Abstract

Artikel ini bertujuan untuk mendalami penegakan hukum atas hak-hak anak yang dilahirkan hasil dari tindak pidana perkosaan. Artikel ini merupakan penelitian kualitatif dengan metode normatif yuridis. Berdasarkan hasil penelitian, saat ini, banyak wanita yang menjadi korban perkosaan terpaksa melanjutkan kehamilan mereka yang tidak diinginkan karena mereka tidak menyadari bahwa mereka hamil akibat perkosaan. Di sisi lain, banyak wanita melakukan aborsi karena mereka menjadi korban perkosaan. Berdasarkan UU Perlindungan Anak, UU Kesehatan dan PP No. 61 Tahun 2014, didapati bahwa penerapan kebijakan mengenai aborsi untuk korban perkosaan tidak memberikan perlindungan hukum yang efektif bagi korban tersebut, termasuk bagi anak yang dikandungnya. Penyebabnya adalah karena berdasarkan data kehamilan akibat perkosaan yang diperoleh, para korban perkosaan telah melewati batas waktu yang ditetapkan oleh hukum untuk melakukan aborsi. Selain itu, masih belum ada ketentuan yang secara tegas mengatur perlindungan hukum bagi anak yang lahir akibat tindak pidana perkosaan. Hukum tentang diskriminalisasi aborsi di Indonesia dipandang tidak adil dan tidak seimbang dalam melindungi hak-hak perempuan, terutama dalam kasus kehamilan akibat tindak pidana perkosaan. Artikel ini bertujuan untuk berkontribusi menegakkan hukum dengan berharap adanya rekonstruksi kebijakan hukum demi memberi perlindungan hukum yang berkeadilan sosial bagi anak hasil dari tindak pidana perkosaan. Hasil dari penelitian ini adalah bahwa diperlukan adanya kepastian hukum atas perlindungan hukum anak terhadap anak hasil dari tindak pidana perkosaan. Serta perlindungan hukum anak terhadap anak hasil dari tindak pidana perkosaan yang berkeadilan berdasarkan persperktif viktimologi.

Abstract

After the issuance of Law Number 11 of 2020 concerning Job Creation, there are several important clusters that need to be considered, one of which is the ease of doing business which is closely related to government administration. Therefore, a system was created by the government to facilitate and legalize business actors in running their businesses in the form of a Business Identification Number (NIB). Because this NIB is a new system and is likely not widely understood by business actors, including MSMEs, it is necessary to socialize it and then provide assistance. Assistance in applying for NIB through the Online Single Submission-Risk Based Approach (OSS-RBA) System by MSMEs is an important step in managing the legality of their businesses. NIB is an identity for business actors that provides access to various facilities and legal protection. The OSS-RBA system is designed to facilitate the licensing process with a risk-based approach, where types of businesses are classified based on their risk levels. The method used in community service under this title is in the form of Socialization/Counseling and Assistance for MSMEs in submitting NIB to the OSS-RBA system. Socialization or counseling is carried out in the form of lectures and Q&A discussions so as to provide a comprehensive understanding. This assistance is carried out by academics/lecturers of the Law Study Program, Veteran Bangun Nusantara University, Sukoharjo Together with the Sukoharjo regional government, in this case represented by the Sukoharjo PMD Chamber of Commerce to ensure that MSME actors understand the procedures that must be followed and can submit NIB correctly. The assistance process includes socialization, consultation and assistance in filling in data in the OSS-RBA system. The goal is to increase the number of registered and legal MSMEs in Indonesia, so that they can access various government programs and get better legal protection.

Abstract

Digitalization has significantly transformed various aspects of life, including expanding women's freedom of expression in cyberspace. However, it also brings challenges such as online gender-based violence (OGBV), cyber harassment, and violations of women's human rights. This article analyzes the intersection of women, digitalization, and freedom of expression from a legal perspective, focusing on national and international legal protections. The discussion includes women's human rights in the digital age, the balance between freedom and legal limitations, and the impact of digitalization on these rights. It also examines regulatory frameworks related to freedom of expression and the challenges women face in cyberspace, particularly regarding OGBV and the effectiveness of law enforcement. Through case analysis, this study evaluates whether current laws adequately protect women online. The article proposes policy reform, emphasizing the roles of government, digital platforms, and civil society in fostering a safer, more inclusive digital space. Key recommendations include revising the Electronic Information and Transactions Law and strengthening the Sexual Violence Crime Law. A collaborative, multidisciplinary approach is essential to uphold women's freedom of expression while ensuring their safety and rights in the digital era.
