Abstract

The purpose of this study is to discover the philosophy of accountability in environmental disputes and discover the legal rationality of the validity of the Res Ipsa Loquitur doctrine in resolving environmental disputes in Indonesia. The results of the study show that 1) The philosophy of accountability in environmental disputes is the human right  because of the existence of human beings as conscientious, intelligent, conscious and free beings who use their conscience, reason, awareness and freedom (ontologism) where their fulfillment is based on moral legislation (epistemological) to bring about justice, legal certainty and expediency (axiological) and 2) The rationality of the legality of the doctrine of res ipsa loquitur is in the environmental dispute is first, the difficulty of proving mistakes (intentional or negligence) in environmental disputes; Second, reversing the burden of proof still requires proof of innocence and causality between loss and mistakes; The three absolute responsibilities still require proof from the defendant regarding the loss caused; Fourth, the allegation evidence still requires the support of other evidence, so that a mechanism for resolving environmental disputes in favor of the environment (novio pro natura) is needed without proof of the mistakes, losses and causality of both but sufficient with the fact of environmental damage that is located in the power of the defendant so the allegation that arises is presumption by factuality with a form of responsibility to compensate absolutely (absolutely compentation liability).

Abstract

Penelitian ini bertujuan untuk mengungkap faktor penyebab anak putus sekolah di Kelurahaan Tuutu analisis Pasal 31 Ayat 1, 2, dan 3 UUD 1945. Metode penelitian yang digunakan yaitu metode penelitian kualitatif dengan metode pengumpulan data observasi dan wawancara. Sedangkan analisis data yang digunakan dari Miles Huberman berupa pengumpulan data, reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian ini menjelaskan bahwa di Kelurahan Tuutu Kabupaten Minahasa Tondano Barat masih banyak yang tidak melanjutkan sekolah disebabkan oleh beberapa faktor contohnya hamil diluar nikah, pergaulan bebas, kurang perhatian orang tua, serta kesadaran diri yang kurang

Abstract

Purpose of the study: To examine the role of Social Media-Based Project-Based Learning in increasing community participation in the process of forming Environmental Regulations, integrating digital technology with civic education and public policy formation. Methodology: The study employed a qualitative approach using a literature review method. Data was collected from academic databases using relevant keywords. Thematic analysis was used to identify key themes. Data source triangulation and peer debriefing were implemented to ensure validity and reliability. The analysis considered socio-political and cultural factors influencing implementation. Main Findings: The Social Media-Based PBL model showed significant potential in increasing public participation in Environmental Regulation formation. It improved understanding of environmental issues and the legislative process, expanded information accessibility, and enhanced the quality of community input. However, challenges like the digital divide and misinformation spread were identified. Novelty/Originality of this study: This study uniquely integrates Project-Based Learning, social media use, and Environmental Regulation formation processes. It offers a new perspective on increasing community participation through active learning and digital technology, potentially transforming public policy formation to be more inclusive and responsive to community and environmental needs.

Abstract

The enactment of the Law No. 6 of 2023 has brought significant changes to the management of Fly Ash and Bottom Ash (FABA), including the reclassification of FABA as non-hazardous and non-toxic waste (non-B3 waste) and the extension of the storage period in the Ash Disposal Area from 365 days to 3 years. This study aims to analyze the impact of Law No. 6 of 2023 on the management of Fly Ash and Bottom Ash at the Amurang Coal-Fired Power Plant (PLTU Amurang). Using a normative legal research method, the findings provide comprehensive insights into the effects of implementing Law No. 6 of 2023 on FABA waste management. These findings are expected to contribute to the development of more effective and sustainable environmental policies, as well as offer practical recommendations for power plant operators to improve environmentally friendly and economically valuable waste management practices.

Abstract

Sustainable development principles ensure current needs are met without compromising future generations' capabilities, integrating economic, socio-cultural, and environmental aspects for a balanced approach. Spatial planning, under Law Number 26 of 2007, defines regions based on administrative or functional aspects and areas for protection and cultivation. Mining activities in South Halmahera, including minerals, coal, oil, natural gas, and geothermal resources, contribute to regional economic growth while managing land use and environmental impacts. Specifically, mineral mining covers Bacan, Obi, Kasiruta, and Kayoa districts, particularly benefiting Obi's Kawasi Village under PT HARITA GROUP, generating jobs and attracting diverse investments. This study evaluates whether South Halmahera's Regional Regulation Number 20 of 2012 and PT HARITA GROUP's mining practices in Obi Islands adhere to sustainable development principles. By using normative legal method, the author finds that South Halmahera Regency Regional Regulation Number 20 of 2012 concerning Regional Spatial Planning contains the principles of sustainable development. From a juridical aspect, the designation of the nickel mining area is carried out by PT. Harita Group has been established in accordance with statutory regulations. However, there are indications that the mining carried out does not fully implement the principles of sustainable development. This is known from research conducted by WALHI North Maluku in 2023, namely the pollution of the waters of Weda Bay and Obi Island. This means that the mining process is carried out without paying attention to sustainable principles. This could be due to a lack of supervision by the relevant institutions. However, procedural supervision is not regulated in South Halmahera Regency Regional Regulation Number 20 of 2012 concerning Regional Spatial Planning.
