Abstract

Penelitian ini menjelaskan dan mengkaji tentang Peran Kuasa Hukum Terhadap Perkara Wanprestasi Dalam Sengketa Utang Piutang Pada Gugatan Sederhana yaitu karena dalam hukum acara perdata sifat seorang kuasa hukum ittu mewakili kepentingan kliennya dan dianggap hadir dalam persidangan sedangkan untuk gugatan sederhana seorang kuasa hukum ia tidak bersifat mewakili tetapi hanya mendampingi dan memiliki konsekuensi ketika kuasa hukum hadir dan kliennya tidak hadir maka hal tersebut dianggap tidak hadir. Adapun yang menjadi Rumusan Masalah dalam penelitian ini yaitu Pertama, Bagaiimanakah iimpleimeintasii peiran kuasa hukum dalam gugatan seideirhana pada peirkara wanprestasi dalam seingkeita utang piutang. Kedua, Bagaiimanakah tiinjauan yuriidiis teirhadap peiran kuasa hukum pada peirkara wanprestasi dalam seingkeita hutang piutang meinurut Peirma Nomor 4 Tahun 2019 teintang Tata Cara Peinyeileisaiian Gugatan Seideirhana. Penelitian ini menggunakan penelitian lapangan (Field Research). Jenis data yang digunakan merupakan sumber data primer yaitu data yang di hasilkan melalui wawancara serta dokumentasi dengan narasumber terpilih melalui teknik purposive sampling dan sumber data sekunder yaitu data yang di peroleh dari buku-buku, jurnal dan referensi lainnya, serta di analisis data menggunakan Deskriptif Kualitatif. Berdasarkan hasil yang diperoleh dari penelitian ini terhadap Peran Kuasa Hukum Terhadap Perkara Wanprestasi Dalam Sengketa Utang Piutang Pada Gugatan Sederhana. Pertama, Peran kuasa hukum dalam menangani gugatan sederhana sama dengan hukum acara perdata lainnya yaitu bisa bersifat mewakili atau mendampingi dan pada realita dipersidangan kehadiran dari seorang penggugat atau tergugat tetap dihitung kehadirannya dengan catatan bahwa penggugat atau tergugat setidaknya hadir walaupun satu kali diawal persidangan dalam gugatan sederhana. Kedua, pada peirkara wanprestasi dalam seingkeita utang piutang dalam gugatan seideirhana peran kuasa hukum atau advokat bertindak sebagai pendamping. Namun, pendampingan yang bersifat aktif, bukan hanya pasif.

Abstract

Joint property is one of the important aspects of the marriage relationship regulated in Islamic law and positive law in Indonesia. In practice, the division of joint property often becomes a problem that triggers conflict during divorce. One of the legal instruments available to protect joint property is the application for marital confiscation, which is a legal action to secure property so that it is not misused by one of the parties during the divorce process. This study aims to analyze the provisions of marital confiscation against joint property claims and analyze the Maqashid Sharia perspective on the provisions of marital confiscation of joint property claims. The research method used is library research with a normative juridical research approach. The data analysis technique used is descriptive analysis which uses deductive thinking flow. The results of this study indicate that marital confiscation has an important role in maintaining justice and protecting the rights of joint assets in the division of joint property, and has provisions regulated in various laws and regulations. Marital confiscation arrangements can be found in several laws and regulations, including Article 190 of the Civil Code, Article 24 paragraph (2) letter c of Government Regulation No. 9 of 1975, Article 78 letter c of Law No. 7 of 1989 jo. Law No. 3 of 2006, and Article 823 Rv. According to the Maqashid Sharia perspective, the provision of marital confiscation against joint property claims can be interpreted as an effort to preserve joint property, offspring, soul, religion, and reason. This is in accordance with the principles of Maqashid Sharia which prioritizes the benefit of mankind in various aspects of life, including in the context of divorce.

Abstract

The amendment of the minimum marriage age through Law Number 16 of 2019 was intended to curb child marriage and strengthen the protection of children’s rights in Indonesia. In practice, however, this policy has been followed by a significant increase in petitions for marriage dispensation in Religious Courts. This situation reveals a contradiction between the normative aim of the regulation, which is oriented toward preventing early marriage, and judicial practice that still provides legal avenues for child marriage through the dispensation mechanism. This study aims to analyze the implementation of child rights protection in the adjudication of marriage dispensation cases and to assess the application of the best interests of the child principle in judicial reasoning. Employing a normative juridical method with statutory and conceptual approaches, supported by an examination of court practice, the research finds that the high approval rate of dispensations, the dominance of premarital pregnancy as a ground, and the limited use of psychological and social assessments tend to undermine the child-protection objectives embedded in the regulatory reform. Accordingly, this study underscores the urgency of applying multidisciplinary assessments in marriage dispensation proceedings to ensure that the best interests of the child are genuinely fulfilled.
