Abstract

The 1983 law on mass organization states that each mass organization shall use Pancasila as the only organization basis is not effective anymore. This ineffectiveness is due to the silence in talking about Pancasila under perspective in solving the problems of the nation and to the reluctance of the government to enforce Pancasila as the only basis for mass organizations. Therefore, it is time to amend it by adopting the 2008 law on political parties, especially those dealing with the position of Pancasila as a basis that enables mass organizations to adopt other basis with stipulation that the  adopted basis should not be in contradiction to the Pancasila ideology

Abstract

Consumer protection in transacting through internet media, how is the validity of the use of standard agreements in e-commerce buying and selling transactions in Indonesia based on the Law on Information and Electronic Transactions No. 11 of 2008, regarding this inability can be started from the fact that there is no specific definition for e-commerce within the framework of the ITE Law, because trade activities carried out electronically are understood as "electronic transactions". How is the legal protection for consumers based on Law No. 8 of 1999 concerning the Consumer Protection Law (UUPK). Technological advances have led to a virtual world of trade transactions through the internet (e-commerce). As well as consumer protection in transactions in buying and selling leads to the failure to meet sellers and buyers directly. A sale and purchase agreement agreement will usually be reached through the medium of term of use and sale term conditions or what is called a standard agreement that has been provided by the website merchant, and if an online consumer accepts the term of use and sales term conditions, then the consumer only needs to select the accept button and at that time an agreement is born between the website merchant and the online consumer. The research method used is normative juridical. The data collection technique used is a literature study. In the consumer law No. 8 of 1999, there is consumer protection.

Abstract

The Constitutional Court’s growing involvement in regulatory matters has sparked intense debate, particularly following Decision No. 90/PUU-XXI/2023 on the age requirement for presidential and vice-presidential candidates. Issued near the candidate registration deadline, this ruling raised concerns about the Court's shift from a negative to a positive legislator. Previous studies have not adequately examined this transformation through the lens of classical justice theory, leaving a critical gap in constitutional discourse. This study aims to (1) assess whether the decision constitutes a positive legislator act, (2) evaluate it through classical justice theory, and (3) compare it with similar rulings. Using normative legal research, it adopts statutory, case, and conceptual approaches, with legal reasoning conducted through analogical and deductive interpretations of judicial precedents, constitutional norms, and principles of justice. The analysis reveals that the Court has increasingly assumed regulatory functions, with Decision No. 90 exemplifying this trend. However, it does not align with Platonic ideals of justice, lacking both moral and procedural fairness. The study concludes that the Court's expanded role poses constitutional risks and fuels ongoing debates on judicial activism versus legislative supremacy, while offering a fresh perspective through the application of classical justice theory. Meningkatnya keterlibatan Mahkamah Konstitusi dalam ranah regulasi telah memicu perdebatan yang intens, khususnya setelah Putusan No. 90/PUU-XXI/2023 terkait syarat usia calon presiden dan wakil presiden. Putusan ini dikeluarkan menjelang tenggat waktu pendaftaran calon, sehingga menimbulkan kekhawatiran mengenai pergeseran peran Mahkamah dari legislator negatif menjadi legislator positif. Studi-studi sebelumnya belum secara memadai mengeksplorasi transformasi ini melalui lensa teori keadilan klasik, sehingga menyisakan kekosongan penting dalam diskursus ketatanegaraan. Penelitian ini bertujuan untuk: (1) menilai apakah putusan tersebut merupakan tindakan legislator positif, (2) mengevaluasinya menggunakan teori keadilan klasik, dan (3) membandingkannya dengan putusan-putusan serupa. Dengan menggunakan metode penelitian hukum normatif, studi ini mengandalkan pendekatan perundang-undangan, kasus, dan konseptual, serta penalaran hukum melalui interpretasi analogis dan deduktif terhadap preseden yudisial, norma-norma konstitusional, dan prinsip-prinsip keadilan. Analisis menunjukkan bahwa Mahkamah semakin mengambil peran regulatif, dan Putusan No. 90 mencerminkan tren tersebut. Namun, putusan ini tidak sejalan dengan cita keadilan menurut Plato karena tidak mencerminkan keadilan moral maupun prosedural. Penelitian ini menyimpulkan bahwa perluasan peran Mahkamah menimbulkan risiko konstitusional dan turut memperkuat perdebatan mengenai aktivisme yudisial versus supremasi legislatif, sembari menawarkan perspektif baru melalui penerapan teori keadilan klasik.

Abstract

The atmosphere of the check and balances relationship in the Trias Politica between state agencies tests each other because each state agency may not exceed the limits of power that have been determined by the laws and regulations of state agencies, their powers are not interfered with so that there is a balance of power between state agencies. Through a normative legal approach related to the arrangement of independent supporting state institutions, it can be concluded as follows: First, looking at the level or hierarchy of laws and regulations that regulate independent state institutions, the higher the laws and regulations that underlie their formation such as the National Human Rights Commission, the General Elections Commission, the Corruption Eradication Commission and other state institutions that have what is called constitutional importance, the more independent the institution is. Second, looking at the functions carried out by independent supporting institutions, these state institutions can also be grouped based on the functions inherent in the institution, such as institutions that carry out judicial functions based on Article 24 paragraph (3) such as: the Corruption Eradication Commission, the Prosecutor's Office, and the National Police, Executive functions such as the National Human Rights Commission, legislative functions such as the Financial Transaction Reports and Analysis Center, and the Indonesian National Police.  Keywords: Arrangement of State Institutions, Independent Supporters, State Administration System
