Abstract

One form of state control is to regulate the granting of land rights, including determining the subject of the right and the duration of a land right. The determination of the period of land rights must pay attention to equality of opportunity and access in acquiring and controlling land so as to create the greatest prosperity of the people as the goal of national agrarian law. This is a normative research that focuses on examining the harmony between regulations so that it uses a statute approach and conceptual approach. Therefore, primary legal materials and secondary legal materials obtained based on literature research are used. The data obtained was then analyzed based on content analysis. In this research, it is found that there are overlapping regulations between the Basic Agrarian Law, Governmental Regulation No. 40 of 1996, Agrarian Minister Regulation No. 18 of 2021 and Government Regulation No. 12 of 2023 regarding the extension and renewal of land rights at the same time. In addition, in reality, the simultaneous extension and renewal of land rights causes several things, namely: (1) legal uncertainty because there are regulations as the basis that collide with each other; (2) inequality and injustice for the community in accessing land; and (3) presents unconstitutionality because basically this policy has violated the Constitutional Court's decision.

Abstract

Disgraceful acts are regulated in Article 9 paragraph 1 letter c of Act No. 2 of 2014 concerning the Office of a Notary. Disgraceful acts are degrading honor and dignity, such as gambling, drinking, using drugs and adultery. Meanwhile, disgraceful acts are those who have committed acts that are not in accordance with existing norms in Indonesia such as religious norms, decency and customs. The purpose of this research is to find out what are the types of dismissal of a notary and how is the responsibility of a notary who has committed a disgraceful act. The research method used is normative juridical research. The source of legal material used by the author is secondary data. The result of the research is that a Notary who is caught committing a violation of a disgraceful act as stated in Article 9 paragraph 1 letter C of Act No. 2 of 2014 Concerning Notary Positions, the board of trustees decides for the notary to be temporarily dismissed for 6 months based on the Notary Office Law.

Abstract

Perseroan Terbatas yang selanjutnya disebut perseroan menurut pasal 1 angka 1 Undang-Undang No. 40 tahun 2007 adalah badan hukum yang merupakan persekutuan modal, didirikan berdasarkan perjanjian, melakukan kegiatan usaha dengan modal dasar yang seluruhnya terbagi dalam saham dan memenuhi persyaratan yang ditetapkan dalam undang-undang ini serta peraturan pelaksaanaannya. Dalam hal pendirian PT tertutup sering sekali dijumpai seluruh sahamnya dimiliki oleh satu orang saja, dikarenakan pada saat pendirian perseroan hanya satu orang yang memasukan modalnya kedalam perseroan, sedangkan yang lain tidak memasukkan modalnya kedalam perseroan. Penggunaan nama orang lain dalam anggaran dasar perseroan dapat disebut sebagai pemegang saham pinjam nama, dimana nama-nama orang lain tersebut hanya dipasang sebagai pemegang saham dalam anggaran dasar, namun dia tidak pernah menamkan modalnya kedalam perseroan. Adapun rumusan masalah dalam penelitian ini adalah Bagaimanakah Pengaturan Pemegang Saham Nominee pada UUPT dan UUPM ? Bagaimanaakah Keabsahan Pemegang Saham Nominee Pada UUPT dan UUPM? Metode penelitian ini menggunakan yurudus normatif/doktrinal dengan pendekatan undang-undang. Hasil penelitian ini keberadaan pemegang saham nominee tidak dapat dikatagorikan sebagai pemegang saham karena tidak dapat memenuhi kriteria sebagaimana kewajiban pemegang saham pada umumnya.

Abstract

ABSTRACTNotary can get involved in problem by participating providing false information in an authentic deed. This happens when the appearer comes to the Notary giving information and fake grants in transferring the title of SHM. The method of approach used is normative juridical, which uses qualitative analysis with deductive logic. The data sources used are secondary data and primary data obtained from literature studies. This research found that sanction,liability for notary defendants cannot all be given simultaneously because the una via principle in law and legal protection that can be given to Notaries the prosecution general public and judges must be carried out by obtaining the approval of the MKN and the existence of legal protection from the notary parent organization (INI).Keywords: Accountabilit; Notary; False InformationABSTRAKNotaris dapat terbawa kedalam permasalahan turut serta memberikan keterangan palsu kedalam akta otentik. Hal ini terjadi apabila penghadap datang kepada Notaris memberikan keterangan, hibah palsu dalam melakukan balik nama SHM. Metode pendekatan yang digunakan adalah yuridis normatif, yang menggunakan analisis kualitatif dengan logika deduktif. Adapun sumber data yang dipergunakan adalah data sekunder dan data primer diperoleh dari studi kepustakaan. Penelitian ini mendapatkan hasil bahwa sanksi, pertanggungjawaban bagi terdakwa Notaris tidak semuanya dapat serta merta diberikan secara bersamaan karena terdapat asas una via dalam hukum. serta perlindungan hukum yang dapat diberikan kepada Notaris dalam proses penegakan hukum di persidangan dapat dilakukan melalui proses, yaitu: penuntut umum dan hakim harus dilakukan dengan mendapatkan persetujuan MKN serta adanya perlindungan hukum dari induk organisasi Notaris (INI).  Kata Kunci: Pertanggungjawaban; Notaris; Keterangan Palsu

Abstract

 Penelitian ini berjudul Implementasi Roya Terhadap Hak Tanggungan Tanah Atas Tanah Guna Dijadikan Objek Jual Beli. Istilah roya adalah pencoretan pada buku tanah hak tanggungan karena hak tanggungan telah terhapus. Jika sudah melakukan roya atau pencoretan hak tanggungan maka pemilik tanah tersebut dapat melakukan proses jual beli. Berdasarkan uraian tersebut di atas, maka penelitian ini bertujuan untuk mengetahui tata cara pelaksanaan roya hak tanggungan dan jual beli terhadap tanah dan mengetahui hambatan-hambatan yang dihadapi dalam pelaksanaan pelaksanaan roya hak tanggungan dan jual beli terhadap tanah. Jenis penelitian ini menggunakan jenis penelitian sosio yuridis, spesifikasi penelitian ini deskriptif analitis, metode penentuan sampel berdasarkan metode purposive sampling, metode pengumpulan data diperoleh melalui data primer dan data sekunder, dan metode analisis data dalam penelitian ini analisis kualitatif. Hasil penelitian ini yakni bahwa pelaksanaan roya hak tanggungan melalui pelunasan utang Debitur di Bank, lalu sertifikat di Roya (pencoretan) hak tanggungan di Kantor Pertanahan Kota Semarang dan setelah sertifikat bersih dari hak tanggungan dapat dijadikan sebagai objek jual beli dan dilakukan proses pendaftaran balik nama.   Adapun hambatan-hambatan yang dihadapi dari pelaksanaan roya hak tanggungan dan pelaksanaan jual beli dari lingkup Bank, Debitur dan Kantor Pertanahan Kota Semarang.

Abstract

The Indonesian Lank Bank Agency (“Land Bank”) is a sui generis institution that has broad authority including providing convenience for investors and implementing agrarian reform based on the value of justice and legal certainty. This paper aims to analyze the disorientation of authority and overlapping regulations of the Land Bank, examine the Land Bank's authority based on the cybernetic concept of Talcott Parsons and deconstruct the Land Bank‘s authority in terms of the value of justice. This research is a normative study that uses secondary data collected through literature research and analyzed the data through content analysis. Based on the analysis, it is found that there is a disorientation of the Land Bank‘s authority as its authority to implement the agrarian reform aimed at creating equitable land ownership is contradictory to its authority to facilitate investments that use large areas of land. The implementation of agrarian reform by the Land Bank also faces overlapping regulations and authority. Based on Talcott Parsons' cybernetic concept, the Indonesian government prioritizes investment facilitation authority (economic subsystem) which has the highest energy and therefore ignore agrarian reform (social subsystem) which has lower energy. This is not in line with the principle of justice, namely partiality to the disadvantaged party since it prioritizes the interests of business entities as the more economically advantaged party and overrides the interests of people who do not own land or control land less than the minimum limit.
