Abstract

Indonesia has regulated labor law, specially UU Cipta Kerja. In Government law No 35 of 2021 article (15), it is stated that employers have the obligation to pay compensation money to employees when their term of employment ends on a fixed-term contract (PKWT). The purpose of this research is to determine the implementation of providing compensation to PKWT at PT. Atalian Global Services to its employees in accordance with statutory regulations. The research method is normative-empirical legal research carried out using data collection methods through interview techniques with 30 sources and secondary data from the results of literature studies. The results of this research showed that the implementation of PKWT compensation at PT. Atalian Global Services does not follow Government regulation no. 35 of 2021 because the outsourcing company has not received payment from the main company, whereas according to the worker's perspective, the worker only hopes that the compensation will be paid immediately because this is the worker's right and obligation for the company.

Abstract

Penelitian ini bertujuan untuk menganalisis peran pendidikan kewarganegaraan dalam pembangunan karakter dan integritas warga negara. Selain itu, penelitian ini juga akan menawarkan strategi dan pendekatan baru dalam implementasi pendidikan kewarganegaraan, sehingga dapat lebih efektif dalam membentuk warga negara yang berintegritas. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi literatur. Metode ini dipilih untuk memperoleh pemahaman yang mendalam tentang peran pendidikan kewarganegaraan dalam pembangunan karakter warga negara yang berintegritas. Melalui penelaahan berbagai sumber literatur, penelitian ini akan mengidentifikasi dan menganalisis tema-tema penting terkait topik tersebut.

Abstract

The existence of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, in Article 88A Paragraph (1) which states that the Rights of Workers/Laborers to Wages arise when an Employment Relationship occurs between the Worker/Laborer and the Employer and ends when the Employment Relationship is terminated, in the Lawsuit for Disputes over Rights to Wages filed with the Industrial Relations Court by workers Adi Priyanto and Yussak Andrian against PT Nippisun Indonesia because the Workers' Wages were not paid even though the Workers' employment relationship had not been terminated and the Panel of Judges who examined the lawsuit issued a Decision in the main case, namely Rejecting the Plaintiffs' lawsuit in its entirety, the legal considerations of which cannot be considered, because they are not legally based. so that it should be declared rejected, then the first problem is how the Payment of Wage Rights in Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation and secondly, how the Legal Considerations of the Industrial Relations Court Panel in decision Number: 153/Pdt.Sus-PHI/2024/PN Bdg, concerning the Case of Payment of Wage Rights have been in accordance with applicable regulations, the research method used by the author is normative legal research, namely research on the application of law, and it was concluded that the Legal Considerations of the Industrial Relations Court were very ambiguous and wrong in applying the law.
