Abstract

Polisi memiliki tugas yang  penting dalam melakukan penanggulangan terhadap suatu tindak pidana, salah satunya tindak pidana penyalahgunaan narkotika di dalam masyarakat. Apabila anggota kepolisian bertugas tidak berlandaskan Pancasila, UUD NRI  1945 dan Undang-Undang yang berlaku maka akan dapat terjerumus dalam lingkaran setan penyalahgunaan narkotika tersebut. Penelitian ini bertujuan untuk mengetahui Kebijakan Non-Penal dalam merehabilitasi bagi anggota Polri pecandu narkotika dan mengetahui aplikasi kebijakan non-penal dalam merehabilitasi anggota polri yang menjadi pecandu narkotika.Polda Jawa Tengah melalui Kapolda Irjen Pol Condro Kirono mengungkapkan bahwa memiliki gagasan dalam menanggulangi tindak pidana narkortika yang dilakukan anggota polisi di lingkungan Polda Jawa Tengah, melalui program  “Kupeduli Narkoba”.dasar dikeluarkannya ide atau gagasan tersebut merujuk pada Peraturan bersama No.1 tahun 2014 dan No. 01/III/2014/BNN tentang penanganan pecandu narkotika dan korban penyalahgunaan narkotika ke dalam lembaga rehabilitasi, dalam peraturan ini telah disebutkan beberapa kerjasama yang dilakukan oleh lembaga-lembagaseperti MA, Menteri Hukum dan HAM, Menteri Kesehatan, Menteri Sosial, Jaksa Agung, Kepolisian, dan BNN. Khususnya juga kerjasama antara Polri dan BNN dalam menangani kasus penyalahgunaan narkotika, dalam pelaksanannya Polda Jawa Tengah baru menerbitkan Nota Dinas sebagai dasar menjalankan program dan menjalin koordinasi antar lembaga pada program“Kupeduli Narkoba” tersebut.

Abstract

Even though conflicts between supporters caused the majority of the riots, other factors were no less important. Specifically, those related to the organization of football matches that were not yet professional could not guarantee security or order. The incident at Kanjuruhan Stadium serves as a significant reminder that hosting football matches without prioritizing proper safety measures and collaborative procedures will undoubtedly fail to promote fair competition in line with the principles of organizing sporting events that uphold sportsmanship, fair play, and respect. This paper is compiled through normative research by prioritizing secondary data that focuses on statutory and case approach, which are collected and analyzed descriptively and qualitatively. The results shows that the legal construction used in carrying out security by the Police in the Kanjuruhan Tragedy refers to the Regulation of the Chief of Police of the Republic of Indonesia Number 1 of 2009 on the Use of Force in Police Action while after the Kanjuruhan Tragedy, the Police compiled a new legal construction, the Republic of Indonesia National Police Regulation Indonesia Number 10 of 2022 on Security for the Implementation of Sports Competitions which can be used specifically in securing the implementation of football in Indonesia

Abstract

The criminal law evidentiary system in Indonesia is a negative wettelijk or proof sys-tem based on the Law negatively. To make light of a criminal act, valid evidence is needed according to the Criminal Procedure Code as stated in Article 184 paragraph 1 of the Criminal Procedure Code. Not all criminal acts can be proven with the naked eye. For example, evidence related to bodily injuries or that cause health problems, or that result in the death of a person. Without expert help a law enforcement officer cannot conclude this. the purpose of this research is to find out visum et repertum as evidence in uncovering the occurrence of criminal acts. This research is a legal research that uses a normative or doctrinal juridical ap-proach by collecting and analyzing secondary data. So it is necessary to help the medical science of the judiciary to deal with the problem. Forensic doctors assist in processes related to judicial proceedings. And the results of the examination are poured into Visum et Repertum. In criminal cases Visum et Repertum is used instead of corpus delicti. That visum et repertum is valid evidence in accordance with article 184 of the Penal Code as evidence of letters

Abstract

In criminal law, unlawful acts are one of the elements of a crime. Logically, in addition to the acts formulated in the law, the unlawful act must also be proven. If an unlawful act is not proven, then an act cannot be considered a crime. However, the elements of unlawful acts regulated in the old Criminal Code differ from those in the National Criminal Code. This article aims to analyse the law of evidence in relation to unlawful acts in the National Criminal Code, in order to establish the truth of the matter. The research method used is the normative juridical method with a literature study analysis. Proving the essence of formal (written) law in the law of evidence is very easy; however, proving the essence of material law is more difficult, as it requires the judge to explore the sense of legal justice that exists in society. In criminal law, proof of unlawful acts is based on the postulate in criminalibus probantiones bedent esse lucis clariores, which states that in criminal cases, evidence must be clearer than light.

Abstract

The Indonesian Fisheries Law has determined criminal threats for perpetrators of illegal fishing in the ZEEI. In practice, there are differences in the application of imprisonment instead of fines for Indonesian citizens and foreign nationals who do illegal fishing. Such differences create injustice for Indonesian citizens. The results of the study indicate that criminal law policies in the field of fisheries need to be based on justice, in the sense of equality before the law. Foreign nationals who catch illegal fishing in the ZEEI are subject to imprisonment instead of a fine, while foreign nationals are not. Therefore, the Fisheries Law (especially Article 2013) needs to be amended by confirming the imposition of confinement instead of fines for all citizens who fish illegally in the ZEEI. Although the Fisheries Law adopted the 1982 UNCLOS, it did not emphasize the prohibition on the application of confinement instead of fines. In addition, Article 30 of the Criminal Code has also provided the basis for the imposition of confinement instead of fines. This change aims to provide a deterrent effect for perpetrators of illegal fishing in the ZEEI who have the status of foreign citizens. This objective is also in line with the premium remedial nature of criminal sanctions in the Fisheries Law. In addition, the abolition of the dualism of fisheries crime in the Fisheries Law also needs to be carried out and adjusted to the RUU-KUHP. All fishing crimes should be categorized as crimes.
