Abstract

Obstruction of justice is an act of someone who obstructs the legal process and disrupts the proper function in a judicial process. The act of obstruction of justice is an act against the law that bypasses and opposes law enforcement. Normatively, the act of obstructing the judicial process has been regulated in many regulations, both in the Criminal Code and in special criminal law. The problems discussed by the author are how the form of acts of obstructing the judicial process (obstruction of justice) carried out by doctors in positive law in Indonesia and how criminal liability by doctors who commit criminal acts hindering the judicial process (obstruction of justice). The method that the author uses in this research is a normative legal approach method using secondary data sources which include primary legal materials, secondary legal materials and tertiary legal materials. The results of the research and discussion show that: the form of the act of obstructing the judicial process (obstruction of justice) carried out by the doctor that the act is all forms of intervention to the entire legal and justice process from the beginning until the process is completed both at the stage of the investigation, prosecution and the judge. In terms of the criminal liability of the medical profession who intentionally prevents, hinders, hinders, or thwarts directly or indirectly the investigation, prosecution, and examination in court against suspects and defendants or witnesses in corruption cases (Obstruction of Justice), Corruption Crimes have regulated in criminal law in Indonesia in Article 21 of Law 20 of 2001 on the replacement of Law Number 31 of 1999 concerning the Eradication of Corruption.

Abstract

Lesbian, Gay, Bisexual, Transgender, Queer or Questioning, Intersex, Asexual or Agender, Two-Spirit atau disingkat LGBTQIA2S+ belum dirumuskan secara detail dalam KUHP Nasional. Penelitian ini bertujuan untuk menganalisis kebijakan formulasi hukum pidana terhadap LGBTQIA2S+ sebagai tindak pidana dalam perspektif Pancasila dan Hak Asasi Manusia dalamKUHP Nasional yang akan datang (ius constituendum). Metode penelitian yang digunakan yuridis normatif. Hasil penelitian menyatakan bahwa dalam KUHP Nasional belum secara detail mengatur tentangkejahatan LGBTQIA2S+. Sehingga perlu adanya kebijakan formulasi hukum pidana secara khusus (lex specialist) yang memformulasikan secara detail kejahatan LGBTQIA2S+di Indonesia. Formulasi LGBTQIA2S+ tersebut perlu mencakup delik pencabulan, delik perzinaan dan delik kesusilaan di muka umum guna mewujudkan tujuan hukum pidana yaitu kesejahteraan masyarakat (social welfare) dan perlindungan masyarakat (social welfare).

Abstract

In criminal law, unlawful acts are one of the elements of a crime. Logically, in addition to the acts formulated in the law, the unlawful act must also be proven. If an unlawful act is not proven, then an act cannot be considered a crime. However, the elements of unlawful acts regulated in the old Criminal Code differ from those in the National Criminal Code. This article aims to analyse the law of evidence in relation to unlawful acts in the National Criminal Code, in order to establish the truth of the matter. The research method used is the normative juridical method with a literature study analysis. Proving the essence of formal (written) law in the law of evidence is very easy; however, proving the essence of material law is more difficult, as it requires the judge to explore the sense of legal justice that exists in society. In criminal law, proof of unlawful acts is based on the postulate in criminalibus probantiones bedent esse lucis clariores, which states that in criminal cases, evidence must be clearer than light.
