Abstract

Notary Deed is the deed with the perfect legitimate evidence, except proven otherwise, in the other hand the privately drawn up deed is the deed which having the equivalent legitimate evidence with the Notary Deed if the signor party acknowledge the privately drawn up deed. The Notary Deed may degrade which cause by incompliance to the provision as stipulated on Law Number 30 Year 2004 which has been amended by Law Number 2 Year 2014 regarding Notary Office (Notary Office Law). In the event of the incompliance to the Notary Office Law it may cause to the parties of the deed, such as if any law suit, therefore the Notary Deed which has been submitted as evidence will be imperfect, and the authenticity will be doubted, this will cause the disadvantage to the party whom submitted the Notary Deed as the Evidence. In Notary Office Law it has been stipulated that in the event of the Notary Deed incompliance with the provision as stipulated on Notary Office Law, therefore the Notary Deed shall be having the legitimate evidence as privately drawn up deed, however how to prevail the provision, is it firstly has to proceed to certain procedure or with immediate effect. The purpose of this research is to acknowledge the procedure of the degradation of the legitimate evidence of the Notary Deed, and the methods of this research is using the yuridical normative method as well as the library research and statute approach.Bahasa Indonesia Abstrak: Akta Notaris adalah suatu akta yang memiliki kekuatan pembuktian yang sempurna, kecuali dibuktikan sebaliknya, sedangkan akta di bawah tangan adalah akta yang memiliki kekuatan pembuktian yang setara dengan Akta Notaris apabila ada pengakuan dari pihak yang menandatangani akta di bawah tangan tersebut. Adapun Akta Notaris ini juga dapat mengalami degradasi yang diakibatkan oleh tidak dipenuhinya ketentuan sebagaimana ditetapkan dalam Undang-Undang No. 30 Tahun 2004 sebagaimana telah diubah dengan Undang-Undang No. 2 Tahun 2014 tentang Jabatan Notaris (UUJN). Hal mana dengan tidak dipenuhinya ketentuan dalam UUJN tentunya dapat membawa dampak kepada para pihak yang membuat akta, di antaranya dalam hal terjadi gugatan di pengadilan, maka Akta Notaris yang dijadikan sebagai alat bukti menjadi tidak sempurna, dan diragukan keautentikannya, yang tentunya hal ini akan membawa kerugian bagi pihak yang menjadikan Akta Notaris tersebut sebagai alat bukti. Dalam UUJN memang telah menetapkan bahwa dalam hal Akta Notaris melanggar ketentuan yang ditetapkan dalam UUJN, maka Akta Notaris tersebut memiliki kekuatan pembuktian sebagai akta di bawah tangan, namun demikian bagaimanakah memberlakukan ketentuan tersebut, apakah hal tersebut harus melalui prosedur tertentu terlebih dahulu ataukah serta merta. Tujuan penelitian ini adalah untuk mengkaji dan membahas bagaimana proses degradasi kekuatan pembuktian Akta Notaris Penelitian ini menggunakan metode penelitian dengan jenis penelitian yuridis normatif, yang menggunakan studi kepustakaan dan pendekatan perundang-undangan.

Abstract

In Indonesia, the execution of court decisions regarding child custody is still a matter of debate among legal experts because the object is a person (human), not an inanimate object. This research will focus on discussing how regulations and execution of court decisions regarding child custody are carried out as well as how the concept of joint custody can be applied to minimize disputes related to child custody. This research is normative juridical research with a statutory and conceptual approach. Even though there are no regulations in Indonesia that comprehensively regulate child custody or its execution, the execution related to child custody can still be carried out guided by generally applicable procedures regarding execution of court decisions. The execution of child custody rights carried out in this way has a low level of success and is prone to causing problems where children's rights which should be protected are violated. For this reason, it is hoped that the concept of joint custody can be applied to minimize the emergence of disputes related to child custody.

Abstract

The development in the current digital era has certainly brought significant changes in various aspects of life, including in notary practice. Therefore, this journal discusses the impact of technology and information on notary practice, with a focus on the aspect of legal certainty related to the concept of Cyber Notary. While there are still concerns in the practical and ethical aspects of implementing Full Cyber Notary in Indonesia, thereforeThrough legal analysis and literature study, this journal highlightsvarious problems of implementing Cyber Notary in Indonesia based on ethical and practical aspects such as the non-accommodation of Cyber Notary in laws and regulations, especially the Notary Law and the unpreparedness of the Cyber Notary implementation system including human resources and uneven distribution of infrastructure. Therefore, the Author Team provides a solution mechanism, namely the Cyber Notary practice method that reconciles laws and regulations related to Notaries in Indonesia reviewed based on progressive law. The Author Team provides a resolution mechanism with the implementation of Cyber Notary in a hybrid manner, which is a combination of current notary practices, namely conventionally with digital implementation, this is as the concept of progressive law which states that there are always weaknesses in the dynamics of law, as we know that existing laws will certainly always change and develop in society along with the social dynamics that occur. In implementing this hybrid system, it is important to adjust the laws related to Cyber Notary to the work area, the person appearing and reading the deed, signing to storing the deed, in addition, related parties such as the Indonesian Notary Association (INI) are also needed in the training and certification process specifically for notaries who will carry out Cyber Notary. Because in the context of implementing Cyber Notary, it is necessary to adjust the laws and regulations in order to provide legal certainty for Notaries and ensure the legality and authentication of electronic deeds are equivalent to conventional deeds, so that there is no overlap or ambiguity related to Cyber Notary in the formation or storage of an authentic deed.

Abstract

In Indonesia, the legal certainty of interfaith marriages is a long-standing problem because the existing positive law does not provide legal certainty regarding the validity of such marriages. In response, the Supreme Court attempted to harmonize the views regarding interfaith marriages by issuing SEMA Number 2 of 2023 which basically contains an appeal to judges in court not to grant requests for registration of interfaith marriages, which upon further review turns out to contain a series of problems. The purpose of this research is to conduct a judicial review on SEMA Number 2 of 2023 regarding the implementation of interfaith marriages in Indonesia to find out how interfaith marriages were regulated before SEMA Number 2 of 2023, what is the legal standing and problems of SEMA Number 2 of 2023 regarding the implementation of interfaith marriages in Indonesia, and how interfaith marriages are implemented after SEMA Number 2 of 2023. This research is a normative juridical research that uses statutory approach method, where the material collection technique used is library research. Not only does the issuance of SEMA Number 2 of 2023 limit the rights of Indonesians to carry out interfaith marriages, but upon closer examination, SEMA Number 2 of 2023 also violates the legal principle of Lex Superior Derogat Legi Inferiori because the provision of SEMA Number 2 of 2023 conflicts with Article 35 of Law Number 23 of 2006 concerning Population Administration as well as the legal principles applicable in the judicial environment such as Judiciary Independence. Bahasa Indonesia Abstract: Di Indonesia, kepastian hukum perkawinan beda agama merupakan salah satu problematika yang telah berlangsung lama dikarenakan hukum positif yang ada tidak memberikan suatu kepastian hukum terhadap sah tidaknya perkawinan yang demikian. Atas dasar hal tersebut, Mahkamah Agung berusaha untuk menyelaraskan pandangan terkait perkawinan beda agama dengan mengeluarkan SEMA Nomor 2 Tahun 2023 yang pada dasarnya memuat himbauan bagi para hakim di pengadilan untuk tidak mengabulkan permohonan pencatatan perkawinan beda agama, yang apabila ditinjau lebih lanjut ternyata memuat serangkaian problematika. Tujuan penelitian ini adalah untuk melakukan tinjauan yuridis SEMA Nomor 2 Tahun 2023 terhadap pelaksanaan perkawinan beda agama di Indonesia untuk mengetahui bagaimana pengaturan perkawinan beda agama sebelum SEMA Nomor 2 Tahun 2023, bagaimana kedudukan hukum dan problematika SEMA Nomor 2 Tahun 2023 terhadap pelaksanaan perkawinan beda agama di Indonesia, dan bagaimana pelaksanaan perkawinan beda agama pasca SEMA Nomor 2 Tahun 2023. Penelitian ini merupakan penelitian yuridis normatif yang menggunakan metode pendekatan perundang-undangan, di mana teknik pengumpulan bahan yang digunakan adalah studi kepustakaan. SEMA Nomor 2 Tahun 2023 tidak hanya membatasi hak masyarakat Indonesia untuk melaksanakan perkawinan beda agama, namun apabila ditinjau lebih lanjut, SEMA Nomor 2 Tahun 2023 juga melanggar asas hukum Lex Superior Derogat Legi Inferiori karena ketentuan SEMA Nomor 2 Tahun 2023 bertentangan dengan Pasal 35 Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan serta prinsip hukum yang berlaku di lingkungan peradilan seperti Judiciary Independence.

Abstract

The Constitutional Court's Decision Number 168/PUU-XXI/2023 concerning the testing of the Job Creation Law has had a significant impact on various aspects of employment in Indonesia, including the protection of workers' rights and the role of trade unions in strategic industries. The purpose of this study is to analyze the impact of the Constitutional Court's decision Number 168/PUU-XXI/2023 on industrial relations between workers and entrepreneurs in the semiconductor manufacturing sector in Indonesia. This study uses a qualitative approach with a case study design to analyze the impact of the Constitutional Court's decision Number 168/PUU-XXI/2023 on labor unions and worker protection in the semiconductor manufacturing sector. The results of this study show that the Constitutional Court Decision Number 168/PUU-XXI/2023 provides more flexibility for employers in regulating employment, which has an impact on the tension of industrial relations between workers and employers, especially related to the increase in workload and reduced protection of workers' rights. This can be seen from data that shows a decline in workers' trust in trade unions and an increase in dissatisfaction with working conditions. Although unions have great potential in protecting workers' rights, they face major challenges in increasing member participation and their relevance to workers' needs. Employers who neglect worker welfare risk lower employee retention and productivity, while companies that care about worker welfare show more positive relationships with unions as well as better stability. The government also plays an important role in creating a balanced labor policy, prioritizing the welfare of workers without neglecting flexibility for employers

Abstract

Bad debts in banks can arise from debtor negligence, lack of good faith, or incompetence. These bad debts negatively impact a bank’s performance and require immediate resolution. One effective method to address them is by selling or transferring receivables through a legal process known as cession. In this process, a bank (as the original creditor) transfers its claim or credit receivable to another party (the new creditor). As a result, the rights and obligations of the original creditor shift to the new one. This study uses a normative legal approach, focusing on how banks can resolve bad debts through cession. Legally, the transfer of receivables changes the relationship between the debtor and creditor. Cession can be an effective solution for banks, especially when facing legal challenges in executing mortgage right auctions. It offers a faster and simpler legal route, with lower legal risks if proper risk mitigation is in place. To protect creditors legally, risk mitigation should be conducted beforehand. This includes financial risk assessments, ensuring all collateral is properly signed and registered, and notifying debtors of the receivables transfer. With these precautions, the cession mechanism can serve as a strategic and legally sound approach to resolving bad debts.

Abstract

Electronic agreements are a development of conventional agreements which in their implementation cannot be separated from the provisions of contract law, especially those relating to agreements as regulated in the Civil Code. Until now, the Civil Code has been the main legal basis for electronic agreements and transactions. The validity of electronic agreements still refers to the valid conditions of agreements as stated in Article 1320 of the Civil Code which is then specifically regulated in the ITE Law and/or Government Regulation Number 80 of 2019 concerning Electronic Commerce (PP PMSE). This study aims to conduct a legal study and review of the validity of the valid conditions of agreements contained in Government Regulation Number 80 of 2019 concerning Electronic Commerce against Article 1320 of the Civil Code. This study uses normative juridical legal method with approach to various literature (libraries) that can be obtained from written legal sources such as books, laws and regulations, scientific articles, research results and opinions of legal experts and other sources that have relevance related to the topic of this research. The results of this study indicate that the addition of two main conditions in the PP PMSE does not conflict with Article 1320 of the Civil Code. This is because the provisions in the PP PMSE still adhere to the basic principles of contract law in Indonesian civil law, as regulated in Article 1320 of the Civil Code. Bahasa Indonesia Abstract: Perjanjian elektronik merupakan pengembangan dari perjanjian konvensional yang dalam pelaksanaannya tidak dapat terlepas dari ketentuan-ketentuan hukum perikatan, khususnya yang berkaitan dengan perjanjian yang sebagaimana di atur dalam KUHPerdata. Hingga saat ini KUHPerdata menjadi dasar hukum utama dalam perjanjian dan transaksi elektronik. Keabsahan perjanjian elektronik tetap mengacu pada syarat sah perjanjian sebagaimana tercantum dalam Pasal 1320 KUHPerdata yang kemudian secara khusus diatur dalam UU ITE dan/atau Peraturan Pemerintah Nomor 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik (PP PMSE). Penelitian ini bertujuan untuk untuk melakukan kajian dan tinjauan hukum mengenai keabsahan syarat sah perjanjian yang termuat di dalam Peraturan PP PMSE terhadap Pasal 1320 KUHPerdata. Penelitian ini menggunakan metode hukum yuridis normatif dengan pendekatan terhadap berbagai literatur (kepustakaan) yang dapat diperoleh dari sumber-sumber hukum tertulis seperti buku, peraturan perundang-undangan, artikel ilmiah, hasil penelitian dan pendapat-pendapat ahli hukum serta sumber lainnya yang mempunyai relevanansi terkait dengan topik penelitian ini. Hasil penelitian ini menunjukkan bahwa penambahan dua syarat utama dalam PP PMSE tidak bertentangan dengan Pasal 1320 KUHPerdata. Hal ini dikarenakan ketentuan dalam PP PMSE tetap berpegang pada prinsip-prinsip dasar hukum perjanjian dalam hukum perdata Indonesia, sebagaimana diatur dalam pasal 1320 KUHPerdata.

Abstract

As a developing country, construction services are essential to Indonesia's economic growth. Based on current conditions, consumer protection in Indonesia's construction/building materials sector still faces challenges such as low consumer awareness and weak supervision of business actors. This research aims to analyze how norms are implemented in the law of engagement between consumers and business actors in the building materials sector, the view of the law of engagement towards retail consumers of building materials or contractors, and how the law protects retail consumers of building materials who are also business actors. The research method used is the normative legal research method, which aims to identify legal rules, principles, and doctrines as answers to emerging legal problems. The results of this research explain that the construction services sector is regulated by various regulations, such as Law No. 2 of 2017 concerning Construction Services, which regulates responsibilities, quality standards, and protection mechanisms in construction services. In this context, contract law and consumer protection play a central role in ensuring justice and legal certainty, especially for consumers of building materials who act as business actors.  As a consumer, you have the right to clear information, product quality that meets standards, and security guarantees, as regulated in the Consumer Protection Law (UU No. 8 of 1999) and the Civil Code (Civil Code). On the other hand, business actors are obliged to ensure that the products sold are safe and fulfill the agreement. In implementing engagement legal norms, law enforcement involves mediation, arbitration, courts, and administrative and criminal sanctions.

Abstract

This article aims to highlight the discrepancies between the regulation and the implementation of laws regarding identities and the administration of the indigenous communities in Indonesia, and how these issues occur and persist. Indonesian Identity Card or KTP and its electronic variant, e-KTP, is considered the primary identifying means for Indonesian citizenship, with the Population Administration Act (Law No. 23/2006, later amended by Law No. 24/2013) even mandating the government to provide all public services based on the NIK or Customs Identification Number. Consequently, this poses a risk of excluding and marginalizing certain segments of the population, namely the Indigenous people of Indonesia, as this document has become mandatory for accessing essential services provided by the government. This exclusion and discrimination of indigenous groups and communities is based on a lack of access to register for the e-KTP itself, and is even based on religion and identity. To examine this issue, this article uses qualitative research, specifically grounded theory methodology, by examining data and law, and reviewing reports made by or of a few different Indigenous communities throughout Indonesia– namely, case studies and reports from indigenous communities in Banten, Sumatra, and Papua, to get a better understanding of this nationwide issue. This article elucidates systemic issues that occur and the problems that emerge from relying solely on one specific identification document for Indigenous people and communities in Indonesia.
