Abstract

Abstract Based on the records of various International Human Rights Institutions, Indonesia is one of the countries that still applies the death penalty to their criminal law system (Retentionist Country). The legal research method used is a normative juridical research type. The legal force of court decisions and the existence of clemency for the execution of sentences in Indonesia can be stated that court decisions that have obtained permanent legal force in the form of punishment in any form cannot be cancelled and are given decisions by government power outside the scope of the judiciary. Although there is already a judicial review (herziening) that can be used by convicts, pardons that are outside the realm of law and outside the criminal justice system can be used by the president as a means to correct and demonstrate legal wisdom. Abstract

ABSTRAK Pengadilan mengadakan proses pemeriksaan yang dikenal dengan nama pembuktian. Untuk kepentingan pembuktian, kehadiran benda-benda yang tersangkut dalam suatu tindak pidana juga sangat diperlukan. Benda-benda dimaksud sering dikenal dengan istilah “barang bukti”.Yang menjadi permasalahan dalam penelitian ini adalah Bagaimana Tanggung Jawab Penyidik Terhadap Barang Bukti ? dan Bagaimana Proses Pinjam Pakai Barang Bukti dalam Perkara Pidana ? Metodologi penelitian Dalam penyusunan skripsi ini, dipergunakan metode penelitian yang bersifat deskriftif, yaitu penelitian yuridis normatif, karena penelitian ini bertujuan untuk menggambarkan secara lengkap aspek-aspek hukum dan suatu keadaan yang terjadi dilapangan. Hasil penyelidikan menunjukan Tanggungjawab penydidik atas barang bukti sejak saat benda itu disita oleh penyidik, maka sejak itu apabila barang bukti rusak atau hilang, maka tanggungjawab ini adalah tanggungjawab penyidik pada tingkat penyidikan. Proses Pinjam Pakai Barang Bukti dalam Perkara Pidana dapat dilakukan oleh pemilik barang bukti berdasarkan Peraturan KAPOLRI No. 10 tahun 2010 tentang Tata Cara Pengelolaan Barang Bukti Di Lingkungan POLRI, dalam Bab VI Prosedur Pinjam Pakai Barang Bukti Oleh Pemilik. Kesimpulan, Tanggungjawab penyidik atas barang bukti sejak saat benda itu disita oleh penyidik, maka sejak itu apabila barang bukti rusak atau hilang dan Proses Pinjam Pakai Barang Bukti dalam Perkara Pidana dapat dilakukan oleh pemilik barang bukti berdasarkan Peraturan KAPOLRI No. 10 tahun 2010 tentang Tata Cara Pengelolaan Barang Bukti Di Lingkungan POLRI. Kata Kunci : Barang Bukti, Penyidikan, Pinjam Pakai. Abstract The court conducts an examination process known as proof. For the sake of proof, the presence of objects involved in a criminal act is also very necessary. These objects are often known as "evidence". The problem in this research is What is the Investigator's Responsibility for Evidence? and how is the process of borrowing and using evidence in criminal cases? Research methodology In the preparation of this thesis, a descriptive research method was used, namely normative juridical research, because this study aims to fully describe legal aspects and a situation that occurs in the field. The results of the investigation show that the investigator's responsibility for the evidence from the time the object is confiscated by the investigator, then since then if the evidence is damaged or lost, then this responsibility is the responsibility of the investigator at the investigation level. The process of borrowing and using evidence in criminal cases can be carried out by the owner of the evidence based on KAPOLRI Regulation No. 10 of 2010 concerning Procedures for Management of Evidence within the POLRI, in Chapter VI Procedures for Borrowing and Using Evidence by Owners. In conclusion, the investigator's responsibility for the evidence from the time the object was confiscated by the investigator, then from then on if the evidence is damaged or lost and the Borrowing and Use of Evidence Process in a criminal case can be carried out by the owner of the evidence based on KAPOLRI Regulation No. 10 of 2010 concerning Procedures for Management of Evidence in the POLRI.

Abstract

Bankruptcy of a finance company is a condition in which the company is unable to fulfill its obligations to creditors, resulting in a bankruptcy legal process. In the bankruptcy process, creditors have rights that must be considered, including the right to submit bills, attend creditors' meetings, and obtain payments from the liquidation of the bankrupt company's assets. However, problems often arise regarding payment priorities, objections to asset management, and other legal actions that can affect the position of creditors. Therefore, creditors need to understand the legal remedies that can be taken, such as filing objections to bankruptcy decisions, homologation requests, and other legal steps to protect their interests. This article comprehensively discusses the rights and remedies available to creditors in the face of finance company insolvency proceedings, highlighting relevant legal aspects as well as prevailing practices in Indonesia
