Abstract

Background. This research raises the issue of the existence of customary law communities in Indonesia, as well as the dynamics of customary law communities seen from the decision of the Constitutional Court. Purpose. This research is focused on analyzing two things, namely: First, what is the existence of indigenous peoples in Indonesia? Second, how is the legal politics of indigenous peoples through the decision of the Constitutional Court? This research uses a statute approach. Method. his research uses a statute approach. In addition, a case approach is also used to find out the ratio decidendi used by the Constitutional Court judges in deciding cases of judicial review of laws related to indigenous peoples. Results. The results of the study concluded: first, the existence of indigenous peoples in Indonesia has been accommodated in various spheres of legislation, both in the 1945 Constitution, Laws, Regional Regulations, Governor Decrees, and Regent Decrees. Second, the legal politics of indigenous peoples through the decision of the Constitutional Court strengthens the existence of indigenous peoples in Indonesia by providing various interpretations or explanations. Conclusion. this study are that the Panel of Judges in cases of criminal acts of narcotics abuse should minimize criminal disparities to prevent the development of a negative perspective of society towards the criminal system in judicial institutions.

Abstract

This study is motivated by the growing complexity of post-divorce child custody determinations, particularly in cases where the mother declines her custodial responsibilities and the father petitions for custody as the primary caregiver. The objective of this research is to analyze the legal basis and judicial considerations underlying the assignment of custody rights to fathers, to identify the influence of social, psychological, and financial factors on such decisions, and to assess the contribution of these elements to strengthening the best interests of the child principle. Employing a normative legal approach, this study centers on the Cikarang District Court Decision No. 38/Pdt.G/2019/PN Ckr as its case study. The findings reveal that the court’s ruling was grounded in legal documentation, the child’s emotional condition, environmental stability, and the father's financial capability. The study concludes by underscoring the critical importance of prioritizing the child's best interests over gender-based assumptions and advocates for more responsive, evidence-based, and child-centered custody policies in Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim dalam memutuskan hak asuh anak dalam putusan Nomor 38/Pdt.G/2019/PN Ckr, dengan fokus pada pemenuhan prinsip kepentingan terbaik bagi anak, serta implikasi putusan terhadap pelaksanaan kewajiban orang tua pasca perceraian. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan studi kasus dan analisis dokumen. Penelitian ini menganalisis bukti-bukti persidangan dan pertimbangan hukum yang digunakan oleh hakim dalam memutuskan hak asuh anak. Hasil penelitian menunjukkan bahwa putusan hakim telah memenuhi prinsip kepentingan terbaik bagi anak, dengan mempertimbangkan faktor-faktor seperti kedekatan emosional anak dengan penggugat, kemampuan penggugat dalam memberikan kebutuhan dasar anak, serta ketidakhadiran tergugat dalam persidangan. Implikasi dari putusan ini tidak hanya memberikan jaminan terhadap kesejahteraan anak, tetapi juga memberikan preseden penting dalam penegakan hukum hak asuh anak di Indonesia. Penelitian ini memberikan kontribusi terhadap pemahaman dan pengembangan kebijakan terkait hak asuh anak pasca perceraian, yang berfokus pada kepentingan terbaik anak dan kesetaraan hak orang tua.
