Abstract

Purpose: This study aims to analyze the application of the As Salam contract in the purchasing system of garlic between retail traders and importers in Medan, Indonesia. Research Methodology: The research utilizes a qualitative approach, employing observation and structured interviews with key participants in the garlic trading industry. The instruments include interview guides and observational checklists to gather detailed insights into the contract negotiation and execution process. Results: The findings indicate that the trading practice involves detailed contract agreements, including specific terms on quantity, quality, and delivery schedules. The principles of the As Salam contract are strictly adhered to, ensuring clarity and minimizing the potential for disputes. Prepayment is an integral part of the contract, facilitating efficient stock planning and delivery logistics. Limitations: The study is limited to the garlic trade within the Medan region, which may restrict the broader applicability of the findings to other commodities or regions. Contribution: This research contributes to the discipline of Islamic economics by providing practical insights into the implementation of As Salam contracts in commodity trading, offering a model for ensuring fairness and transparency in accordance with Islamic law.

Abstract

Pemerintah berkomitmen untuk memajukan ekonomi Islam, terutama sektor keuangan syariah yang menduduki pangsa sebesar 10,69% dalam keuangan nasional Indonesia. Namun, tantangan global mempengaruhi perkembangan ekonomi syariah, makanya penting penetapan hukum Islam yang mendorong penggunaan ijma’. Penelitian ini bertujuan untuk mengidentifikasi apakah Ijma’ masih memainkan peran dalam penetapan fatwa-fawa praktik keuangan Islam kontemporer dan juga menyoroti praktik Ijtihad Jama'i dalam membentuk fatwa-fawa tersebut. Metode penelitian ini menggunakan literature analysis untuk menggambarkan dan mengevaluasi data dari berbagai sumber guna mencapai kesimpulan. Hasil penelitian menunjukkan peran Ijma' tetap relevan dalam keuangan syariah, menegakkan prinsip Syariah dan memberi legitimasi hukum di Indonesia sesuai dengan kesepakatan ulama yang telah disahkan dalam bentuk Fatwa DSN MUI. Fatwa yang dikeluarkan oleh DSN-MUI bisa dibagi menjadi sembilan kategori, mulai dari perbankan, asuransi, pasar modal, hingga pasar komoditas syariah. OJK mencatat sembilan jenis akad yang digunakan dalam transaksi perbankan syariah, termasuk wadi'ah, mudharabah, musyarakah, murabahah, dan lainnya. Sejak tahun 2000, DSN-MUI telah mengeluarkan 156 fatwa, dan dari jumlah itu, 41 di antaranya menggunakan ijma' sebagai sumber hukum dalam penentuannya. Dalam hal ini, diperlukan pendekatan hati-hati dalam penerapannya di era modern dan memperkuat Ijtihad Jama'i dan kolaborasi antara ulama dan lembaga keuangan syariah untuk fatwa yang komprehensif.

Abstract

At the end of 2019 there was a global change due to the corona virus, the virus known as covid-19 first appeared in the city of Wuhan, China. WHO officially announced this respiratory virus as a pandemic in early 2020. This virus causes the death rate to continue to increase both in Indonesia and in the world. This virus affects various sectors, one of the sectors most affected is the economic sector. The virus that brought the community's economy also declined drastically because this outbreak caused a lot of decline in the wheels of community business. Many companies are laying off their employees so that the banking sector, industry and others are affected. The unemployment rate is increasing, and also in the micro-economic sector, many MSMEs have decreased and even went bankrupt. MSME turnover has decreased while MSMEs need capital assistance for their business. To handle and support MSMEs, the role of financial institutions is very much needed. One of the financial institutions that play a role in providing capital for MSMEs is Islamic banking. Because Islamic banking focuses on the real sector. Even so, Islamic banks need a strategy before providing financing so that Islamic banks can maintain financial stability during the pandemic. In this study used descriptive qualitative methods, which this research uses field studies to obtain accurate information by conducting interviews, data analysis and data credibility to get good results. So we know that during the pandemic there are banks providing concessions. And the policy is carried out on each financial institution which has its own policy. Noble from reducing the amount of installment fees and so on.
