Abstract

Perjanjian pinjam meminjam antara nasabah dengan koperasi terjadi kesepakatan perjanjian yang menimbulkan akibat hukum apabila pihak melanggar perjanjian (wanprestasi) maka harus dipertanggungjawabkan. Wanprestasi sering terjadi di beberapa koperasi salah satunya di Kota Tujuan dari penulisan ini untuk mengetahui faktor penyebab wanprestasi pada Nasabah di Koperasi Nasari Kecamatan Oebobo Kota Kupang dan untuk mengetahui tanggung jawab perdata Nasabah wanprestasi di Koperasi Nasari Kecamatan Oebobo Kota Kupang. Hasil penelitian menunjukan: (1) faktor penyebab terjadinya wanprestasi yaitu Usaha nasabah bangkrut, Nasabah pindah wilayah, Keadaan memaksa (Force Majeure),Keterlambatan dalam membayar pinjaman uang dan Itikad buruk oleh nasabah yaitu malas, mengulur-ulur waktu membayar utang pinjaman, (2) tanggungjawab nasabah wanprestasi yaitu kewajiban pembayaran pinjaman, Kewajiban untuk membayar denda atau biaya tambahan, Kewajiban untuk memberikan ganti rugi, Hak koperasi untuk mengambil tindakan hukum, Penghapusan layanan atau privilese dan Pertimbangan hukum. Kesimpulan dari penelitian ini adalah (1) faktor penyebabyaituusaha bangkrut, Pindah wilayah, Keadaan memaksa (Force Majeure), Telambat membayar, Itikad buruk nasabah, seperti malas atau mengulur-ulur waktu (2) tanggung jawab nasabah yaitu Pembayaran pinjaman, Pembayaran denda atau biaya tambahan, Memberikan ganti rugi, Hak koperasi untuk mengambil tindakan hukum, Penghapusan layanan atau privilege dan Pertimbangan hukum.

Abstract

Surat Izin Usaha Perdagangan (SIUP) sangat penting dan harus dimiliki oleh setiap badan usaha perdagangan dalam wilayah negara Indonesia sesuai Peraturan Menteri Perdagangan Nomor 36/M-DAG/PER/9/2007 tentang penerbitan Surat Izin Usaha Perdagangan (SIUP). Penelitian ini bertujuan untuk mengetahui dan menganalisis: (1) Bagaimana kesadaran hukum pelaku usaha terhadap Surat Izin Usaha Perdagangan (SIUP) dalam pelaksanaan kegiatan perdagangan usaha kios? (2) Faktor apa saja yang menjadi hambatan dalam pengurusan Surat Izin Usaha Perdagangan (SIUP). Penelitian ini merupakan jenis penelitian yuridis empiris dan pengumpulan datanya menggunakan teknik wawancara dengan responden dan studi kepustakaan. Data dianalisis secara deskriptif kualitatif. Hasil penelitian ini menunjukkan: (1) kesadaran hukum pelaku usaha terhadap Surat Izin Usaha Perdagangan (SIUP) masih tergolong lemah karena rendahnya tingkat pengetahuan dan pemahaman pelaku usaha untuk mengurus Surat Izin Usaha Perdagangan (SIUP) serta sebagian pelaku usaha belum memahami secara baik tentang Surat Izin Usaha Perdagangan (SIUP) itu sendiri dan kurangnya kontrol dari pihak pemerintah, sehingga masih banyak pelaku usaha yang tidak mengurus Surat Izin Usaha Perdagangan (SIUP); (2) Faktor penghambat dalam pengurusan Surat Izin Usaha Perdagangan (SIUP) yaitu rendahnya tingkat pendidikan yang berpengaruh terhadap minimnya pengetahuan dan pemahaman mengenai Surat Izin Usaha Perdagangan (SIUP), dan kurangnya sosialisasi yang dilaksanakan oleh Dinas Perindustrian, Perdagangan, Koperasi, dan UMKM Kabupaten Timor Tengah Selatan.

Abstract

Marriage is the behavior of creatures created by God Almighty so that life in the natural world can reproduce. Regarding marriage, it is regulated in Articles 26 to 102 of the Civil Code, where the general provisions in the Civil Code are contained in Article 26 of the Civil Code which reads: "The law views marriage only in terms of civil relations." Starting from these provisions, the Civil Code does not consider the importance of religious elements. The research results show: The factors that cause broken promises to marry are because the family does not support or disapprove of their relationship, the perpetrator is just having fun (not seriously dating), and the perpetrator is afraid of starting a family so they choose to run away or are irresponsible , so that the NGO provides this solution. So far, cases of broken promises to marry have been difficult to bring to legal proceedings because there is no legal payment, so the resolution of cases of broken promises to marry is mostly resolved within the family, in this case the victim asks for compensation in the form of a customary fine. The author's conclusions are: The factors that cause one party to break their promise to marry are that the perpetrator is not ready to get married and the relationship between the perpetrator and the victim is not approved by both parents because the perpetrator and victim are still students. The legal consequences for the party who breaks their promise to marry is that the victim's family asks for responsibility in the form of fines, some in the form of money and animals, because so far cases of broken promises to marry handled by the NGO Kupang Women's House are difficult to bring to legal proceedings because there is no legal payout.

Abstract

Cooperatives are one form of economic organization that is getting government attention. A cooperative is an incorporated organization. Cooperative development in Indonesia is part of the overall national development effort. The benefits of this research are: 1) Theoretically, this research can bring new vehicles in building insights in the academic scope as well as a stage of enrichment on theories and for further research can be used as a reference for similar research as information material for cooperative administrators in carrying out their responsibilities. 2) As information material for cooperative members to find out obstacles in the implementation of management responsibilities. The results of this study show that the implementation of the responsibilities of the cooperative management against the loan of cooperative members has been going well, but it has not been maximized where the cooperative teachers in charge of providing convoluted explanations to cooperative members have not all been able to understand the existing explanations. Factors that affect the implementation of the responsibilities of the cooperative management are economic factors that become obstacles in terms of loan installment repayment. In addition, misusing loans for things that deviate from their use.

Abstract

This research aims to find out how the process of resolving fiolates of the costumay rights of the Boti indigenous community, Ki’e district south central Timor regency and also the inhibiting facktot in the resolution process, this research is also expected to be able to contribute idea’s in efforts to understand insights in the field of civil law an in general, for the student community, this research writing is also considered as information for the general public regarding the problem under study, namely costomary rights. the Research method used in this research is empirical research or field studies,which is carried out directly at the actual research location using primary, secondary and tertiary data collection techniques through direct interviews at the research location with compotent respondents according to the problem being taken writer. The results of this research indiccate that the process of resolving violations of the customary rights of the Boti indigenous people is generally resolved by mediation of traditional consensus deliberation based on the principle because all Boti indigenous people have the same genes or blood ties so that traditional mediation is more appropriate to use in the process of resolving violations towards the customary rights of the Boti indigenous community.

Abstract

This study examines the legal protection of consumers of the Regional Drinking Water Company in Belu Regency, Atambua City, based on Law Number 8 of 1999 on Consumer Protection. Based on these issues, this study focuses on two main aspects: (1) how consumer protection for PDAM consumers in Atambua City is regulated under consumer protection law, and (2) the inhibiting factors that hinder the optimal implementation of legal protection for Regional Drinking Water Company consumers in Atambua City.This study employs an empirical juridical research method with a statutory and conceptual approach. Data were obtained through observation, interviews, and literature studies. The research findings indicate that although consumer protection law provides a legal foundation for consumer protection, its implementation in practice remains suboptimal. Several major obstacles include a lack of information transparency, infrastructure limitations, slow responses to consumer complaints, and weak government oversight. Therefore, improving transparency, enhancing infrastructure, and strengthening supervision and policy implementation are necessary to enhance consumer protection in Atambua City.

Abstract

This research examines the exoneration clause's application in consumer protection in Bena Village, South Amanuban District, South Central Timor Regency. The data collection methods were interviews and literature study, with data processing and analysis carried out descriptively and qualitatively. The research results show that the application of the exoneration clause occurs in mixed-type food stalls and kiosks, while it does not apply to service businesses. Factors that influence the implementation of exoneration clauses include a lack of education from the government regarding these clauses and a lack of independent consumer literacy. In conclusion, implementing the exoneration clause in consumer protection in Bena Village is not optimal, and it is recommended that there be outreach to consumers and business actors to increase awareness of consumer rights and replace unsuitable products with better ones.

Abstract

The increasing prevalence of consumerist culture stimulates public interest in consumer financing, particularly in the purchase of motorcycles through credit systems. Non-bank financing institutions have become the primary choice due to their streamlined processes. The issues examined are: (1) How is the implementation of motorcycle lease-purchase agreements at consumer financing companies viewed in light of the civil code, (2) What are the legal consequences of motorcycle sales still bound by lease-purchase agreements at consumer financing companies according to the civil code. This research is normative legal research, utilizing theoretical foundations and legal materials consisting of primary, secondary, and tertiary legal materials, analyzed descriptively qualitatively. The research findings indicate: (1) The implementation of Motorcycle Lease-Purchase Agreements at Consumer Financing Companies, as Reviewed Under the Civil Code, employs the principle of contractual freedom, particularly through standard agreements, which are unnamed contracts stemming from the principle of contractual freedom. Article 1338 of the Civil Code stipulates that all agreements made apply as law to those who make them. (2) The Legal Ramifications of Selling Motorcycles Still Bound by Lease-Purchase Agreements at Consumer Financing Companies (Creditors), as Reviewed Under the Civil Code, entail such actions being deemed unilateral legal actions by consumer financing companies, thereby regarding the first party as still bound by the consumer financing agreement. This transfer contravenes Law Number 42 of 1999 concerning Fiduciary Guarantees, granting the financing company the right to undertake fiduciary execution measures, namely repossession of the motorcycle.

Abstract

The land is essentially the most basic need for everyone so that the presence of the State is to ensure that everyone can be legally protected by their land ownership rights. Many legal problems occur in obtaining recognition from the State of the legal status of one's land ownership. The purpose of this research is to analyze the settlement of disputes overlapping land rights certificates in Non litigation by the Land Office of Kupang Regency. This research method is qualitative, this research was conducted at the Land Office of Kupang Regency, East Nusa Tenggara Province. The population of this research is the Head of the Kupang Regency Land Office 1 person, the Head of Section at the Kupang Regency Land Office 3 people and the Community 2 people. The sample of this research uses a saturated sample technique, which will be the sample in this study are all members of the population. The result of this research is the effort to resolve the dispute over the overlapping certificate of land rights of the Land Office of Kupang Regency in mediation efforts between the two parties in accordance with the Operational Standards and Procedures (SOP) that have been established based on the Regulation of the Minister of Agrarian Affairs Number 21 of 2020 concerning Handling and Settlement of Land Cases, namely by Mediation by bringing both parties with the Head of the Land Office as mediator. While the legal consequences when the occurrence of multiple certificates will cause the certificate does not guarantee legal certainty. Because basically the ownership status of one plot of land there is only one ownership status. It can be concluded that the certificate is strong evidence as long as the other party does not prove otherwise.
