Abstract

Fenomena Catcalling di Indonesia telah menjadi sesuatu yang lazim bagi masyarakat secara umum dan diyakini masuk akal. Lalu masyarakat juga berlagak lumrah seolah-olah mereka tidak memahami dampak terhadap korban catcalling. Sedang definisi catcalling adalah pelecehan ekspresi yang bisa dipahami sebagai tindakan yang menggunakan kata-kata yang eksplisit secara seksual, porno atau genit hingga menggoda dan merayu orang lain yang mengarah pada perasaan tidak nyaman, tidak aman. Catcalling juga termasuk dalam pelecehan non fisik karena terjadi tanpa persetujuan/sukarela. Dalam jurnal ini, penulis memilih menerapkan metode yuridis normatif dengan pendekatan konseptual dan pendekatan peraturan perundang-undangan. Pendekatan konseptual yakni dengan mengkaji teori-teori yang berkaitan dengan penanganan kasus catcalling di Indonesia. Sedang pendekatan peraturan perundang-undangan menganalisis segala aturan yang berkaitan dengan penanganan kasus catcalling di Indonesia. Berdasarkan hasil pembahasan, penulis dapat menyimpulkan bahwa kekosongan standar hukum terkait catcalling memaksa aparat penegak hukum menggabungkan beberapa ketentuan dalam KUHP dan UU No. 44 Tahun 2008. Sejumlah pasal yang dijadikan dasar hukum penanganan kasus catcalling adalah Pasal 281 ayat (2) dan Pasal 315 KUHP serta Pasal 8, Pasal 9, Pasal 34 dan Pasal 35 UU No 44 Tahun 2008 mengenai pornograf. Memang catcalling relevan dengan empat pasal tersebut, namun penerapan Pasal 8, Pasal 9, Pasal 34, dan Pasal 35 sebenarnya juga tidak bisa menjamin kejelasan hukum terhadap tindakan catcalling lantaran pemfokusan keempat pasal tersebut hanyalah melarang menjadikan orang lain sebagai model atau objek tindakan pornografi. Jenis tindakan yang dilarang belum ditentukan dengan tegas dan jelas.

Abstract

Penelitian ini membahas mengenai relevansi antara tindak pidana memperdagangkan pengaruh dan gratifikasi dalam tindak pidana korupsi di Indonesia. Berdasarkan laporan Indonesia Corruption Watch (ICW) pada tahun 2023, kasus korupsi menunjukkan peningkatan yang signifikan, dengan kerugian negara mencapai Rp 28,4 triliun. Penelitian ini mengkaji kelemahan regulasi terkait gratifikasi yang hanya terbatas pada pihak-pihak yang memiliki kewenangan formal, sementara perdagangan pengaruh seringkali melibatkan pihak-pihak yang tidak secara langsung memegang jabatan formal. Penelitian ini menggunakan metode yuridis normatif, dengan fokus pada analisis peraturan domestik dan praktik internasional, seperti United Nations Convention Against Corruption (UNCAC). Hasil penelitian menunjukkan bahwa perdagangan pengaruh merupakan modus yang kompleks karena melibatkan hubungan trilateral antara pemberi, penerima, dan perantara, dan sering kali tidak dapat dijangkau oleh peraturan yang ada. Studi kasus menunjukkan bagaimana pengaruh politik dapat dimanfaatkan untuk kepentingan pribadi, meskipun pelakunya tidak memiliki jabatan formal. Penulis merekomendasikan reformulasi Undang-Undang Tindak Pidana Korupsi untuk memasukkan perdagangan pengaruh sebagai tindak pidana yang dapat dituntut, sehingga memberikan dasar hukum yang lebih kuat untuk menjerat pelaku korupsi dengan modus ini.

Abstract

The criminalization of immoral acts through Law Number 1 of 2023 concerning the New Criminal Code (KUHP) is in the spotlight. According to article 411 of the New Criminal Code, every person who has sexual intercourse with someone who is not their husband or wife is punished for adultery, including those who are not married. The criminalization of perpetrators who are not in a sexual marriage will have the potential to ensnare underage teenagers who have had premarital relations. The 2017 Indonesian Demographic and Health Survey (SDKI) (conducted every 5 years) revealed that among women and men who had had premarital sexual relations, 59% of women and 74% of men were teenagers aged 15-19 years. The expansion of the formulation of the offense of adultery will certainly affect the juvenile criminal justice system (SPPA) considering that currently the implementation and regulation of SPPA is still weak and far from ideal. This research aims to outline how the possible influence of the formulation of the regulation of the crime of adultery or overspill according to the new Criminal Code could greatly influence the juvenile criminal justice system in Indonesia. Using normative juridical methods and a "comparative" approach to answer the formulation of the crime of adultery in the New Criminal Code which can ensnare minors or teenagers will it can make the juvenile criminal system in Indonesia more difficult.

Abstract

Pregnancy due to rape is a pregnancy that occurs outside of a person's will. When the victim is faced with violence or threats of violence, the victim is forced to have sex with the perpetrator outside of marriage. Therefore, that unwanted pregnancies generally result in abortion. In Indonesia, the incidence of unwanted pregnancies reaches 121 million per year. This figure shows that there are 64 unwanted pregnancies occurring in every 1,000 women aged 15-49 years and it is recorded that 73.3 million abortions occur each year, which is equivalent to 39 abortions per 1,000 women each year. Normatively, abortion is regulated by Health Law No. 17 of 2023, Article 60, which prohibits everyone from having an abortion except for the criteria permitted by national criminal law. This study seeks to analyzes Indonesia’s criminal law policy on abortion decriminalization and legal gaps for rape victims over 14 weeks gestation, using a normative juridical approach to examine relevant laws and their alignment with state policy. The decriminalization of abortion through the 2023 national criminal code is a criminal law policy that is harmonized from the previous law and abortions carried out based on the new national criminal law policy have a tendency to be victim-oriented. Although abortion has been decriminalized, the government has yet to establish clear policies, systems, and legal protections for rape victims with pregnancies over 14 weeks.

Abstract

An Advances in information technology in the industrial revolution 5.0 have brought major changes and impacts. This also makes the modes of crime increasingly varied, which can be detrimental to the economic stability of society. In February 2022, Bareskrim Polri arrested a number of people who spread fake news using online fraud on the binomo or binary options application where the perpetrators laundered money from the proceeds of the crime. In the legal process of this binomo case, the panel of judges through Supreme Court Decision No. 2029k/Pid.Sus/2023 makes a breakthrough in standards for confiscation and return of assets proceeds from crime to victims amidst the absence of specific regulations to handle confiscation of assets proceeds from crime in Indonesia. For this reason, this research aims to identify the asset confiscation model that is applied to the binomo case to create an ideal confiscation model for the proceeds of money laundering crimes so that it can be applied as an alternative to fill legal gaps. Using normative juridical methods involving theory, legal principles and related legal regulations as well as asset application compliance studies from several countries.
