Abstract

This research aims to find out how the wife's position in the household in Wewit Village, Central Adonara District, in terms of Law Number 1 of 1974 concerning Marriage and what are the legal consequences of the position of the wife's rights and obligations in the household in Wewit Village, Adonara District Currently being reviewed is Law Number 1 of 1974 concerning marriage. The research method used by researchers is a type of empirical research, namely research carried out directly in the field, namely by engaging directly with participants, which is related to the formulation of the research problem being studied. The data sources used are the legal sources and materials used are primary legal materials and secondary legal materials. The results of the research show that 1) the position of the wife in the tanges household is equal or balanced with the husband, the rights and obligations of the wife in the household are to earn a living physically and mentally, take care of the household as well as possible, get a dowry, have the right to good treatment from her husband, obey husband's orders and serves the husband's biological needs. 2) the legal consequences of the position of the wife's rights and obligations in the household, namely that the husband may file for divorce (one) if the wife's rights and obligations are not carried out in the household and vice versa, the wife can also file a divorce suit against the husband if the husband does not carry out his rights and obligations properly. Good. The husband must give a warning (tauji) to the wife to immediately change her attitude in carrying out her duties as a wife in the household.

Abstract

In developing a business, a person needs capital assistance from other people who have capital and of course borrowing capital will give rise to a legal act which is based on the agreement of the parties in an agreement called a loan agreement which is commonly used in contract practice. The Airnona Tent of Worship Church itself is a church located on Jalan Kancil Number 33, Airnona Village, Kota Raja District, Kupang City. Where this church, prepares a revolving fund for micro businesses through the Church's diaconate body as program manager and runs this program with an agreement or agreement with certain conditions and in the process the returns are without interest. The main issues are as follows: (1) What is the loan and loan agreement system between the Diaconate Body as the creditor and the Congregation as the debtor at the Airnona Tabernacle Church? (2) What caused the breach of contract to occur between the parties at the Airnona Tent of Worship Church? (3) What countermeasures are used by the Diaconate body when there is a breach of contract (default) by a debtor at the Airnona Tent of Worship Church? The method used in this research is qualitative research, while using an empirical juridical approach. The data collection techniques used were interviews, observation and documentation. The aim of this research is to determine the loan agreement system used by the Church Diaconate Body with Debtors at the Airnona Tent of Worship Church. The research results show that the loan and borrowing agreement for revolving funds for micro businesses at the Tent of Worship Church has written procedures in the form of receipts, but the agreement is very simple and only includes basic information such as the name, address of the debtor, and the due date for refunding the funds without covering the rights aspect, obligations, or sanctions related to breach of agreement. The lack of effectiveness of the assessment team in analyzing data and selecting potential debtors, as well as the lack of regular supervision of each place of business, causes difficulties in dealing with debtors who experience difficulty in fulfilling payment obligations when their business conditions decline or experience bankruptcy. In dealing with problems, coping efforts are limited to verbal warnings, which are often not effective enough to overcome problems or encourage behavior change. The limited authority of Church institutions is also an obstacle, so that handling violations is limited to intensive collection efforts.

Abstract

The change of one's name in practice cannot be separated from the culture and customs that exist and grow in society. In Eastern culture, especially East Nusa Tenggara, it is still believed by some people. Giving the child an inappropriate name will make the child sickly and fragile. The solution is to rename it. After the name change process is complete, what they have to complete is the administrative process, which is to change the name on the birth certificate with a new name. For the recording of name changes themselves carried out based on court determinations, this can be seen from the provisions of Article 52 of Law Number 23 of 2006 concerning Population Administration juncto Article 93 paragraph (2) of Presidential Regulation Number 25 of 2008 concerning Requirements and Procedures for Population Registration and Civil Registration. This research is an empirical legal research, where empirical research is that researchers observe various realities that occur in the Kefamenanu District Court located in the North Central Timor Regency and review them based on the Law, derivative regulations related to the main problem that has been formulated previously by interviewing related parties and then the data that has been obtained is presented using the stages in it, namely coding, editing and tabulation as well as presented with qualitative descriptive.

Abstract

This research focuses on the legal protection of Indonesian Migrant Workers (PMI) in the pre-deployment phase, as implemented by the Department of Manpower and Transmigration of Kupang City in accordance with Law Number 18 of 2017 on the Protection of Indonesian Migrant Workers. The study aims to comprehensively understand the legal protection applied during the pre-deployment phase and identify the obstacles faced in its implementation. Using an empirical legal approach and direct interviews with Department staff and prospective PMI registered in the SIAPKERJA application, the research explores the administrative and technical processes conducted by the Department. The findings reveal that the Department strives to provide comprehensive protection through document validation, training, and interagency coordination. However, challenges such as limited training facilities, insufficient socialization at the village level, and the negative role of brokers still persist. Cooperation between local government and related institutions, such as BP3MI, is crucial to achieving optimal protection for prospective migrant workers. These findings offer recommendations for improving the protection mechanisms for migrant workers in the future.

Abstract

The objective of this research is to examine the legal protection afforded to the welfare and safety of loading and unloading workers (TKBM) in the TKBM Cooperative of Tenau Port Kupang, and the obstacles experienced in its implementation. Empirical legal research methodology is employed, whereby applicable legal provisions are analysed alongside real-time observations of the field. The findings of this research indicate that the legal protection of TKBM at Tenau Kupang Port is in accordance with Law Number 13 of 2003 concerning Labour. The protection encompasses working time, rest time, work safety, and the provision of Personal Protective Equipment (PPE) to minimise the risk of accidents. However, the implementation of these measures is hindered by several factors. These include wage uncertainty, which is dependent on the frequency of ship arrivals, the wage gap between containers and bulk containers, and a lack of awareness regarding the importance of PPE use. Furthermore, inclement weather, damage to transport equipment, and instances of thuggery pose additional challenges to the protection of TKBM's welfare and safety. Not with standing these challenges, the cooperative has introduced BPJS Employment, which provides work accident insurance and old age insurance for workers.as the ‘milk fallacy’ or if it will change the face of the case law as it currently stands.

Abstract

This article analyzes the change of a person's name on a birth certificate based on presidential regulation no. 96 of 2018 in the Atambua district court. A person's name is an important factor in his identity as a subject, while a birth certificate is the first population document obtained by the community since his birth which contains his name and other identities. The change of a person's name on a birth certificate becomes an important matter that should be seen in terms of implementation procedures, obstacles to implementation and legal consequences, which are formulated into problems in the research as follows: (1) What are the implementation procedures for changing one's name on a birth certificate at the Atambua District Court based on Presidential Regulation Number 96 of 2018 concerning Requirements and Procedures for Population Registration and Civil Registration (2) What are the inhibiting factors in changing one's name on a birth certificate quote (3) What are the legal consequences of changing one's name on a birth certificate at the Atambua District Court. This research is empirical juridical in nature which requires primary data sources or field research which requires interview methods and document studies. The results of the study said that the implementation of a person's name change on a birth certificate at the Atambua District Court was slightly different from Presidential Regulation No. 96 of 2018 but still followed the existing requirements, the most obstacles in its implementation were low education, procedures that were considered difficult and the non-acceptance of applications at the Court. The legal consequences are legal certainty and multiple identities.
