Abstract

Law No.4 of 1996 is the mandate of Article 51 of Law No. 5 of 1960, which regulates the only institution security rights over the landknown as Mortgage. The law completes the realization of law unification in the field of national land management .The existance of the law bring fresh air for business development in Indonesia. Land and buildings located on it can be used as collateral either by the individual or legal berau. As it can raise fund sasinitial capitalin doing business (business activity) to sustain the economy and national development.

Abstract

Perempuan dan laki laki  memiliki derajat yang sama sebagai pemegang hak atas tanah baik kapasitasnya sebagai isteri ataupun suami. Keduanya mempunyai kapasitas melakukan perbuatan hukum terhadap hak atas tanahnya. Sebelum lahirnya UU no 1 Tahun 1974, perempuan dianggap tidak cakap dalam melakukan perbuatan hukum dan suamilah yang dianggap patut melakukan perbuatan hukum. Sejak diberlakukannya UU 1 Tahun 1974 tentang Perkawinan dan UU No. 5 Tahun 1960 tentang Ketentuan Dasar Pokok Pokok Agraria, maka baik perempuan maupun laki laki memiliki kedudukan yang sama dalam melakukan perbuatan hukum. Artinya, apabila dalam perolehan,  peralihan dan pembebanan harta bersama  suami hanya satu yang melakukan tindakan hukum, maka yang lain wajib memberikan persetujuan.

Abstract

Indonesia still has a very crucial problem, the problem is human trafficking. This study is aimed at identifying and analyzing legal protection for Indonesian workers who work in the Middle East against crimes of trafficking in persons based on national law and international law as well as the application of sanctions given to perpetrators. The research method in this article is juridical normative using a statute approach and a conceptual approach. The results of this study are a form of protection for migrant workers, there are several international regulations, one of which is CEDAW. Meanwhile, the government's efforts in legal protection for TKI victims of human trafficking are by issuing various legal instruments, one of which is the UU PTPPO (Pemberantasan Tindak Pidana Perdagangan Orang). From this research, it can be concluded that the government needs to collaborate bilaterally, as well as multilaterally, especially the destination countries for placing Indonesian migrant workers, and cooperate with non-governmental organizations in combating human trafficking.

Abstract

Explores the concept of "fictitious positive" in the context of Indonesian administrative law, focusing on its application in public administration and licensing processes. The term refers to situations where public administration authorities fail to provide timely responses or services to citizen requests. The principle of positive fiction is enshrined in Article 53 of Law Number 30 of 2014, which sets time limits for government officials to make decisions and take actions. If the specified time limits are not met, the application is considered accepted. The State Administrative Court plays a role in adjudicating fictitious positive applications. However, recent regulatory changes introduced by the Job Creation Law have altered the process, shifting the authority to the executive branch. This abstract also examines the implementation of positive fictitious decisions in the context of the One Stop Integrated Service and the Electronic Integrated Business Licensing Service, aimed at simplifying licensing procedures and enhancing service quality. The abstract concludes by discussing the challenges and uncertainties associated with the application of positive fictitious principles in Indonesian administrative law and highlights the need for further regulations and clarity to ensure legal certainty and effective governance.

Abstract

Penelitian ini secara fundamental menggali konsep keberlanjutan dalam konteks multidimensional yang meliputi dimensi lingkungan, ekonomi, dan sosial. Keberlanjutan adalah paradigma yang mendasari pemeliharaan sumber daya alam dan lingkungan hidup untuk memenuhi kebutuhan generasi saat ini tanpa mengorbankan kemampuan generasi mendatang untuk memenuhi kebutuhan mereka. Aspek lingkungan mengharuskan perlunya manajemen yang bijak terhadap sumber daya alam yang terbatas, termasuk pelestarian ekosistem, air bersih, kualitas udara, dan biodiversitas. Sementara itu, dimensi ekonomi mempertimbangkan pertumbuhan ekonomi yang berkelanjutan, di mana pertumbuhan tersebut harus dipertimbangkan dalam konteks penggunaan yang bertanggung jawab terhadap sumber daya alam dan distribusi yang adil. Fokus juga diberikan pada dimensi sosial, yang menyoroti inklusi, kesetaraan, dan keadilan dalam akses terhadap sumber daya dan manfaat dari pembangunan berkelanjutan. Melalui pemahaman yang lebih mendalam dan penerapan konsep keberlanjutan dalam konteks penelitian ini, diharapkan dapat memberikan kontribusi pada perwujudan masyarakat yang lebih seimbang, adil, dan berkelanjutan bagi generasi masa kini dan yang akan datang.

Abstract

Indonesia merupakan rumah bagi berbagai sumber daya alam dan biota laut. Luas perairannya lebih besar dari luas daratannya. Karena kurangnya pengawasan, bisnis penangkapan ikan negara tetangga terlibat dalam penangkapan ikan ilegal yang ekstensif, yang menyebabkan kerugian negara. Yang lebih mengejutkan lagi adalah ancaman terhadap harga ikan nelayan lokal yang ditimbulkan oleh kembalinya hasil tangkapan illegal fishing ke negara asal mereka dan re-ekspor murah ke Indonesia. Indonesia memiliki tanggung jawab untuk mempertahankan rakyat dan tanah airnya sebagai negara yang berdaulat dan merdeka. Alhasil, Negara menegaskan dengan mematuhi UU Perikanan Nomor 45 Tahun 2009, Peraturan Menteri Nomor 2 Tahun 2015 Tentang Penggunaan Kapal Pukat Harimau, serta sejumlah  undang-undang lainnya, peraturan pemerintah, dan keputusan presiden sebagai upaya untuk menempatkan pemberantasan illegal fishing di Indonesia. Selain itu, berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Deklarasi Djuanda Tahun 1957, UNCLOS III tahun 1982 tentang gagasan negara kepulauan Indonesia, dan Zona Ekonomi Eksklusif mengambil tindakan hukum terhadap illegal fishing dengan cara menenggelamkan dan membakar kapal. . Dokumen-dokumen ini semua terkait dengan kedaulatan nasional. Karena sesuai dengan hukum domestik dan internasional, tindakan pemerintah tersebut bukan merupakan pelanggaran hukum.

Abstract

Land is a security item for debt repayment that is most preferred by financial institutions that provide credit facilities, basically land is easy to sell, besides that the price for the land continues to increase and has a basis of rights which is the basis of proof of ownership of the land, and is difficult to engineer. So the Government created a program called Home Ownership Credit (KPR) which aims to make it easier for citizens to get a livable house. This research is a normative juridical research that is descriptive, which describes and analyzes systematically, factually, and accurately related to receivables in credit agreements that have been transferred. This research is a normative juridical research using a statutory approach and a case approach. The results of the author's research show that the power of SKMHT as the ownership of dependent rights made by Notaries does not meet the provisions stipulated in the UUJN, the legal consequence is that the power of proof becomes under hand. Thus, the creditor must make APHT and issue a Certificate of Liability so that the creditor gets his preferred rights in the Right to Dependent. But if it only makes SKMHT and does not make APHT, then to carry out execution parate, SKMHT has no binding legal force. As well as the application of the principle of good faith to the process of transferring receivables to third parties which is a solution to unlawful acts, namely that in this case if the creditor applies the principle of good faith and is committed in the agreement, then the sale of the object of the Right of Liability can be carried out under the lower hand if thus it will be able to obtain the highest price that benefits all parties and/or give priority to the debtor to be the buyer.

Abstract

This research discusses the legal protection for buyers in the context of land mafia crimes related to the making of a sale and purchase deed. Land mafia crimes have become a serious threat to property transactions, especially when involved in the creation of sale and purchase deeds. The purpose of this research is to analyze the legal protection available for buyers in dealing with land mafia crimes. This research uses the normative legal research methods by analyzing laws and regulations relating to property transactions and legal protection for buyers. The results showed that legal protection for buyers can be found in several legal instruments, such as the Basic Agrarian Law, the Law on Land Rights Guarantees, and the Law on Provincial Regulations on Spatial Planning. However, there are several challenges faced by buyers in protecting their rights related to property purchases. Land mafia crimes often involve complex practices and deception that are difficult to detect. In addition, vulnerabilities in the sale and purchase deed process and weak law enforcement are obstacles in providing effective protection for buyers. In this research, improvements are recommended in the legal system related to property transactions to provide stronger protection for buyers. Awareness-raising and education effort for the public are also important to prevent property deception and land mafia crimes. In addition, it needs to be close cooperation between the authorities, financial institutions and the public to tackle this problem. In conclusion, the legal protection for buyers in the context of land mafia crimes in making of sale and purchase deeds still requires serious attention. Improvement of law and regulations, increasing public awareness, and cooperation between institutions can help strengthen legal protection for property buyer.

Abstract

This study aims to analyze the validity of the underhand exchange agreement based on a case study of court decision number 21/Pdt.G/2020/PN BLK. The method used in this study is qualitative with a juridical-normative approach. Data were obtained through in-depth interviews with legal experts and practitioners, as well as document studies of court decisions and relevant legal literature. The analysis was carried out using content analysis and juridical analysis techniques to identify and assess the legal aspects of the underhand exchange agreement and its application in court decisions.The results of the study indicate that the validity of the underhand exchange agreement is greatly influenced by the fulfillment of the requirements for the validity of the agreement according to civil law in Indonesia. The court decision in this case underlines the importance of the elements of agreement and good faith between the parties in ensuring the validity of the agreement. This study also found that although underhand agreements are often considered more vulnerable to legal disputes, court decisions provide important guidance on how such agreements can be legally recognized and enforced.This research contributes to the development of contract law theory, particularly regarding underhand agreements, and provides recommendations for legal practitioners in drafting and handling legally valid exchange agreements.

Abstract

The land mafia is a serious threat to the sustainability of the land registration system and the legality of land ownership in Indonesia. One group that plays an important role in the process of making land deeds is the Land Deed Making Officer (PPAT). Therefore, legal protection for PPAT is very important to prevent land mafia crimes in making land deeds. This study aims to analyze how the legal protection for PPAT from land mafia crimes in making land deeds based on Government Regulation No. 37 of 1998. The research method used is qualitative research with a literature study approach. Data were analyzed using a descriptive-analytical approach. The results of the research show that existing regulations, especially Government Regulation Number 37 of 1998, provide a strong legal basis for PPATs in carrying out their duties in making land deeds. This regulation regulates the obligations, responsibilities and authorities of PPATs in carrying out their duties, as well as providing sanctions for PPATs who commit violations. However, the challenges faced in implementing these regulations were also encountered in this study. Some of the challenges faced include the lack of oversight of PPATs, low public legal literacy, and vulnerability to influence from the land mafia. In addition, legal practice and the role of the courts in providing legal protection for PPATs are still facing obstacles such as lengthy and complex legal processes, and the lack of effective sanctions against perpetrators of land mafia crimes. In maintaining the integrity and legality of land deeds made by PPAT, a synergy between regulations, legal practice and the courts is needed. Efforts to strengthen oversight of PPATs, increase public legal literacy, and increase the effectiveness of sanctions against land mafia perpetrators need serious attention. In addition, the role of the court in providing fair and prompt decisions in cases involving land mafia crimes is also important for enforcing the law and providing effective legal protection for PPATs and the public in making land deeds.
