Abstract

Barang inventaris pemerintah merupakan aset yang dimiliki dan dikelola oleh pemerintah, yang digunakan dalam penyelenggaraan fungsi dan tugas pemerintahan. Metode lelang non eksekusi wajib dipilih dalam situasi tertentu untuk menghindari komplikasi yang dapat muncul dari eksekusi langsung, seperti ketika aset yang dihapuskan memiliki nilai sejarah atau kultural yang signifikan, atau ketika eksekusi langsung dapat memicu pertentangan sosial. Penelitian ini bertujuan untuk mengevaluasi prosedur lelang non eksekusi wajib yang digunakan dalam penghapusan barang inventaris pemerintah. Penelitian ini menggunakan metode penelitian yuridis normatif yang mencakup pendekatan perbandingan, pendekatan konseptual, dan pendekatan perundang-undangan. Penelitian ini mengandalkan sumber data sekunder. Data dianalisis secara deskriptif dan kualitatif. Penerapan efektif kerangka hukum ini memungkinkan pemerintah mengelola aset negara dengan efisien, melindungi kepentingan masyarakat, dan memaksimalkan nilai aset untuk kepentingan seluruh rakyat Indonesia, dengan evaluasi dan perbaikan terus-menerus untuk memastikan kepatuhan terhadap prinsip-prinsip transparansi, akuntabilitas, dan keadilan.

Abstract

Policies and legal norms regarding land acquisition in Indonesia are generally regulated in Law (UU) no. 2 of 2012 concerning Land Acquisition for Development in the Public Interest. Development policies and projects, such as infrastructure, industrial zones, or public facilities, often require significant space that can only be obtained through land acquisition. This research aims to comprehensively review the legal dimensions related to land acquisition, focusing on the rights concerned, applicable regulations, and the need for reform to ensure a fair and sustainable process. This research uses normative juridical research methods, with comparative, conceptual and statutory approaches. These data were analyzed descriptively and qualitatively. The results of this research show that land acquisition in Indonesia is regulated by various laws, including the Job Creation Omnibus Law and Government Regulation no. 19/2021. The land acquisition process involves stages of planning, preparation, implementation and delivery of results, involving many government agencies. Policy and regulatory reform in land acquisition is essential to address gaps and deficiencies in the existing system, with particular emphasis on protecting community rights, promoting transparency, and ensuring accountability. Increasing equity in land acquisition involves strategies to ensure impartiality, transparency and protection of the interests of all stakeholders.

Abstract

Bank loans play a vital role in supporting economic activities in Indonesia. One important instrument in managing credit risk is a personal guarantee, which involves a third party or the debtor himself to guarantee repayment of the loan in the event of default. This study analyzes the legal position of personal guarantees in the structure of bank credit agreements in Indonesia, identifying the effectiveness and risks associated with the use of personal guarantees. The normative juridical research method is used to explore conceptual and statutory approaches, and compare practices in the field. The results show that although personal guarantees provide an additional layer of security for banks, their utilization must be followed by an in-depth assessment of the guarantor's financial condition and the legal agreement made. Strict regulations and the application of prudential principles by banks are important to ensure that personal guarantees are effective in reducing credit risk, while supporting sustainable economic growth.
