Abstract

Background. Bitcoin is the world's first digital currency that uses the concept of Cryptocurrency, which is a digital asset designed as a medium of exchange using cryptographic techniques to secure transactions and control the administration of its currency units that are likely to continue to grow in the future. Based on Law No. 7 of 2011 on Currency or cryptocurrencies, Bitcoin cannot be considered as legal tender in Indonesia. Purpose. It is said to be a means of payment because the means of payment in Indonesia is the Rupiah, but based on the Regulation of the Minister of Trade of the Republic of Indonesia Number 99 of 2019, crypto assets are one of the commodities that can be used as the subject of futures contracts traded on futures exchanges. Method. his research uses a statute approach. In addition, a case approach is also used to find out the ratio decidendi used by the Constitutional Court judges in deciding cases of judicial review of laws related to indigenous peoples. Results. This type of research is normative juridical research. The nature of research in this research is descriptive analytical. The type of data used in this research is library research. The validity of crypto asset transactions based on Indonesian contract law which refers to the Civil Code is valid because it fulfills the terms of the agreement in article 1320 of the Civil Code and is supported by the principles contained in the Civil Code itself, including the principle of freedom of contract, the principle of consensualism, the principle of pacta sunt servanda, and the principle of good faith. Therefore, crypto asset transactions are also legalized according to Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) because crypto asset transactions are carried out online through the internet network. Conclusion. The Indonesian government then compiled several rules to accommodate interests as guidelines and clarity for the public regarding the government's recognition of the existence of bitcoin and virtual currencies, namely through the policy of the Minister of Trade of the Republic of Indonesia Number 99 of 2019, and based on the rules of the Bappebti Regulation Number 5 of 2019 concerning Technical Provisions for the Implementation of the Crypto Asset Physical Market on the Futures Exchange.

Abstract

Enforcement of immigration law violations by cross-border travelers from Papua New Guinea to Indonesia poses a significant challenge for the state authorities, especially in ensuring the security and sovereignty of border areas. These immigration violations are often driven by social, cultural, and economic factors influencing the behavior of border communities. This study aims to analyze the implementation of immigration regulations in border areas and the challenges faced in law enforcement. The findings reveal that infrastructure limitations, human resources, and lack of inter-agency coordination are the main barriers to effective law enforcement.This research employs a qualitative method with a normative legal approach, relying on primary and secondary data obtained through library research. The analytical approach used is descriptive qualitative, classifying legal materials into three main categories: primary, secondary, and tertiary. The results of the study show that despite efforts in surveillance through joint patrols and infrastructure improvements, the effectiveness of law enforcement in the Indonesia-Papua New Guinea border remains limited. Many cross-border travelers still use unofficial routes, and the public's understanding of immigration regulations remains low. This study recommends improving coordination between law enforcement agencies and enhancing legal outreach to border communities

Abstract

This study examines the definition and proof of adultery in Islamic law and Law No. 1 of 2023 from a criminological perspective. It highlights the differences in how these legal frameworks address adultery and their impacts on society’s moral order. The research explores the criminal sanctions provided by Islamic law and compares them with the more lenient approach of the Indonesian legal system under the new criminal code. The study aims to offer a comprehensive analysis of the regulatory and normative aspects of adultery law and its practical implementation. This research employs a qualitative method with a normative legal approach, analyzing regulations and legal norms. Primary and secondary data are used, collected through literature studies, including official documents, legal books, journals, and previous research. The findings indicate that Islamic law’s strict sanctions serve as a strong deterrent against adultery, while Law No. 1 of 2023 adopts a more restorative approach, allowing victims to report offenses. Despite the differences, both legal systems aim to protect social order by upholding moral standards. The research suggests that balancing these legal approaches could help harmonize legal norms and improve their application in Indonesia.

Abstract

This study explores the legal, social, and psychological impacts of delaying the execution of death sentences under the new Indonesian Criminal Code (KUHP). The introduction of a 10-year probationary period for death row inmates has raised legal uncertainties regarding execution timelines and potential changes in sentencing. The research highlights the psychological strain and potential human rights violations that long delays may cause for those awaiting execution, leading to significant concerns within the criminal justice system. Additionally, it examines how this delay influences the integrity of the legal framework in Indonesia. The study uses a qualitative method with a normative legal approach, focusing on analyzing regulations and interpreting legal norms in practice. Data were collected through an in-depth literature review of legal documents and previous studies.The findings indicate that the delay in execution contributes to a lack of certainty in the legal process, which affects both the detainees' mental health and the public’s trust in the justice system. Psychological effects on death row inmates, such as severe distress and mental deterioration, are significant, while the legal impact shows the need for clearer regulations to ensure justice and prevent human rights violations. The study concludes that reforming execution timelines and legal processes is crucial for improving the fairness and effectiveness of the Indonesian criminal justice system.

Abstract

Anak merupakan individu dengan esensi dan kehormatan yang unik, dilindungi oleh berbagai peraturan hukum. Sejumlah regulasi mendefinisikan "anak" berdasarkan usia dan status perkawinan. Internasional memandang perlindungan hak anak melalui Deklarasi Anak 1979 dan Konvensi Hak Anak 1989. Di Indonesia, konstitusi dan undang-undang telah mencoba melindungi hak anak. Akan tetapi, anak jalanan seringkali mengalami kesulitan yang berbeda dengan anak-anak lain, dan memiliki berbagai alasan mengapa mereka berada di jalanan. Anak jalanan juga menghadapi berbagai bentuk kekerasan, membutuhkan penanganan khusus. Penelitian ini berbasis kualitatif dengan kerangka hukum normatif. Data dikumpulkan dari dokumentasi, wawancara, dan observasi. Tujuan penelitian ini adalah untuk mengevaluasi hukum yang ada dan penerapannya. Penelitian ini didominasi oleh kajian literatur, dengan sumber data primer dan sekunder. Meski anak-anak di Indonesia berhak mendapatkan kesejahteraan, anak jalanan sering dilihat sebagai beban. Banyak di antaranya mendapat perlakuan buruk dan terpaksa bekerja di jalanan. Konvensi Hak Anak menekankan empat hak dasar anak. Perlindungan anak adalah tanggung jawab negara dan masyarakat, dijamin oleh UU Perlindungan Anak No. 23 Tahun 2002. Perlindungan anak melibatkan berbagai aspek sosial dan hukum yang harus diterapkan secara menyeluruh. Negara harus memastikan hak anak untuk dilindungi dari diskriminasi, mendapat perawatan, memiliki identitas, dan banyak hak lainnya.

Abstract

Outsourced workers in Indonesia continue to face systemic vulnerabilities, including wage disparities, limited access to social security, and legal uncertainty resulting from fragmented responsibilities between Service User Companies (PPJ) and Manpower Service Providers (PJTK). This study aims to analyze the effectiveness of a joint and several liability model based on proportional responsibility in ensuring holistic protection for outsourced workers. The research employs a normative juridical approach through doctrinal analysis of current labor regulations, particularly the Job Creation Law and its implementing regulations, combined with a systematic literature review on outsourcing implementation challenges. Secondary data consist of statutory regulations, court decisions, and previous normative legal studies. The findings indicate that the joint and several liability model has the potential to integrate the responsibilities of PPJ and PJTK proportionally, thereby closing protection gaps related to workers’ normative rights, including wages, occupational safety and health, and access to legal remedies. This model also enhances legal certainty by allowing workers to pursue claims against both parties collectively. However, its effectiveness remains constrained by regulatory ambiguity, weak government supervision, complex litigation mechanisms, and the risk of moral hazard among manpower providers. Therefore, systemic reforms are required, including regulatory harmonization, strengthened institutional oversight, and clear operational guidelines, to achieve comprehensive protection for outsourced workers.
