Abstract

Being aware of the law and then being able to understand rights and obligations before the law and ensuring legal protection for Micro, Small and Medium Enterprises (MSMEs) activists is the ideal condition that we all hope for to create the growth of MSMEs in Indonesia. It is clear that MSMEs activists as an important component in economic development in Indonesia need legal certainty and protection. For the role of all parties, one of them is academician, namely lecturers or instructors, it is very necessary. Through the spirit of the Tridharma of University, academician can contribute through legal counseling programs to ensure that legal protection is given to MSMEs activists. Through counseling for MSMEs activists in cooperation with the Yayasan Inspirasi Indonesia Membangun (YIIM) in the Kebayoran Baru District area, South Jakarta Municipality, it is hoped that this will become a good portfolio for the contribution of academician to strengthening MSMEs, especially legal literacy so that MSMEs activists are able to identify and find solutions to various cases encountered in daily life.

Abstract

The empowerment of assisted citizens in the Detention Center is a very important component in building a sustainable chain of empowerment up to the Correctional Institution level and can later continue to the Correctional Center level, as the last gate that debriefs fostered residents to return to the community. In addition to the government, academics, as a component of the nation's children, must take an important role in this program through community service so that the presence of academics will be greatly felt by the community, especially fostered citizens. Of course, academics cannot run alone; they must synergize with other components, both social activists and business people who can help fund community service programs. So that the synergy will produce an excellent portfolio, especially in the field of empowerment of prison-assisted citizens. Through the social entrepreneurship training program, it is hoped that it can provide provisions to the assisted residents of the Pondok Bambu Class 1 Detention Center and also provide wider inspiration so that all parties can take a role so that the sustainability of empowerment can continue to be carried out.

Abstract

ABSTRAK : Artikel ini menganalisis mekanisme pengawasan administrasi negara di Indonesia dengan fokus pada implementasi oleh lembaga-lembaga kunci seperti Badan Pemeriksa Keuangan (BPK), Komisi Pemberantasan Korupsi (KPK), Ombudsman Republik Indonesia, Pengadilan Tata Usaha Negara (PTUN), dan Komisi Informasi Publik. Melalui kajian ini, diidentifikasi bahwa meskipun regulasi seperti Undang-Undang tentang Pemeriksaan Pengelolaan dan Tanggung Jawab Keuangan Negara dan Undang-Undang Keterbukaan Informasi Publik memberikan landasan hukum yang kuat, efektivitas pengawasan sering terhambat oleh tantangan signifikan, termasuk kekurangan sumber daya manusia, budaya birokrasi yang tidak mendukung, serta adanya regulasi yang tumpang tindih dan inkonsistensi dalam implementasi. Tantangan tambahan muncul dari tekanan politik yang dapat mempengaruhi independensi lembaga pengawas dan dari kebijakan yang tidak mendukung transparansi penuh. Untuk meningkatkan efektivitas pengawasan, dibutuhkan upaya berkelanjutan untuk memperbaiki regulasi, memperkuat kapasitas aparatur, dan mendorong partisipasi masyarakat dalam proses pengawasan. Kata Kunci: Mekanisme Pengawasan, Regulasi Administrasi, Tantangan Pengawasan ABSTRACT : This article analyzes state administrative oversight mechanisms in Indonesia with a focus on implementation by key institutions such as the Supreme Audit Agency (BPK), Corruption Eradication Commission (KPK), Ombudsman of the Republic of Indonesia, State Administrative Court (PTUN), and Public Information Commission. Through this study, it was identified that while regulations such as the Law on Audit of State Financial Management and Responsibility and the Law on Public Information Disclosure provide a strong legal foundation, the effectiveness of oversight is often hampered by significant challenges, including human resource shortages, an unsupportive bureaucratic culture, and overlapping regulations and inconsistencies in implementation. Additional challenges arise from political pressures that can affect the independence of oversight institutions and from policies that do not support full transparency. To improve the effectiveness of oversight, sustained efforts are needed to improve regulations, strengthen the capacity of the apparatus, and encourage public participation in the oversight process. Keywords: Oversight Mechanisms, Administrative Regulations, Oversight Challenges.

Abstract

ABSTRAK Global Compact Perserikatan Bangsa-Bangsa (UN Global Compact) adalah inisiatif yang luar biasa untuk mengintegrasikan dunia bisnis dan kepatuhan terhadap hak asasi manusia. Global Compact berangkat dari sebuah inisiatif besar yang di motori oleh Profesor John Ruggie perannya melahirkan Prinsip Pemandu PBB mengenai Bisnis dan Hak Asasi Manusia (United Nations Guiding Principles on Business and Human Rights, dikenal pula sebagai Ruggie Principles) pernah menjabat sebagai Pelapor Khusus PBB mengenai Bisnis dan Hak Asasi Manusia. Meskipun sifatnya belum mengikat secara hukum, namun inisiatif ini dapat menjadi rujukan dan panduan bagi seluruh negara-negara didunia agar berkontribusi dalam memastikan penghormatan, perlindungan dan pemajuan hak asasi manusia dalam sektor bisnis. Gerakan ini diharapkan dapat mencegah beragam pelanggaran hak asasi manusia yang dapat terjadi pada sektor bisnis baik melibatkan perusahaan bersekala nasional maupun perusahaan multi-nasional. Global Compact diharapkan menjadi inisiator tanggungjawab sosial perusahaan berkelanjutan berbasis pada sepuluh prinsip khususnya prinsip pertama dan kedua dalam menjalankan kegiatan bisnis diseluruh dunia. Global Compact juga selaras dengan Tujuan Pembangunan Berkelanjutan (TPB) (Sustainable Development Goals disingkat SDGs) sebelumnya adalah Tujuan Pembangunan Milenium (Millennium Development Goals disingkat MDGs). Kata Kunci : Deklarasi Universal Hak Asasi Manusia,  Global Compact,  Global Inisiatif,  Hak Asasi Manusia dan Bisnis, Hak Sipil dan Politik, Hak Ekonomi Sosial dan Budaya, Perusahaan, Akuntabilitas. ABSTARCT The United Nations Global Compact (UN Global Compact) is an extraordinary initiative to integrate world business and comply with human rights. The Global Compact began as a major initiative driven by Professor John Ruggie who promoted the United Nations Guiding Principles on Business and Human Rights, also known as the Ruggie Principles. He served as the UN Special Rapporteur on Business and Human Rights. Even though it is not yet legally binding, this initiative can be a reference and guide for all countries in the world to contribute to ensuring respect, protection and promotion of human rights in the business sector. It is expected that this movement can prevent various human rights violations that occured in the business sector, both involving national companies and multi-national companies. The Global Compact is expected to be the initiator of sustainable corporate social responsibility based on ten principles, especially the first and second principles, in carrying out business principles throughout the world. The Global Compact is also in line with the Sustainable Development Goals (SDGs), previously the Millennium Development Goals (MDGs).Keywords:  Universal Declaration of Human Rights, Global Compact, Global Initiatives, Human Rights and Business, Civil and Political Rights, Economic Social and Cultural Rights, Corporate, Accountability.

Abstract

Abstrak : Pengertian dari tindak pidana oleh korporasi merupakan tindak pidana yang dilakukan oleh orang berdasarkan hubungan kerja atau berdasarkan hubungan lain, baik sendiri-sendiri maupun bersama-sama yang bertindak untuk dan atas nama korporasi di dalam maupun di luar lingkungan korporasi. Pertanggungjawaban pidana korporasi terhadap perusakan hutan pada dasarnya sudah menjadi tanggung jawab masyarakat, badan hukum, dan/atau korporasi yang memperoleh perizinan berusaha terkait pemanfaatan hutan. Maka korporasi bisa dimintakan pertanggungjawaban terhadap perusakan hutan, Perusakan hutan adalah proses, cara, atau perbuatan merusak hutan melalui kegiatan pembakaran liar, penggunaan kawasan hutan tanpa izin atau penggunaan izin yang bertentangan dengan maksud dan tujuan pemberian izin di dalam kawasan hutan yang telah ditetapkan, yang telah ditunjuk, ataupun yang sedang diproses penetapannya oleh Pemerintah. Kerusakan kawasan hutan. Dalam perkaraPutusan Nomor 114/Pid.B/LH/2020/PN Unh merupakan perkara penegakan hukum pertambangan dikawasan hutan.Hasil dari Penelitian ini dirasakan kurang adil penerapan hukumnya terhadap Pelaku kejahatan atas perkara Putusan Nomor 114/Pid.B/LH/2020/PN Unh, tidak melakukan Penerapan undang-undang dan subjek hukum yang berkeadilan.Kata Kunci : Pertanggungjawaban Pidana, Korporasi, TambangAbstract : The definition of a criminal act by a corporation is a criminal act committed by a person based on an employment relationship or based on another relationship, either individually or collectively acting for and on behalf of the corporation inside or outside the corporate environment. Corporate criminal liability for forest destruction is basically the responsibility of communities, legal entities and/or corporations that obtain business permits related to forest utilization. So corporations can be held responsible for forest destruction. Forest destruction is the process, method or act of destroying forests through illegal burning activities, use of forest areas without permits or use of permits that conflict with the aims and objectives of granting permits in designated forest areas, which has been appointed, or is being processed for determination by the Government. Damage to forest areas. In the case of Decision Number 114/Pid.B/LH/2020/PN Unh, it is a case of mining law enforcement in forest areas.The results of this research felt that the application of the law was unfair to perpetrators of crimes in the case of Decision Number 114/Pid.B/LH/2020/PN Unh, not applying the law and legal subjects fairly.Keywords: Criminal Liability, Corporations, Mining

Abstract

Regional or sub-regional institutions are a necessity in a modern legal system, considering that similar systems have long been established in Europe and Latin America. The two regional mechanisms provide an alternative for justice seekers at the national level who do not find justice and whose cases tend to meet exhausted local remedy, regional human rights bodies have an important role in promoting and protecting human rights because they are closer to the condition of the people. Specifically related to precautionary measures such as those in the Latin American mechanism, ASEAN sub-regional institutions must dare to build similar mechanisms so that serious and gross violations of law and human rights can be prevented. It is time for ASEAN sub-regional institutions to strengthen their presence in ensuring legal and human rights protection in the Region, one of which is through the precautionary measures mechanism to prevent potential legal and human rights cases from having a wider impact. The Inter-American human rights system is one of the best examples for ASEAN to learn from, because there are some similarities between ASEAN and Latin America.  For example, both regions have had a history of dictatorship, suffered from the Cold War and nowadays are transitioning to democracy and progressing in promoting human rights.

Abstract

Allegations of serious human rights violations that occurred in Timor Leste after the 1999 Referendum became one of the black notes in Indonesia's history. At the time, Indonesia was facing serious accusations in the form of alleged Crimes Against Humanity, and an Ad Hoc Human Rights Court was established at the Central Jakarta District Court to prosecute the defendants in this case, but unfortunately the results of the trial were still far from the victims' expectations. Thus, it is important to conduct a more in-depth study of law and human rights from an academic perspective to get a complete picture of the legal construction of alleged crimes against humanity in Timor Leste. Moreover, serious human rights violations certainly require an in-depth legal analysis framework, not only the national legal framework but also the international legal framework and also precedents from previous international human rights crime tribunals. This is important, thus there are more references and analyzes that can provide an overview of human rights events that have occurred in Timor Leste, especially after the implementation of the 1999 Referendum.
