Abstract

Protection of Intellectual Property Rights (IPR) is important for companies to maintain brand awareness. One of the challenges in trademark protection involves resolving disputes under a supranational organization, specifically The Court of Justice of the European Union (CJEU). This Court has jurisdiction to adjudicate cases involving foreign companies from non-EU countries, which can present complexities for those entities navigating the legal framework and protections afforded within the EU. This research examined the authority, legitimacy, and application of justice through CJEU in resolving disputes between foreign companies. This normative legal research used a statute approach, case study, and library research. Based on the research results, the authority and legitimacy of CJEU in resolving disputes with foreign companies have been regulated in the Maastricht treaty. The submission of foreign companies is also related to the opposing party, a company flagged by an EU member state. The use of CJEU in resolving disputes requires parties to maximize all judicial remedies available at the national before proceeding to the international level.

Abstract

The development of smart contract in a decentralized blockchain system raises various problems in the legal field marked by cases of smart contract violations such as the DAO, Parity Wallet, and PlayDapp cases. The breach of smart contract in the blockchain system affects the application and enforcement of conventional law in a virtual world that has no geographical jurisdiction. The limitations of conventional law in regulating the virtual world gave birth to various new legal concepts such as lex cryptographia and virtual state. This research aims to examine the expansion of law in blockchain systems and smart contract, especially in cases of breach of smart contract and the birth of new governance. This research uses doctrinal research methods with a case study approach and literature research. Based on the results of this research, the existence of smart contracts affects the legal expansion of their legitimacy and application as contracts that have legal force. Smart contract that have no ties to territorial jurisdiction give the parties to the smart contract complete freedom to regulate the settlement of contract violations, so that smart contracts become law, legal procedures, and punishment itself in carrying out its functions. In addition, the existence of smart contracts in the blockchain system also gave birth to lex cryptographia as a new law and a blockchain-based virtual state as a new governance model that is not limited by geographical areas.

Abstract

Ketidakpastian penggunaan Online Single Submission Risk-Based Approach (OSS RBA) sebagai layanan perizinan berusaha menimbulkan berbagai permasalahan, khususnya permasalahan yang berdampak pada perizinan usaha UMKM. Dampak tersebut diakibatkan dari adanya Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 yang menyatakan inkonstitusional bersyarat Undang-Undang Cipta Kerja dan keberadaan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 tahun 2022 tentang Cipta Kerja. Tujuan penelitian ini adalah untuk mengetahui keabsahan penerapan OSS RBA sebagai sistem perizinan usaha serta akibat hukum yang ditimbulkan akibat adanya putusan MK dan Perpu Cipta Kerja terhadap penggunaan sistem OSS RBA. Penelitian ini menggunakan metode penelitian hukum normatif melalui pendekatan perundang-undangan dan studi pustaka. Penelitian ini menghasilkan tiga simpulan. Pertama, Penggunaan OSS RBA secara sah telah diatur dalam Peraturan Pemerintah Nomor 5 Tahun 2020. Kedua, Akibat hukum dari adanya putusan MK adalah dinyatakannya inkonstitusional bersyarat dasar hukum penggunaan OSS RBA yang berimbas pada digantinya Undang-Undang Nomor 11 Tahun 2020 dengan Perppu Nomor 2 Tahun 2022. Ketiga, Akibat hukum dari adanya Perpu Cipta Kerja adalah kembali sahnya penggunaan OSS RBA sebagai layanan perizinan berusaha melalui pemberlakuan peraturan pelaksana dari Undang-Undang Cipta Kerja khususnya dalam Pasal 184 Perppu Nomor 2 Tahun 2022.

Abstract

The two types of invalidity of administrative acts in the Government Administration Law, which include invalid and voidable, are not in accordance with the concept of invalidity in administrative law. The aim of this research is to find answers to two problems, first, the concept of administrative acts in the Government Administration Law, and second, the correct meaning regarding the invalidity of decisions based on the concepts and principles of administrative law. Using a doctrinal type of legal research with a legislation approach and a conceptual approach, this research produces two conclusions. First, the concept of decision in the Government Administration Law is a decision in a broad sense including general case decisions (besluit) and individual case decisions (beschikking) including factual actions, and the latter is not appropriate. Second, the nullity of administrative acts in administrative law includes being null and void and voidable, firstly the decision and its legal consequences are deemed to have never existed, secondly the decision and its legal consequences are valid until they are annulled by a later decision or administrative court.

Abstract

The protection of human rights for crew of vessels, which is one of the professions in the seafaring and maritime sector, has become an urgency after the increasing cases of modern slavery in Indonesia. Therefore, this research will examine the implementation and optimization of human rights protection for Indonesian crew of vessels, especially those from Tegal Regency. This research uses an empirical legal research method using a descriptive qualitative approach to examine the problems and strategies for optimizing human rights protection for Indonesian crew of vessels. Based on the results of this research, it explains that the practice of modern slavery that often occurs with Indonesian crew of vessels includes exploitation of workers by forcing them to work for 18 hours or more a day, inadequate work wages, a workplace atmosphere that is not conducive, and a lack of supporting facilities for the comfort and welfare of workers. In addition, there are other findings that explain that the protection of the human rights of crew of vessels is regulated in Indonesian legislation and international conventions that have obliged all levels of society to participate in providing human rights protection to Indonesian crew of vessels.
