Abstract

This article examines violations related to trademarks in the metaverse, which are reviewed from the perspective of intellectual property rights and examines the law enforcement that is applied in the metaverse itself in the event of a trademark violation that is claimed by another person who is not the owner of the rights to the trademark. The type of research used is normative juridical, in which the discussion of this research prioritizes the study of the application of positive legal norms or legal principles applied in Indonesia and approaches through related laws and regulations. The study in this research is an analysis of the first-to-file principle in registering trademarks used in the metaverse and studying the classification of trademarks so that they can be registered in the metaverse so that other people do not use these trademarks. Based on the study in the discussion in this study, it is concluded that the legal protection of trademarks in the metaverse, seen from the perspective of intellectual property rights, still needs to be under the provisions of the applicable laws and regulations. This is marked by the many legal cases against trademark violations in the metaverse itself because trademarks registered in the real world will not automatically be registered in the metaverse unless the rights owner or company registers their trademark through a trademark registration service application on the metaverse.

Abstract

Tumbuh dan berkembangnya gerakan postivisme di dunia telah memberikan pengaruh terhadap banyak pemikiran pada berbagai bidang keilmuan terutama berkaitan dengan proese kehidupan manusia. Postivisme merupakan salah satu aliran filsafat yang menyatakan bahwa ilmu alam sebagai satu-satunya sumber pengetahuan yang benar dan menolak aktifitas yang berkenaan dengan metafisik. Selanjutnya, setelah perkembangan hukum positif muncul teori hukum murni yang dapat dilihat sebagai suatu pengembangan saksama dari aliran positivisme. Ajaran ini menolak hal yang bersifat ideologis dan hanya menerima hukum sebagaimana adanya, yaitu dalam bentuk peraturan-peraturan yang ada. Metode penelitian ini adalah normatif atau dikenal dengan doktrinal dengan menggunakan pendekatan konseptual atau conceptual approach. Kesimpulan penelitian ini adalah Teori hukum murni merupakan teori yang berasal dari aliran hukum positif, dimana di dalam teori ini berusaha untuk memberikan pengertian hukum dilihat sebagai sesuatu yang “murni“ terlepas dari segala unsur lain yang berasal dari luar ilmu hukum itu sendiri. Pure Theory of Law Kelsen berusaha untuk membebaskan ilmu hukum dari anasiranasir non-hukum dengan mengarahkan diri pada kognisi hukum itu sendiri, Teori Hukum Murni telah diimplementasikan di Indonesia, hal tersebut tercermin dengan masih diterapkannya beberapa pemikiran dari Hans Kelsen dalam teori Stufenbau.

Abstract

Bullying in the Higher Education environment, also known as campus, has become an increasingly pressing issue in recent years. This phenomenon not only includes verbal and physical bullying but also reaches the digital dimension through cyberbullying. Students who are victims of bullying face a range of serious harms, including negative impacts on their emotional and mental well-being. These impacts can include increased levels of stress, anxiety and depression, which in turn can impair their academic performance and threaten long-term psychological health. In addition, bullying can also lead to significant social isolation and even jeopardise the physical safety of the victim in certain cases. The importance of creating a safe, supportive, and inclusive campus environment is crucial in effectively and preventively addressing this bullying issue. This socialisation was held in the inaugural lecture at Stifera Semarang online. Overall, the inaugural lecture on anti-bullying prevention is an important first step in shaping mindsets and practices that support a campus culture free from bullying. The inaugural lecture can be a platform to build a safe campus culture, where every member of the community is prepared to recognise, report, and prevent bullying.

Abstract

This community service article aims to escalate Gen Z's understanding of sexual violence, which continues to show a concerning trend in case numbers, thereby hindering the nation's aspirations towards a civil society. The cause of the high trend in sexual violence is that victims do not yet understand the content of the TPKS Law; the reporting mechanism and the legal process in court. Considering that the effectiveness of the law cannot be sufficiently realized through adequate content and means (legal substance-legal structure), efforts are needed through the work of other variables, such as community involvement (legal culture), which in this service activity is carried out and participated in by students from SMA Negeri 1 Wangon. The method used in this program is lectures and interactive discussions. The result of this program is a comprehensive understanding of the TPKS Law, which is then followed by building a commitment to combat sexual violence through daily campaigns, both in the form of preventive and repressive actions carried out in social-community environments and on social media. So that the aspiration for the formation of a civil society can be realized.

Abstract

Simultaneous regional head elections in 2024 are a challenge for Indonesia's democratic system, especially with the phenomenon of single candidates even though the Constitutional Court has lowered the nomination threshold through Decision Number 60/PUU-XXII/2024. This study aims to analyze the impact of the Constitutional Court's decision on party political participation and identify factors that influence the sustainability of the single candidate phenomenon. This research uses a normative juridical method with a conceptual approach. The results show that although the lowering of the threshold has succeeded in increasing the opportunities for small parties to nominate candidates, the dominance of incumbents, high political costs, and weak political education remain significant obstacles so that there will still be single candidates in 37 Regions in the 2024 Simultaneous Regional Head Elections. Key findings suggest the need for additional arrangements, such as limiting the maximum party support for a single candidate, to encourage more participatory competition. This research confirms the importance of regulatory reform and political education to realize a more inclusive democracy in the context of regional head.
