Abstract

Personal Data Include d in the Scope of Cyber Law is the law that regulates digital matters, privacy and information security and crimes related to the definition of personal data are not found in laws and regulations. The research objective in this thesis is how the law is regulated. ITE electronic information and transactions against perpetrators of criminal acts of distributing personal data (doxing) on social media as an effort to protect personal rights and how criminal sanctions are against perpetrators of criminal acts of distributing personal data on social media. Using Empirical Normative Legal Research Methods Is an Understanding of Law in the Meaning of Norms and Implementation of Legal Rules in real behavior and is evidence of whether citizens have behaved in accordance with legal provisions or not. The results of the study show that the perpetrators of the crime of spreading personal data on social media are found in law number 19 of 2016 concerning electronic information and transactions and law number 27 of 2022 concerning personal data protection and threats of sanctions against perpetrators of distributing personal data are regulated in Article 67 with a sentence of four years in prison.

Abstract

This study aims to determine whether the application of forced money (dwangsom) in a judge's decision is a coercive legal instrument to ensure voluntary implementation of a civil decision by the losing party. However, in practice, the absence of standard operating procedures and consistent legal considerations from judges in imposing or rejecting dwangsom create legal uncertainty. This study examines the urgency of rational, fair, and proportional legal considerations in every judge's decision related to the application of dwangsom. Normative legal research with a statutory, doctrinal, and case study approach was used. The results of the study indicate that the absence of explicit legislation regulations causes the judge to rely heavily on subjective interpretations, thereby reducing the effectiveness and coercive power of the decision. Therefore, a deep legal understanding and mature legal considerations are needed from judges when imposing dwangsom as a form of legal protection for parties with good intentions. This study also recommends judicial guidelines or regulatory updates to strengthen certainty and fairness in the application of dwangsom in civil courts.

Abstract

The wage disparity between recruited workers and assigned employees who bear equivalent workloads and responsibilities represents a serious issue in industrial relations in Indonesia. Recruitment workers often receive wages below the City Minimum Wage and experience discrimination in the provision of allowances and other normative rights, as occurred in the case of PT. Prima Multi Terminal. In this case, recruitment workers received Merit Salaries below the 2024 Medan City Minimum Wage, as well as unequal position allowances and leave entitlements compared to assigned employees, despite performing the same job functions. This condition contradicts the principle of justice and the principle of non-discrimination as stated in Article 6 of Law Number 13 of 2003 concerning Manpower and the provisions in Government Regulation Number 36 of 2021 in conjunction with Government Regulation Number 51 of 2023 concerning wages. This study aims to analyze the form of legal protection for recruitment workers who experience wage imbalance based on Decision No. 99/Pdt. Sus-PHI/2024/PN Mdn. The research method used was the normative legal method through a literature study approach and juridical analysis of the court decision. The results showed that the court partially granted the lawsuit and ordered the equalization of salaries and allowances. Therefore, the government needs to strengthen regulations, the labor inspection system, and improve legal education for workers.

Abstract

Child adoption is a crucial process in family law, involving the legal acceptance of a non-biologically related child into another family. In Indonesia, adoption safeguards children's rights to a stable family environment, making family law's role pivotal. However, adoption in Indonesia faces challenges like complex procedures, limited information, and bureaucratic delays. This study aims to explore adoption's facets in Indonesia: its legal process, common obstacles, family law's role in safeguarding children's and adoptive parents' rights, and Law Number 23 of 2002's effectiveness in handling adoption cases. Using normative juridical research, this study analyzes secondary data from regulations and literature. Findings reveal the adoption process's intricacies, highlighting issues with legal compliance, children's rights protection, and adoptive parents' responsibilities. Courts play a vital role in ensuring legal certainty for adopted children. Adoption not only involves legal aspects but also emotional challenges for the adopted child. This research enhances understanding of Indonesian adoption and informs better family law policies and practices, aiming to improve adopted children's and adopting families' welfare and protection
