Abstract

The primary objectives of this study encompass three main aspects: firstly, to determine and thoroughly analyze the influence of Leadership Agility on Organizational Agility; secondly, to ascertain and examine the impact of Organizational Culture on Organizational Agility; and finally, to establish and evaluate the effect of Motivation on Organizational Agility. To accomplish these objectives, a research methodology comprising descriptive analysis and multiple linear regression analysis was employed, with a sample size consisting of 85 respondents. The outcomes derived from the multiple linear regression analysis revealed several noteworthy findings. Firstly, it was observed that Leadership Agility exerted a positive and significant influence on Organizational Agility. This suggests that leaders who possess agile qualities, such as adaptability, flexibility, and effective decision-making, contribute significantly to enhancing the overall agility of the organization. Secondly, the study found that Organizational Culture also played a crucial role in shaping Organizational Agility. A positive and significant relationship was identified, indicating that a strong and supportive culture that values innovation, collaboration, and learning fosters organizational agility. Lastly, the analysis demonstrated that Motivation exhibited a positive and significant impact on Organizational Agility. Motivated employees who are driven by intrinsic and extrinsic factors, such as recognition, rewards, and a sense of purpose, contribute to a more agile organization. Overall, this research underscores the importance of Leadership Agility, Organizational Culture, and Motivation in driving and sustaining Organizational Agility. The findings emphasize the significance of cultivating agile leaders, fostering a supportive culture, and nurturing employee motivation to enhance an organization's ability to adapt, innovate, and thrive in a dynamic business environment.

Abstract

The atmosphere of the check and balances relationship in the Trias Politica between state agencies tests each other because each state agency may not exceed the limits of power that have been determined by the laws and regulations of state agencies, their powers are not interfered with so that there is a balance of power between state agencies. Through a normative legal approach related to the arrangement of independent supporting state institutions, it can be concluded as follows: First, looking at the level or hierarchy of laws and regulations that regulate independent state institutions, the higher the laws and regulations that underlie their formation such as the National Human Rights Commission, the General Elections Commission, the Corruption Eradication Commission and other state institutions that have what is called constitutional importance, the more independent the institution is. Second, looking at the functions carried out by independent supporting institutions, these state institutions can also be grouped based on the functions inherent in the institution, such as institutions that carry out judicial functions based on Article 24 paragraph (3) such as: the Corruption Eradication Commission, the Prosecutor's Office, and the National Police, Executive functions such as the National Human Rights Commission, legislative functions such as the Financial Transaction Reports and Analysis Center, and the Indonesian National Police.  Keywords: Arrangement of State Institutions, Independent Supporters, State Administration System

Abstract

The phenomenon of citizens' personal data misappropriation into political party membership through the SIPOL application in the 2024 Election reveals a regulatory disharmony within Indonesia's digital democracy ecosystem. The digitalization of political party verification, originally intended to enhance administrative efficiency, has in practice triggered privacy rights violations due to the unauthorized use of National Identification Numbers (NIK). This study focuses on two main issues: firstly, the implications of regulatory inconsistencies between the Personal Data Protection Act (PDP Act) and the General Elections Commission Regulation (PKPU) for the effectiveness of restoring the rights of victims of identity theft within the electoral information system; secondly, the necessary restructuring of electoral personal data protection to achieve substantive electoral justice. To address these issues, this study aims to analyse the effectiveness of legal protection for victims of data misuse, evaluate the KPU’s operational performance in handling public complaints, and examine the implications of regulatory fragmentation for legal certainty and substantive justice. The research method employed is socio-legal research with a single case study model in Jember Regency using purposive sampling techniques. Data were collected through in-depth interviews with KPU commissioners and victims of data misappropriation, and analyzed using statutory and conceptual approaches. The results of this study indicate that the currently available protection mechanisms remain administrative-procedural and have not been able to provide complete rights restoration. This is evidenced by the existence of "data residuals" in SIPOL despite the submission of objection reports, rooted in the absence of automatic data status update protocols and the failure to shift the burden of proof to political parties. This study concludes that strengthening the integrity of electoral democracy requires a reconstruction of technical regulations that integrate the principles of the Personal Data Protection Law (UU PDP) into the electoral information system through the harmonization of KPU Regulations (PKPU), the enforcement of progressive administrative sanctions, and the provision of accountable self-correction data features.
