Abstract

Salah-satu tujuan penting didirikannya Halal Centre di Universitas Trunojoyo Madura ialah untuk mengusahakan terciptanya pola kehidupan masyarakat yang bergaya hidup halal. Salah-satu upaya untuk mencapai hal itu ialah dengan cara menjalin Kerjasama kelembagaan dengan pondok pesantren di Madura. Persoalan penting yang ingin dijawab dalam penelitian ini ialah terkait peran strategis kiai pesantren dalam upaya mendukung pelaksanaan gaya hidup halal di Madura melalui kerjasama dengan lembaga perguruan tinggi. Penelitian ini menggunakan metode penelitian hukum empiris dengan metode pendekatan yuridis sosiologis dan legal antropologis. Hasil dan pembahasan dalam penelitian ini ialah bahwa faktor strategisnya peran kiai pesantren dalam kehidupan sosial masyarakat Madura disebabkan oleh ajaran tradisi, budaya, dan agama yang sama-sama memposisikan figur guru sebagai panutan dalam melaksanakan kehidupan di dunia. Strategisnya figur kiai ini nantinya akan dimanfaatkan untuk menciptakan tatanan kehidupan masyarakat yang bergaya hidup halal melalui optimalisasi peran kiai pesantren, dengan cara menggencarkan gerakan pendidikan gaya hidup halal, baik Gerakan yang sifatnya internal ataupun eksternal. (One of the important goals of establishing the Halal Center at Trunojoyo University, Madura, is to strive to create a pattern of community life that has a halal lifestyle. One of the efforts to achieve this is by establishing institutional partnerships with Islamic boarding schools in Madura. An important issue to be answered in this study is related to the strategic role of Islamic boarding schools in an effort to support the implementation of a halal lifestyle in Madura through collaboration with higher education institutions. This study uses an empirical legal research method with a sociological juridical and anthropological legal approach. The results and discussion in this study is that the strategic factor of the role of kiai pesantren in the social life of the Madurese community is due to the teachings of tradition, culture and religion which both position the teacher figure as a role model in carrying out life in the world. Strategically, this kiai figure will later be used to create a community life order that has a halal lifestyle through optimizing the role of the Islamic boarding school kiai, by intensifying the halal lifestyle education movement, both internal and external movements.)

Abstract

The TNI as a means of defense of the Unitary State of the Republic of Indonesia has a noble task. Even though it has a noble task, the TNI is still the same as society in general which has the possibility of committing criminal acts. In practice, TNI who commit criminal acts will be investigated and tried in a Military Court. It turns out that several laws and regulations relating to the authority of the Military Court contain conflicts between one law and another law. The authority to examine and adjudicate courts within the Military justice environment in resolving general crimes committed by the TNI as stated in Article 3 paragraph (4a) of MPR Decree Number VII/MPR/2000 jo. Article 65 Paragraph (2) of Law of the Republic of Indonesia Number 34 of 2004 concerning the Indonesian National Army is apparently different from the authority of military justice contained in Law no. 31 of 1997 regarding Military Justice. In order to answer this question, research was conducted, as well as to provide an explanation regarding the resolution of general crimes committed by the TNI. This research is normative research, using a statutory approach and a conceptual approach. The research results found that the resolution of general crimes committed by the TNI was still carried out in the Military Court, referring to the legal principle of lex specialis derogate legi generali. The resolution of general crimes committed by the TNI is carried out through legal trials, consisting of the stages of investigation, prosecution, examination and proof, and the execution stage.

Abstract

Legal issues regarding the unfairness of state policies in regulating salt prices need to be resolved, especially regarding the preparation of salt price regulations that favour the people's interests. The salt price policy should bring benefits to the people and not merely benefit the salt middlemen. This research contributes to reforming equitable regulations where the benchmarks are based on the theory of justice according to Farid Escak's theory. This research uses normative legal research methods by basing the argumentation on salt regulations and the concept of justice in Farid Escak's theory. The research produces essential findings in the form of a national salt price policy that does not bring benefits to farmers, but the policy favours the interests of middlemen and parties in the industrial sector (companies). In addition, the framework of policy regulation on equitable salt prices in Farid Escak's perspective produces ideas in the form of determining the price of salt must be in accordance with the needs of salt farmers and more oriented towards the welfare of farmers. This research recommends the need for the renewal of salt regulations to create justice in the determination of national salt prices.

Abstract

Social work punishment is one of the non-imprisonment alternative punishment threats accommodated in Article 85 paragraph (8) of Law Number 1 Year 2023 on the New Criminal Code (KUHP). This provision creates changes in the punishment system in Indonesia. The purpose of the criminal sanction of social work is to provide guidance and mentoring in order to become a good and useful person, especially since the punishment is not intended to degrade human dignity. However, efforts to realize this goal must be carried out through a clear and precise mechanism for the implementation of social work punishment, but the New Criminal Code has not clearly established the mechanism or institution responsible for the implementation of social work punishment. On this basis, this study aims to analyze the ratio legis (purpose) of the regulation of social work punishment in the New Criminal Code and recommend the concept of ideal implementation supervision arrangement in the future. This type of research is normative and the results conclude: First, social work punishment is regulated due to the occurrence of over capacity and is considered ineffective as a coaching space. Second, the ideal concept of the implementation of social work punishment to support the purpose of punishment is not only sufficiently carried out by law enforcement officials and/or Correctional Institutions, but the involvement of social institutions and other institutions will provide a more optimal correctional influence.
