Regulation Number 6 of 2006. It finds that while these regulations affect community order and local traditions, they lack adequate legal protection and safety measures for passengers. The research, conducted through empirical normative legal methods, highlights a need for improved legal awareness and enforcement due to numerous traffic violations and Bentor accidents. The study suggests a review of the regulation's substance to accommodate better the unique characteristics and needs of Bentor transportation within Gorontalo Province.

Abstract

E-purchasing in Gorontalo Province is not yet optimal, hindered by implementation obstacles and the potential for fraud. The lack of studies on the effectiveness of procurement of goods/services through e-purchasing is a concern. Juridical-normative research with a comparative and conceptual approach reveals that e-purchasing in the province is not fully effective. Implications include the potential for price manipulation, bribery, fictitious transactions, administrative malpractice, and inefficiency. The study highlights issues such as the potential for Price Setting by Procurement Service Unit and Providers, Bribery and Gratification Potential, Fictitious Transactions, Administrative Malpractice/Non-negotiation, Failure to Check Product Specifications, High Prices, Waste, and Inefficiency in the procurement of Goods/Services through e-purchasing in Gorontalo Province.

Abstract

Anomali harga bahan pangan baik di tingkat produsen dan konsumen terjadi secara ekstrim dari tahun ke tahun. Jalur utama terjadinya anomali harga pangan ini lebih disebabkan factor politik-ekonomi pangan nasional yang cenderung berpatron pada mekanisme pasar. Signifikansi dan relevansinya mendorong bentukan pasar pangan menjadi cendeurng oligopoly bahkan monopoli. Bentukan pasar seperti ini menjadi penyebab utama panjangnya mata rantai distribusi, mahalnya biaya logistik serta hubungan konsumen dan produsen yang sangat random. Produsen dan konsumen mudah didikte pemilik modal (pelaku usaha besar). Penelitian ini adalah penelitian hukum normatif, yang menggunakan metode doctrinal dalam menganalisis eksistensi konstitusi melalui ketahanan pangan prinsip-prinsip dan normanorma perundang-undangan yang berkaitan dengan Urgensi Pengaturan Hak Atas Pangan Warga Negara dalam Amandemen Kelima UUD 1945. Tujuan penelitian ini guna menganalisi Upaya penguatan pasokan dan perdagangan harus dibuat efisien dan didukung sistem serta kelembagaan negara yang kuat. Hal ini bisa dimulai dengan merubah paradigma berfikir dari pendekatan ketahanan pangan ke kedaulatan pangan. Sebagaimana amanat konstitusi pasal 33 UUD 1945, dalam kaitan ini, untuk mencapai setabilitas harga pangan maka harus digalakan upaya pemulihan berbasis integrasi pangan dari hulu ke hilir di bawah kendali negara lewat peran BUMN pangan (Bulog) dan Koperasi Pangan baik di tingkat petani dan konsumen. Lantaran itu, perlu difikirkan amandemen ke-5 UUD 1945 untuk memperkuat pasal 33 dalam mewujudkan kedaulatan dan ketahanan pangan yang lebih berpihak pada petani dan masyarakat.

Abstract

The phenomenon of exploitation of child buskers is one of the social problems that must be resolved by all groups, both the government and society. This exploitation of children is even carried out by their own parents. The focus of this research study is how the form of legal protection from child exploitation should children get education but only in the market. This study aims to determine the forms of child labor exploitation, the factors that influence working children, and to determine the negative impacts arising from child exploitation. In this study, normative research on written law was examined from various aspects such as aspects of theory, philosophy, comparison, structure/composition, consistency, general explanation. This method is considered suitable by researchers to be used in describing the problem of child exploitation in the Gorontalo district market. Based on the results of this study, biological parents are involved in the form of exploitation of children in the market. Factors that influence children to work in the market are economic factors, family factors, and environmental factors. And the negative impact arising from the exploitation of children in the market is the disruption of children's health, loss of desire to go to school, the emergence of psychological traumas in children. and the emergence of unrest in the community around the red light as well as the community around where the child workers themselves live.

Abstract

Currently, many criminal acts are often committed, such as violence. Violence is an arbitrary act committed by someone with the aim of causing physical or psychological harm. Parents have an important role to protect and protect, but instead acts of violence against children are carried out by those closest to them, such as parents. Child Victims of violence who are part of a society whose development is immature both physically and psychologically require special assistance in handling it. This study aims to determine the emergence of factors that cause victims of physical violence against children in the Gorontalo region to reduce the number of victims of acts of violence against children. Which examines the existence of violence perpetrated against children. Data collection was done by interview technique. So a way is needed so that acts of violence against children are not continuously carried out and strict action must be given by the government to the perpetrators who commit violence. So it is deemed necessary to emphasize the regulations that have been implemented in the government, especially Law Number 23 of 2002 concerning child protection
