Abstract

Penelitian ini mengkaji pengaruh kepentingan politik dalam proses pembentukan peraturan perundang-undangan ditinjau dari perspektif Pancasila sebagai sumber hukum. Tujuan penelitian ini adalah untuk menganalisis pengaruh kepentingan politik dalam pembentukan peraturan perundang-undangan terhadap kualitas peraturan yang dihasilkan dan mengkaji apakah kepentingan politik tersebut dapat diterima dalam konteks aktualisasi nilai-nilai Pancasila. Penelitian hukum ini menggunakan yuridis normatif. Hasil penelitian menunjukkan bahwa pengaruh kepentingan politik terhadap kualitas peraturan sangat bergantung pada kesesuaiannya dengan nilai-nilai Pancasila dan kepentingan masyarakat luas. Kepentingan politik dapat diterima sepanjang sejalan dengan nilai-nilai Pancasila, tidak bertentangan dengan prinsip-prinsip negara hukum, diimbangi dengan partisipasi masyarakat dan pengawasan publik, serta diarahkan untuk mewujudkan tujuan hukum. Pancasila harus menjadi pedoman utama dalam setiap tahapan pembentukan hukum nasional

Abstract

Hirabah is a term or concept in Islamic law that refers to acts of murder, robbery, and sexual assault. Incidents of rape and adultery often make headlines in Indonesia, but many rape victims feel disadvantaged by the judgments handed down by judges, which further victimize them. Additionally, certain articles have undergone an expansion of their meaning, particularly regarding adultery and rape, in order to minimize instances of rape. This study employs a qualitative research design, using approaches such as legal, conceptual, case-based, and comparative approaches. The findings reveal that the legal consequences for rape victims are deemed highly detrimental. This is evident in cases from Aceh, where a female rape victim received a whipping punishment that should not have been imposed on her. Furthermore, the common practice of seeking peaceful resolutions, such as marrying the victim to the perpetrator, is considered highly detrimental to the victims.

Abstract

Customary law is an option in resolving problems and disputes that occur in the indigenous people of Biak Numfor Regency. However, with the passage of Law Number 1 of 2023 concerning the Criminal Code, in deciding all problems, they still pay attention to the laws that live in society. Of course, this will cause an overlap between the two legal systems so that it requires revitalization and harmonization of the two laws. The research is a type of empirical research using the legal pluralism approach. As for this study, snowball sampling and purposive sampling are used in answering the problems raised. The results of the study show that customary law can be harmonized with positive law but with slight changes the difference between the two laws

Abstract

This research aims to analyze the legal arrangements regarding the recognition of the law that lives in society in the 2023 Criminal Code (KUHP) and examine the urgency of integrating customary sanctions in the national penal system, especially in Biak Numfor Regency, as a manifestation of restorative justice. The research method used is normative-empirical legal research, with a legislative, conceptual, and sociological approach, through literature study and analysis of customary case settlement practices in Biak Numfor. The results of the study show that normatively, Article 2 of the 2023 Criminal Code provides a clear legal basis for the recognition of living law as a source of national criminal law. Philosophically, the recognition is in line with the values of Pancasila, the theory of Volksgeist Savigny, and the principle of restorative justice that emphasizes the restoration of social relations. Meanwhile, sociologically, customary settlement practices in Biak Numfor have proven effective in creating peace, strengthening legal legitimacy, and reducing the burden of formal justice. This study emphasizes that the integration of customary sanctions into the national penal system is a strategic step towards a legal system that is humanistic, socially just, and rooted in the local values of Indonesian society.
