Abstract

ABSTRACT??The members of INA and PIR don?t give right to vote and be elected in general elections because there is worried about right to vote and be elected will be bringing on not neutral in general election, with the result that general elections principle is direct, general, secret, honest, and fair will not be achieved if right to vote and be elected is given. Although that worried still be able to debate in theoretical. It is becaused if right to vote and be elected for members of INA and PIR are given, so will not influence the vote result majority in general elections. The concept? to give right to vote and be elected? for members INA and PIR in general elections need to be implemented, because in the first general elections in 1955 the members of INA and PIR follow to vote and be elected in general election, and than there was not problem happen in thats time. Because of that? be alternative thought bargained? in this thesis; The concept? of? legal protection? for members INA and PIR in political freedom is looked from human right protection principle is given? freedom for members INA and PIR? to vote the candidates house representatives, house representative region, house representative people, President and Vice President with free without any pressures from the institution INA and PIR. And than? for the members INA and PIR propose their self as candidates the members House Representative, House Representative Region, House Representative People, President and Vice President permitted to be candidate as form of political freedom to every people?Keyword: legal equality, political freedom, general election.

Abstract

One day before the sea alms event held by coastal residents around Pantai Baru, Bantul Regency, a group of mobs carried out an act of violence that destroyed property (ubo rampe) for the event. The mass group considers that the marine charity event, which coastal residents routinely carry out, is an activity of shirk. Research in this journal is normative juridical (legal research), which focuses on studying the principles or norms in positive law, especially legal instruments in the field of Human Rights, both nationally and internationally. This type of research is carried out by examining formal legal regulations such as laws and literature containing theoretical concepts, which are then linked to the issues raised in the journal, namely aspects of human rights violations. The actions of a group of mobs that prevent the community from carrying out the sea alms tradition violate human rights. The government can try to protect the people's human rights in a preventive and repressive manner. This type of research is carried out by examining formal legal regulations such as laws and literature containing theoretical concepts, which are then linked to the issues raised in the journal, namely aspects of human rights violations. Abstract

Every five years, the Indonesian state conducts General Elections, including the Presidential Election or General Election for the President and Vice President. The occurrence of General Elections is closely linked to the phenomenon of Abstention. In the 2019 Presidential Election in Sidoarjo Regency, the Abstention rate was recorded at 18.12%. One contributing factor to Abstention is individuals adhering to a pragmatic typology; they prioritize personal gains from candidate pairs rather than considering their vision and mission. Regional general elections play a crucial role in reducing Abstention rates by actively engaging all levels of society and emphasizing the significance of participating in General Elections. Empirical juridical research reveals that the prevalent cause of abstaining is a pragmatic mindset, where voters lack awareness of their choices. The absence of sanctions in Law Number 7 of 2017 Concerning General Elections makes abstaining an easily committed act. The Sidoarjo Regency KPU's efforts to diminish Abstention figures are guided by KPU Regulation Number 10 of 2018, focusing on socialization, voter education, and encouraging societal participation in General Elections. The study emphasizes the need for public awareness regarding the importance of elections, discouraging Abstentions, and advocating for accessible TPS locations through KPU initiatives, ensuring convenience for voters when casting their ballots.

Abstract

Cryptocurrency adalah jenis baru dari uang digital yang memanfaatkan teknologi kriptografi untuk melindungi transaksi dan mengatur pembuatan unit-unit baru. Teknologi blockchain yang menjadi dasar utama cryptocurrency menciptakan sistem keuangan yang tidak terpusat, transparan, dan sulit untuk dimanipulasi. Dalam beberapa tahun terakhir, permintaan dan penggunaan cryptocurrency telah meningkat secara signifikan, baik sebagai sarana investasi maupun sebagai alternatif untuk sistem pembayaran internasional. Meskipun memiliki potensi, terdapat berbagai tantangan yang perlu dihadapi, seperti fluktuasi nilai yang ekstrem, belum adanya regulasi yang konsisten, serta ancaman keamanan siber. Penelitian ini mengulas secara umum perkembangan cryptocurrency, cara kerjanya, manfaat yang mungkin didapat dalam keuangan modern, serta risiko yang menyertainya. Dengan memahami sisi teknis dan ekonomi dari cryptocurrency, diharapkan masyarakat bisa lebih bijaksana dalam memanfaatkan teknologi ini di era digital yang terus berubah. Penelitian ini bertujuan untuk menganalisis aspek legalitas serta potensi kejahatan finansial dalam penggunaan cryptocurrency di Indonesia. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan perun-dang-undangan, konseptual, perbandingan hukum, dan historis. Hasil penelitian menunjukkan bahwa pengaturan hukum terhadap cryptocurrency di Indonesia masih bersifat parsial dan memerlukan penyempurnaan. Oleh karena itu, diperlukan kebijakan hukum yang komprehensif melalui pembentukan norma baru atau pembaruan dalam Kitab Undang-Undang Hukum Pidana (KUHP) sebagai bentuk umbrella provision guna memberikan kepastian dan perlindungan hukum bagi masyarakat. Temuan ini diharapkan dapat menjadi kontribusi dalam perumusan regulasi yang adaptif terhadap dinamika teknologi keuangan digital

Abstract

The Constitutional Court’s growing involvement in regulatory matters has sparked intense debate, particularly following Decision No. 90/PUU-XXI/2023 on the age requirement for presidential and vice-presidential candidates. Issued near the candidate registration deadline, this ruling raised concerns about the Court's shift from a negative to a positive legislator. Previous studies have not adequately examined this transformation through the lens of classical justice theory, leaving a critical gap in constitutional discourse. This study aims to (1) assess whether the decision constitutes a positive legislator act, (2) evaluate it through classical justice theory, and (3) compare it with similar rulings. Using normative legal research, it adopts statutory, case, and conceptual approaches, with legal reasoning conducted through analogical and deductive interpretations of judicial precedents, constitutional norms, and principles of justice. The analysis reveals that the Court has increasingly assumed regulatory functions, with Decision No. 90 exemplifying this trend. However, it does not align with Platonic ideals of justice, lacking both moral and procedural fairness. The study concludes that the Court's expanded role poses constitutional risks and fuels ongoing debates on judicial activism versus legislative supremacy, while offering a fresh perspective through the application of classical justice theory. Meningkatnya keterlibatan Mahkamah Konstitusi dalam ranah regulasi telah memicu perdebatan yang intens, khususnya setelah Putusan No. 90/PUU-XXI/2023 terkait syarat usia calon presiden dan wakil presiden. Putusan ini dikeluarkan menjelang tenggat waktu pendaftaran calon, sehingga menimbulkan kekhawatiran mengenai pergeseran peran Mahkamah dari legislator negatif menjadi legislator positif. Studi-studi sebelumnya belum secara memadai mengeksplorasi transformasi ini melalui lensa teori keadilan klasik, sehingga menyisakan kekosongan penting dalam diskursus ketatanegaraan. Penelitian ini bertujuan untuk: (1) menilai apakah putusan tersebut merupakan tindakan legislator positif, (2) mengevaluasinya menggunakan teori keadilan klasik, dan (3) membandingkannya dengan putusan-putusan serupa. Dengan menggunakan metode penelitian hukum normatif, studi ini mengandalkan pendekatan perundang-undangan, kasus, dan konseptual, serta penalaran hukum melalui interpretasi analogis dan deduktif terhadap preseden yudisial, norma-norma konstitusional, dan prinsip-prinsip keadilan. Analisis menunjukkan bahwa Mahkamah semakin mengambil peran regulatif, dan Putusan No. 90 mencerminkan tren tersebut. Namun, putusan ini tidak sejalan dengan cita keadilan menurut Plato karena tidak mencerminkan keadilan moral maupun prosedural. Penelitian ini menyimpulkan bahwa perluasan peran Mahkamah menimbulkan risiko konstitusional dan turut memperkuat perdebatan mengenai aktivisme yudisial versus supremasi legislatif, sembari menawarkan perspektif baru melalui penerapan teori keadilan klasik.

Abstract

Indonesia's polygamy regulations, which allow men to practice polygamy and prohibit women from practicing polygamy, have the potential to violate human rights. Suppose the study of the theory of state responsibility, the assertion of gender equality must be supported in all aspects of life, especially in marriage. Indonesia has also ratified CEDAW as a national law that can be used as a guide. Therefore, the ratification of CEDAW has significant implications for Indonesia, which will immediately revise the polygamy requirements in the marriage law to prevent discrimination from continuing. It is because delaying the protection of human rights also means that the state cannot protect and respect women's rights and is considered reckless. Therefore, state delays can be viewed as a violation of human rights.
