Abstract

The political practice of identity in a political reality is indeed a matter of discretion, given that identity itself is inherent to man. Practices of identity politics potentially have two significant impacts: positive and negative. This study seeks to look at the political impact of identity on some of Indonesia's political contestation experiences and provide constructive advice to mitigate something similar in the forthcoming 2024 elections. This research is qualitative and is accompanied by descriptive techniques of analysis by studying reference sources relevant to the research. The results of this study show that in the context of political controversy in Indonesia, identity politics has been shaped throughout the electoral momentum: Pilpres 2014, Pilkada DKI Jakarta 2019, and Pilpres 2019 were used as political strategies by hitting the identities of other candidates. The emergence of mainstream groups using religious symbols and provocative narratives as an attempt to catch the hearts of voters means that the course of electoral momentum tends to advance sentiment rather than argument. If identity politics continues to flourish, it will potentially give rise to fascism, separatism, and so on. To prevent the same from happening in the forthcoming 2024 elections, it would require mitigation efforts such as strengthening religious moderation, promoting political ethics and ideas of candidates, and increasing digital literacy for voters, so that the niche will create quality electoral processes and outcomes.

Abstract

Praktik politik identitas dalam suatu realitas politik memanglah sebuah keniscayaan, mengingat identitas sendiri merupakan hal yang melekat pada manusia. Praktik dari politik identitas berpotensi menimbulkan dua dampak signifikan: yakni dampak positif dan negatif. Penelitian ini berupaya melihat dampak politik identitas pada beberapa pengalaman kontestasi politk Indonesia dan memberikan saran konstruktif guna memitigasi hal yang serupa pada Pemilu 2024 mendatang. Penelitian ini bersifat kualitatif yang disertai dengan teknik deskriptif analisis dengan mengkaji sumber rujukan yang relevan dengan penelitian. Hasil penelitian ini menunjukan bahwa dalam konteks kontestasi politik di Indonesia, politik identitas gencar digaungkan sepanjang momentum-momentum pemilihan: Pilpres 2014, Pilkada DKI Jakarta 2019, dan Pilpres 2019 digunakan sebagai strategi politik dengan menghantam identitas kandidat lain. Munculnya kelompok-kelompok mainstream menggunakan simbol-simbol agama dan narasi-narasi provokatif sebagai upaya untuk meraih hati pemilih, sehingga jalannya momentum-momentum pemilihan cenderung mengedepankan sentimen ketimbang argumen. Jika politik identitas terus dibiarkan tumbuh subur maka akan berpotensi melahirkan fasisme, separatisme, dan lain sebagainya. Guna mencegah hal yang sama terjadi pada Pemilu 2024 mendatang, maka diperlukan upaya mitigasi berupa penguatan moderasi beragama, mengedepankan etika politik dan gagasan dari para kandidat, serta peningkatan literasi digital bagi pemilih, sehingga nisca akan menciptakan proses dan hasil Pemilu yang berkualitas.

Abstract

In the contestation of the nation’s journey, Indonesia has gone through a long and dynamic period in its state policy, from colonialism to post-independence. The Declaration of Independence of 18 August 1945 was the opening gateway for Indonesia to organize its affairs independently, freely and independently. Although Indonesia can already arrange its own affairs, it does not mean that it can eliminate potential conflicts. During the years from 1950 to 1959, a series of conflicts continued, while at that time it was known as a fairly democratic time when freedom of opinion was restricted and elections were held for the first time. Starting from what is meant, this study will throw a thorough and comprehensive look at the political dynamics of Indonesian statehood in the parliamentary democracy. The method used in this study is a method of normative legal research with a historical approach. As for the technique of collection of materials used is the library study technique, with relevant materials around the conditions of Indonesia in the parliamentary democracy. The results of this study show that the political dynamics of statehood that occurred during parliamentary democracy were caused by a variety of things, ranging from the internal conflict of the Islamic group due to the question of the division of posts in the cabinet, the bunt of the Constituante in formulating the state policy, to the political intrigue played by Soekarno and the Army caused because throughout that time they were unprofitable.   Abstrak: Dalam kontestasi perjalanan bangsa, Indonesia telah melewati masa yang panjang dan dinamis dalam ihwal politik ketatanegaraannya, mulai dari zaman kolonialisme hingga pasca-kemerdekaan. Dikumandangkannya Proklamasi Kemerdekaan pada tanggal 18 Agustus Tahun 1945 menjadi gerbang awal bagi Indonesia untuk mengatur urusan kenegaraannya secara mandiri, bebas, dan merdeka. Kendati Indonesia sudah bisa mengatur urusannya sendiri, namun bukan berarti hal tersebut bisa menghilangkan potensi-potensi konflik yang ada. Terbukti sepanjang tahun 1950 hingga tahun 1959 rentetan konflik terus terjadi, padahal pada masa tersebut dikenal sebagai masa yang cukup demokratis karena terjaminnya kebebasan berpendapat dan pemilu untuk pertama kalinya dapat dilaksanakan. Berangkat dari hal yang dimaksud, maka tujuan dalam penelitian ini menjelaskan secara runtut dan komprehensif mengenai penyebab dinamika politik ketatanegaraan Indonesia pada masa demokrasi parlementer. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan pendekatan sejarah. Adapun teknik pengumpulan bahan yang digunakan adalah teknik studi pustaka, dengan bahan yang relevan seputar kondisi Indonesia pada masa demokrasi parlementer. Hasil dari penelitian ini menunjukan bahwa dinamika politik ketatanegaraan yang terjadi pada masa demokrasi parlementer disebabkan oleh berbagai macam hal, mulai dari konflik internal dari golongan Islam karena persoalan pembagian jabatan di kabinet, buntunya Konstituante dalam merumuskan dasar negara, hingga intrik politik yang dimainkan oleh Soekarno dan Angkatan Darat yang disebabkan karena sepanjang masa tersebut mereka tidak diuntungkan

Abstract

This community service article aims to escalate Gen Z's understanding of sexual violence, which continues to show a concerning trend in case numbers, thereby hindering the nation's aspirations towards a civil society. The cause of the high trend in sexual violence is that victims do not yet understand the content of the TPKS Law; the reporting mechanism and the legal process in court. Considering that the effectiveness of the law cannot be sufficiently realized through adequate content and means (legal substance-legal structure), efforts are needed through the work of other variables, such as community involvement (legal culture), which in this service activity is carried out and participated in by students from SMA Negeri 1 Wangon. The method used in this program is lectures and interactive discussions. The result of this program is a comprehensive understanding of the TPKS Law, which is then followed by building a commitment to combat sexual violence through daily campaigns, both in the form of preventive and repressive actions carried out in social-community environments and on social media. So that the aspiration for the formation of a civil society can be realized.

Abstract

Starting from what is meant, the aim of the research is to provide a thorough and comprehensive understanding of the political dynamics of Indonesian statehood in parliamentary democracy. The results of this research show that the political dynamics of statehood that occurred in the parliamentary democracies are colored by a variety of things, from the internal conflict of the Muslims because of the question of the division of posts in the cabinet to the constraint of the Constituante in formulating the state policy to the political intrigues played by Soekarno and the Army caused by the fact that they were unprofitable the whole time. Thus, the consequences of this have been a recession in the cabinet at a relatively rapid and unstable time for the national economy.

Abstract

Indonesia is a unitary state that adopts a system of regional autonomy in terms of the maintenance of its country, which has the consequences of the existence of official Heads of District in each region. The head of the district is democratically elected every five years through an electoral mechanism. However, with the 2024 simultaneous elections being held, there is a vacancy in the office of the head of district due to the expiration of the term of the previous head of area, so the mechanism used to fill the vacancies is the appointment of the District Chief Officer who will be appointed on Permendagri No. 4 of 2023. It raises legal issues because Permendagri a quo is deemed to harm the notion of democracy by amputating the rights of the people to participating in the decision-making of the District Chief. The study aims to provide a contribution to the thinking of reformulating the mechanism of appointment of the District Chief in order to run more democratically. So this kind of research is normative jurisprudence using a legislative approach, a conceptual approach, and a case approach by relying on the legal material of the library. The result of this study is that given that the District Chief Officer is a strategic position and given that Indonesia is a democratic state, there is a need for a mechanism for the appointment of the District Head Officer based on the principles of openness in the process, transparency of information, and the presence of public participation, which is practically carried out by: (1) announcing the names of the candidates for the Regional Chief of Staff proposed by the Councillor and Governor. (2) The DPRD which is the regional legislative body should absorb the aspirations of the public through public hearings so that the criteria for the candidate for the District chief of staff to be proposed are in accordance with the needs of the region. (3) conducting a public test so that each proposed District Chiefs of Staff candidate knows his capacity before finally being determined by a final assessment team to become a District Head of Staff.

Abstract

The self-assessment tax system in Indonesia, which gives full responsibility to Taxpayers (WP), serves as the main pillar of state revenue. Although annual tax revenue achievements are quite good, there is a compliance gap marked by a low tax ratio and room for opportunistic behavior. This study analyzes the existing tax legal framework, including the KUP Law, the TPPU Law, and regulations related to information exchange (AEoI) and beneficial ownership, to assess their effectiveness in preventing and prosecuting tax avoidance and tax evasion. This research uses a normative legal research method and a statute approach. The results of this study show that the legal instruments currently in force are not yet fully adequate to address complex tax avoidance schemes. This study proposes Non-Conviction Based (NCB) Asset Forfeiture and Mandatory Disclosure Rules (MDR) as complementary compliance architecture for novelty proposals. NCB Asset Forfeiture can accelerate the recovery of state losses without relying on criminal decisions that have permanent legal force, while MDR will encourage early reporting of aggressive tax planning schemes by intermediaries. This proposal is expected to sustainably strengthen the state's fiscal capacity, narrow the gap between norms and practice, and close law enforcement gaps in the Indonesian tax system.
