Abstract

Kerja sama antara Notaris dengan konsultan hukum yang pada hakekatnya bertindak sebagai perantara untuk mencari atau mendapatkan klien dilarang didalam Pasal 4 ayat (4) Kode Etik Notaris. Kerja sama antara Notaris dengan konsultan hukum ini kian marak beberapa tahun ke belakang, karena Pemerintah sedang berupaya untuk memulihkan keadaan ekonomi negara setelah pandemi dengan cara mempermudah legalitas dan perizinan berusaha agar masyarakat dapat melakukan kegiatan berusaha. Banyak konsultan hukum yang secara terang-terangan melakukan promosi di media sosial terhadap beberapa produk berupa akta Notaris seperti pendirian PT, CV dan Yayasan. Pengawasan Notaris dilakukan oleh Menteri Hukum dan Hak Asasi Manusia dan untuk pelaksanaannya Menteri membentuk Majelis Pengawas Notaris. Majelis Pengawas Notaris merupakan suatu badan yang mempunyai kewenangan dan kewajiban terhadap pembinaan dan pengawasan terhadap Notaris. Majelis Pengawas Notaris ini terdiri dari Majelis Pengawas Daerah (MPD) untuk setiap Kabupaten/Kota, Majelis Pengawas Wilayah (MPW) untuk setiap Provinsi dan Majelis Pengawas Pusat yang terletak di Ibukota Negara, Metode penelitian dilakukan secara yuridis normatif, dengan data sekunder sebagai data utama dengan didukung data primer. Disimpulkan bahwa pengawasan yang dilakukan oleh Majelis Pengawas Notaris masih bergantung kepada laporan masyarakat,

Abstract

Pemanfaatan internet atau media elektronik telah menjadi bagian terpenting dalam hal meningkatkan suatu kinerja baik di bidang instansi pemerintahan maupun berbagai profesi lainnya. Salah satu profesi yang dikenal di masyarakat adalah profesi Notaris, Notaris sebagai pejabat umum bertugas untuk memberikan pelayanan kepada anggota masyarakat yang memerlukan jasanya dalam pembuatan alat bukti tertulis, khususnya berupa akta Autentik dalam bidang hukum perdata seperti pembuatan akta Jual beli, akta Pendirian Perseroan Terbatas, akta jaminan Fidusia, akta Keterangan Hak Waris, akta Wasiat, akta perjanjian Kerjasama dan lain-lain, Keberadaan notaris merupakan pelaksanaan dari hukum pembuktian. Penelitian ini mengkaji pelayanan Notaris secara elektronik dilihat dari implementasi, pengaturan dan kepastian hukumnya sebagai perwujudan dari konsep Cyber Notary dan E-Notary. Melalui pendekatan Yuridis normatif dengan metode deskriptif analitis ditemukan bahwa dari segi substansi, struktur dan kultur Indonesia masih memerlukan berbagai macam penyesuaian, pembaharuan maupun strategi kolaboratif untuk membentuk suatu harmonisasi dari aspek regulasi, dukungan dari insrastruktur teknologi dan sumber daya manusia serta kepercayaan terhadap jabatan notaris sendiri. Hal tersebut perlu adanya suatu pembenahan- pembenahan terkait dengan Harmonisasi subtansi dalam peraturan terkait jabatan Notaris serta sarana dan prasarana pendukung. Kata kunci: Pelayanan Notaris, Cyber Notary dan E-Notary

Abstract

This research aims to examine the implementation of the principle of notary accuracy as an effort to avoid the practice of making nominee agreements regarding the transfer of land ownership rights to foreign citizens along with the legal consequences for notaries who ignore the principle of equality with those making deeds based on these agreements.The research method used is normative juridical by examining library materials or secondary data, including legal principles, legal systematics, research on levels of vertical and horizontal synchronization, and legal comparisons. This research uses an applicable legislative approach linked to legal theories and practices relating to legal issues with analytical descriptive research specifications and qualitative juridical data analysis methods.Based on the results of the research, it can be concluded that the refusal to make a deed based on a nominee agreement regarding the transfer of ownership rights to land to a foreign citizen is part of the implementation of the principle of notarial accuracy considering that the deed violates the objective requirements in the form of a halal cause in the terms of the validity of the agreement in Article 1320 of the Civil Code and results in a deed declared null and void by law. Cancellation of an act of nominee agreement provides a legal basis for imposing civil sanctions on the Notary, which may include payment of fees, compensation and interest. By considering the impact, Notaries should carry out their duties carefully, professionally, prioritizing integrity and good morals.

Abstract

The legal relationship of Land Sale and Purchase in relation to land acquisition for public purposes, and the role and responsibilities undertaken by a Notary Public or Public Official, become highly significant. This is because the Notary Public bears the responsibility to ensure that the land being bought and sold is transferred in accordance with the prevailing legal regulations. This study aims to determine the Accountability of the Notary Public or Public Official regarding the implementation of Land Sale and Purchase that has a designated Land Acquisition location, and the Legal Certainty Aspect of Authentic Deeds from Land Sale and Purchase Created by the Notary Public or Public Official in relation to Land Sale and Purchase that has a designated Land Acquisition location. The research method employed is normative juridical, focusing on literature review, particularly analyzing the applicable legal provisions. The research is descriptive-analytical in nature, aiming to comprehensively depict the state of an object in a systematic manner. The research is carried out in two stages: Field Research and Library Research, with the goal of obtaining primary, secondary, and tertiary legal sources. The research findings indicate that the sale and purchase of land rights by a Public Official, who oversees the transfer process of an object designated as land for development for public purposes, results in the improper receipt of compensation costs by the wrong party. In this regard, the Notary Public or Public Official, in carrying out their duties, must adhere to legal regulations, exercise prudence, and avoid favoring any party in order to prevent any party from being disadvantaged in the process of transferring land rights that they have executed
