Abstract

Grants are in principle irrevocable, but there are certain conditions that allow grants to be canceled. If the conditions of the grant are not met by the grantee, the grantor has the right to withdraw the property that has been donated in accordance with the initial agreement. This study aims to find out whether the decision to cancel the grant at the Yogyakarta State Service number 45/Pdr.G/2023/PN Yyk regarding the cancellation of the grant is in accordance with the applicable legal provisions or not, and to find out the legal consequences of the cancellation of the grant on the certificate of transfer results. Where the legal consequences also have a legal impact on the parties involved. The research method used is Normative Juridical with analytical descriptive research specifications. The type of data used is secondary data. The data collection technique used is library study, then using qualitative data analysis. Based on this research, the results were obtained: First, Decision Number 45/Pdt.G/2023/PN Yyk regarding the cancellation of grants has been in accordance with the applicable legal provisions. Second, the legal consequences of the cancellation of grants to the status of the transitional certificate, namely the return of property that has been donated in the form of land and buildings to the grantor along with his rights. This legal writing is expected to help and provide input and additional knowledge for the parties regarding the issues being researched and are useful for parties interested in the same issue.

Abstract

Dalam praktik ditemukan masyarakat yang melakukan transaksi jual beli tanah secara dibawah tangan, Perjanjian jual beli tanah yang tidak dibuat dihadapan PPAT dapat menimbulkan kerugian bagi pihak pembeli, seperti pada kasus putusan Nomor 566/Pdt.G/2023/PN.Smg. Tujuan dari penelitian ini  mengenai keabsahan dan kekuatan hukum perjanjian jual beli tanah yang tidak dibuat dihadapan PPAT serta menganalisis pertimbangan hukum putusan Hakim Pengadilan Negeri Semarang terhadap Putusan Nomor 566/Pdt.G/2023/PN.Smg. Penelitian ini menggunakan pendekatan yuridis normatif. Metode yang digunakan dalam penelitian ini adalah studi kepustakaan serta dianalisis dengan menggunakan pendekatan kualitatif. Hasil penelitian bahawa: 1) Keabsahan dan kekuatan hukum perjanjian jual beli tanah dibawah tangan dengan objek sertipikat hak guna bangunan adalah sah sesuai dengan pasal 1320 KUHPerdata dan mempunyai kekuatan hukum yang sama seperti akta otentik. 2) Analisis pertimbangan hakim dalam putusan Nomor.566/Pdt.G/2020/PN.Smg bahwa majelis hakim telah memberikan dasar hukum bagi Penggugat untuk melanjutkan peralihan hak dengan menggunakan salinan resmi putusan pengadilan.

Abstract

A Will (testament) is a legal instrument containing a person’s declaration regarding what he or she wishes to take effect after death, and it may be revoked by the testator at any time. In practice, a testator often does not inform family members or even beneficiaries of the existence of a will, with the expectation that upon death the will shall be implemented and the estate distributed in accordance with its provisions. This study examines the legal consequences of a will that is unknown to the heirs and beneficiaries after the distribution of the estate has been carried out, as well as the measures that must be undertaken prior to the execution of inheritance distribution. This research employs a normative juridical research method with a statutory approach. A will that is unknown to the heirs remains valid and retains its legal force. Where the distribution of inheritance is not based on an existing will, such distribution may prejudice the beneficiaries designated in the will. Consequently, the beneficiaries are entitled to assert their rights against the heirs and may demand a redistribution of the inheritance in accordance with the will. The procedure that must be undertaken prior to the distribution of inheritance is the verification of the existence of a will through the Central Register of Wills, which may be facilitated by a Notary by complying with the procedures stipulated in the Regulation of the Minister of Law of the Republic of Indonesia No. 16 of 2025.

Abstract

The rapid development of the digital economy has given rise to various forms of digital assets such as cryptocurrencies, Non-Fungible Tokens (NFTs), and digital tokens, challenging the structure of Indonesian civil law, which is still based on the colonial legacy of the Civil Code. This study aims to examine two main issues: first, the legal status of digital assets in the Indonesian civil law system from the perspective of property law; and second, how the legal regulation of digital assets in the modern legal system in Indonesia. This study uses a normative legal research method with a statute approach and a conceptual approach. Primary legal materials include the Civil Code, the P2SK Law Number 4 of 2023, POJK Number 27 of 2024, and the UNIDROIT Principles on Digital Assets and Private Law (2023). The results show that doctrinally, digital assets can be categorized as intangible objects (onlichamelijke zaken) based on the open construction of Article 499 of the Civil Code, although without explicit normative recognition. Ownership of digital assets is realized through control of private keys, which is functionally equivalent to the concept of possession in the Indonesian Civil Code, while the transfer of rights occurs through a leveraging mechanism based on on-chain transactions. On the regulatory side, there is a serious legal vacuum: existing regulations are sectoral and lack synergy, consumer protection is inadequate, and cross-border jurisdiction issues remain unresolved. This study concludes that Indonesia requires a three-layer legal reform: updating Book II of the Indonesian Civil Code to recognize digital assets as a separate category of objects, drafting a specific integrated digital asset law, and adapting smart contract regulations within the national contract law system, with reference to the European Union's MiCA and the UNIDROIT Principles 2023 as international comparative guidelines.
