Abstract

Consuming medication is an effort to maintain and maintain health. The high demand for medicines and low consumer knowledge create opportunities for business actors to produce fake medicines. The aim of this research is to determine the causes of the spread of fake patent medicines as well as the legal protection for consumers regulated in law along with BPOM's efforts to prevent the spread of fake patent medicines. The research method used in this research is empirical juridical, the research specifications used are analytical descriptive with data collection techniques through direct research in the field, namely open interviews and literature studies. Based on the research results obtained, the causes of the circulation of counterfeit patent medicines in influenced by business actors and consumer factors. Repressive legal protection for consumers is regulated in the Consumer Protection Law Article 8 Paragraph 1 Letter (a), Law Number 17 of 2023 concerning Health Article 138, Article 140 and Article 142. Apart from that, it is also regulated in the Regulation of the Medicine Supervisory Agency and Food Number 34 of 2018 concerning Guidelines for Implementing Good Medicine Manufacturing Methods. The prevention efforts carried out by BPOM are carried out in two forms, namely pre-market control in the form of standardization and product evaluation and post-market control in the form of Communication, Information and Education (KIE).

Abstract

The arbitration award results in a final and binding decision. However, an annulment attempt can be made based on Article 70 of the ADR Law which is directed at the District Court. This is contrary to the principle of non-intervention of the court in Articles 3 and 11 of the ADR Law. The urgency of this study is to determine the authority of the court and the use of the provisions of Article 70 in the annulment of an arbitration award after the issuance of the Constitutional Court Decision Number 15/PUU-XIII/2015 and Supreme Court Regulation number 3 of 2023. This study uses a normative legal approach with analytical descriptive research specifications. The sources and types of data used are secondary data collected through literature which are analyzed descriptively qualitatively. The results of the study indicate that the District Court only has the authority to cancel based on the elements of Article 70 of the ADR Law without being accompanied by an act of trying it itself. The use of the provisions of Article 70 of the ADR Law still has different opinions even though the Constitutional Court has issued a decision Number 15/PUU-XIII/2015, as in the Semarang District Court Decision No. 01/Arbitrase/2016/PN.Smg and the Supreme Court Decision No. 480B/Pdt-Sus-Arb/2017. The follow-up to the Constitutional Court decision was then made by Supreme Court Regulation number 3 of 2023 to regulate further. However, the regulation still does not clearly regulate the use of the provisions of Article 70 of the ADR Law which contains criminal elements but is carried out in a civil manner. The ambiguity in terms of evidence related to the norms contained in Article 70 will potentially cause legal uncertainty for justice seekers.

Abstract

Tujuan dari penelitian ini adalah menganalisis fenomena liberalisasi perdagangan terkait krisis perjanjian WTO di negara-negara organisasi kerja Islam. Menekankan etika ekonomi Islam terkait globalisasi ekonomi modern. Metode yang digunakan adalah penelitian yuridis normatif, data yang dikumpulkan berasal dari studi literatur dan studi pustaka. Hasil penelitian menunjukkan bahwa upaya merespon fenomena ini, integrasi konsep keadilan ('adl), keseimbangan (mizan), dan manfaat (maslahah) ke dalam kebijakan perdagangan internasional negara-negara OKI sebagai keadilan dalam fondasi dalam memastikan bahwa manfaat liberalisasi dinikmati secara merata oleh negara berkembang, terutama anggota OKI.  Penelitian ini memberikan rekomendasi untuk sinergi yang kuat antar negara-negara anggota OKI untuk memperkuat solidaritas ekonomi Islam internasional, membentuk kebijakan kolektif yang mendukung nilai-nilai syariah, dan memperjuangkan sistem perdagangan global yang lebih adil dan manusiawi. Integrasi nilai keadilan, keseimbangan, dan manfaat dalam kebijakan perdagangan tidak hanya mendukung ketahanan ekonomi negara-negara OKI, tetapi juga memberikan kontribusi nyata bagi Islam dalam membangun tatanan ekonomi dunia yang lebih merata.

Abstract

The rapid growth of the concert industry in Indonesia has not been matched by adequate consumer protection practices. Consumers often face issues such as ticket fraud, sudden cancellations without compensation, changes in event venues, and misleading promotional content. This research identifies the gap between legal consumer protection frameworks and their actual implementation in the concert sector. Using a normative juridical method with a prescriptive-analytical approach, this study analyzes how consumer rights are neglected in transactions involving concert services. The findings reveal that many organizers fail to act transparently or responsibly, leading to significant material and immaterial losses for consumers. Moreover, existing complaint mechanisms remain ineffective and lack enforcement power. The study implies an urgent need for specific regulations to govern concert organization practices, including refund procedures, clear communication, and fair dispute resolution. Strengthening institutional capacity and regulatory oversight is essential to ensure accountability and safeguard consumer interests in the entertainment industry.
