Harus diakui bahwa perkembangan hak dan kebebasan beragama di Indonesia mengalami berbagai masalah, baik secara substansi pengaturan maupun penegakannya. Ini dibuktikan dengan semakin maraknya aksi-aksi kekerasan berbasis agama di berbagai wilayah di Indonesia. Beragam aksi tersebut nyatanya bertentangan dengan jaminan terhadap hak dan kebebasan yang diatur oleh beberapa aturan positif Indonesia. Guna memperbaiki segala persoalan di atas, tidak ada salahnya jika dalam perumusan pengaturan hak dan kebebasan beragama berkiblat pada aturan hukum yang diberlakukan pada zaman Majapahit, mengingat selain terdapat kesamaan kultur, kerajaan tersebut telah teruji reputasinya sebagai negeri yang plural.

Pemisahan agama dan kepercayaan dalam konstitusi adalah suatu kebijakan yang menimbulkan beragam permasalahan. Seringkali para penghayat kepercayaan mengalami intimidasi ataupun hal-hal lain yang mengganggu pelaksanaan hak sipilnya untuk menganut dan mengamalkan ajaran kepercayaan yang dianutnya. Dengan dalih kepercayaan bukan agama, para pelaku anarkisme seringkali melakukan pelarangan dan kekerasan terhadap para penganut kepercayaan. Kajian ini menggunakan metode penelitian hukum normatif. Sedangkan hasil penelitiannya ialah bahwa 1) Alasan hukum pemisahan pengaturan antara agama dengan aliran kepercayaan disebabkan oleh politik pembedaan pendefinisian keduanya dimana kepercayaan diamsusikan sebagai tradisi dan ajaran luhur masyarakat yang bersumber dari budaya yang keberadaannya di luar agama. 2) Pemisahan agama dan kepercayaan berakibat hukum tidak diakuinya aliran kepercayaan sebagai agama resmi negara, padahal status aliran kepercayaan merupakan agama lokal yang diyakini sebagai agama oleh para penganutnya. Pemisahan ini juga mengakibatkan hadirnya beragam sikap diskriminatif yang berpotensi mengganggu dan merampas hak setiap warga negara dalam meyakini suatu agama, dalam hal ini hak beragama yang diganggu dan dirampas ialah hak untuk meyakini agama lokal sebagai agama warisan leluhur bangsa Indonesia. The separation of religion and indigenous religion in the constitution is a policy that causes various problems. Often the beliefs of the indigenous religion are intimidating or other things that interfere with the exercise of civil rights to embrace and put into practice the beliefs embraced. Under the pretext of non-religious convictions, the perpetrators of anarchism often make prohibitions and violence against believers. This research uses normative legal methods. The results of the research are: The first, the legal reason for the separation of rules between religion and indigeneous religion is caused by the politics of defining both of them in which beliefs are interpreted as traditions and noble teachings of society originating from cultures which are outside of religion; The second, that the separation of religion and indigenous religion that is caused in the law does not recognize the indigenous religion as the official religion of the state, while the status of the indigenous religion is a local religion that is considered as a religion by his believers. This separation also makes several of discriminatory attitudes come up to have potency in disrupting and robbing every citizen’s right to believe in a religion. In this case, the right which is bullied is the right to believe in local religion as the religion of the Indonesian ancestral heritage.
Bhag-Rembhag Sabhala’an as a Method of Resolving Religious Conflicts in the Madura Legal Tradition

Religion-based conflicts often occur in various regions, including Madura. However, there is an interesting conflict resolution, namely through the bhag-rembhag sabhala'an tradition. This research aims to determine the mechanism for resolving religious-based conflicts based on local wisdom through bhag-rembhag sabhala'an which is practiced in Madura. This research uses empirical legal research methods with socio-legal and anthropo-legal approaches, which result in the discussion that: First, the resolution of religious conflicts in the context of national law only focuses on efforts to give verdicts of heresy and guilt to parties who, by the religious majority community, are considered contrary to the understanding of the majority of religious believers, not on efforts to open dialogue and find ways of peace between conflicting communities. Second, the resolution of religious conflicts with the bhag-rembhag sabhala'an emphasises efforts to open dialogue between conflicting adherents by utilising local village figures to find a peaceful way and find a variety of similarities amid striking differences caused by the outbreak of religious conflict. Bhag-rembhag Sabhala'an has long been practised in Madura in the event of differences in understanding and religious conflicts, where humanist and peaceful approaches are preferred over violent ways of resolving conflicts. The real contribution of this research is that the mechanism for resolving religious conflicts based on local wisdom can be the primary choice for parties in resolving religious conflicts. This method prioritises peaceful solutions and respect for religious differences.

The re-examination of the Job Creation Law in 2023 highlights a serious issue in the national legislative system, specifically the follow-up to the Constitutional Court’s (MK) decisions in judicial review cases (PUU) concerning the Omnibus Law. The urgency of this research stems from the high demand among lawmakers for drafting laws in the omnibus format and the potential for judicial review of such laws. This research contributes to addressing the follow-up to the Constitutional Court’s decisions by focusing on the choice of legislative forms as a response to these rulings. The research employs normative legal methods with conceptual, legislative, and case-based approaches. The findings emphasize the need to standardise the type of regulation to ensure the executability of the Constitutional Court’s decisions. The ideal regulatory form for implementing the Court’s rulings on the Omnibus Law is a law. Therefore, it is necessary to legitimise the use of laws as the standard form of follow-up to the Constitutional Court’s decisions on the Omnibus Law to maximise the executability of these rulings.

Tajul Muluk and 274 former Shia have not been able to return to their hometowns in Sampang District, even though they have pledged repentance to return to Sunni teachings on November 5, 2020. The formulated research problems consisted of: first, what was the position of former Shia adherents in Sampang District based on the perspective of rights and freedom of religion in Indonesia? And second, what was the form of violation of the right to freedom of religion in the case of community rejection of former Shia in Sampang District? This research utilizes empirical legal research methods combined with sociological and anthropological approaches. The research results concluded: First, the existence of former Shia adherents as refugees should be treated as a violation of the constitutional mandate of Indonesia which forbids acts of violence and violations of religious rights and freedoms, of all Indonesian citizens. Second that they were accused of embracing a deviant religious sect, is evidence to their religious minority status; and third the expulsion of the former Shia adherents was a violation of the right to freedom of religion. which had been regulated in the constitution, laws, and regulations under the constitution and the spirit of the Indonesian nation.

Penelitian mengkaji tentang kerugian hak konstitusional perpanjangan masa jabatan pimpinan komisi pemberantasan korupsi. Tujuan penelitian untuk menganalisis kerugian hak konstitusional perpanjangan masa jabatan pimpinan komisi pemberantasan korupsi. Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian mengungkapkan bahwa Kerugian Konstitusional (Constitutional Injury) adalah kerugian yang dialami oleh pemohon pengujian materil Undang-Undang atas berlakunya Undang-Undang. Putusan Mahkamah Konstitusi Nomor 112/PUU-XX/2022 yang diajukan oleh pemohon bukanlah bagian dari kerugian konstitusional hak warga negara. Karena pemohon tidak ada potensi untuk dirugikan oleh Undang-Undang dan pemohon dapat mengajukan diri dan dipilih kembali sebagai pimpinan KPK pada periode selanjutnya selanutnya, perlakuan yang tidak adil, yang diajukan oleh pemohon tidak selalu berarti jumlah dan bagian yang sama, dapat memahami keadilan proporsional, yang membagi jumlah dan porsi sesuai dengan bagaimana hal yang bersangkutan dapat berfungsi lebih baik

Salah-satu tujuan penting didirikannya Halal Centre di Universitas Trunojoyo Madura ialah untuk mengusahakan terciptanya pola kehidupan masyarakat yang bergaya hidup halal. Salah-satu upaya untuk mencapai hal itu ialah dengan cara menjalin Kerjasama kelembagaan dengan pondok pesantren di Madura. Persoalan penting yang ingin dijawab dalam penelitian ini ialah terkait peran strategis kiai pesantren dalam upaya mendukung pelaksanaan gaya hidup halal di Madura melalui kerjasama dengan lembaga perguruan tinggi. Penelitian ini menggunakan metode penelitian hukum empiris dengan metode pendekatan yuridis sosiologis dan legal antropologis. Hasil dan pembahasan dalam penelitian ini ialah bahwa faktor strategisnya peran kiai pesantren dalam kehidupan sosial masyarakat Madura disebabkan oleh ajaran tradisi, budaya, dan agama yang sama-sama memposisikan figur guru sebagai panutan dalam melaksanakan kehidupan di dunia. Strategisnya figur kiai ini nantinya akan dimanfaatkan untuk menciptakan tatanan kehidupan masyarakat yang bergaya hidup halal melalui optimalisasi peran kiai pesantren, dengan cara menggencarkan gerakan pendidikan gaya hidup halal, baik Gerakan yang sifatnya internal ataupun eksternal. (One of the important goals of establishing the Halal Center at Trunojoyo University, Madura, is to strive to create a pattern of community life that has a halal lifestyle. One of the efforts to achieve this is by establishing institutional partnerships with Islamic boarding schools in Madura. An important issue to be answered in this study is related to the strategic role of Islamic boarding schools in an effort to support the implementation of a halal lifestyle in Madura through collaboration with higher education institutions. This study uses an empirical legal research method with a sociological juridical and anthropological legal approach. The results and discussion in this study is that the strategic factor of the role of kiai pesantren in the social life of the Madurese community is due to the teachings of tradition, culture and religion which both position the teacher figure as a role model in carrying out life in the world. Strategically, this kiai figure will later be used to create a community life order that has a halal lifestyle through optimizing the role of the Islamic boarding school kiai, by intensifying the halal lifestyle education movement, both internal and external movements.)

This study examines the strategies implemented by several pesantrens (Islamic boarding schools) in Madura to curb the proliferation of radical Islam. It aims to uncover the various approaches these Islamic boarding schools employ to combat the rise of radical Islam, which has recently gained traction in the region. Utilising empirical legal research methodologies with socio-legal and anthropo-legal frameworks, the study reveals that pesantrens are proactive in teaching students—the Santri—to reject religious radicalism. Furthermore, these institutions foster religious communities, such as koloman, kamrat, and Majelis Shalawat, which have been effective in resisting radical influences in Madura. The success of these pesantrens can be attributed to their pivotal role in enhancing legal awareness among the community, steering them away from radical ideologies. This strategic influence is anchored in their capacity to modify legal behaviours through organisational structure, social control, and cultural integration. The findings affirm the critical role of pesantrens in promoting a secure, peaceful, and religiously tolerant Indonesia, highlighting their tangible contributions to national stability.

Abstract: The quest for fast wealth acquisition through internet fraud among the Nigerian youth has become a common lifestyle. That education among the Nigerian youth is considered a scam, given the poor economic level of the country and the inability to secure a job after graduation. Although several laws prohibit internet fraud in Nigeria, there seems to be a surge of internet fraud and a setback in educational focus among the Nigerian youth. However, Indonesia though has similar challenges but has been able to surmount and curtail incidences of fraud. Purpose: In this regard, this study tends to examine the menace of internet fraud in shackling the Nigerian youth from an educational focus and how the Nigerian government can learn from the Indonesian experience in curbing the incidence of fraud through legal and educational policy. Design/Methodology/Approach: The study adopts a doctrinal method of study; primary and secondary sources of authority were relied on in sourcing for data. The data obtained was analysed using a descriptive and analytical method of study. Findings: The study therefore found that the prevalence of internet fraud among Nigerian youth is as a result of unemployment, poverty, poor educational policy, and the syndrome of getting rich quickly through internet fraud. The study further found that the educational process among Nigerian youth has been severely affected due to the prevalence of internet fraud. Also, it was also revealed that the Indonesian government through effective legal, educational, and socio-economic policy has been able to curtail the incidence of internet fraud among its youths. Originality/value: The study therefore contributes to the existing body of knowledge as it concerns curtailing the incidence of fraud and enhancing education. Furthermore, the study also achieves a high focus on education among the Nigerian youth by identifying the fact that the Nigerian government needs to incorporate the Indonesian government's legal and educational policy that tends to promote education among its youth. This will also result in a cross-cultural ideology in resolving the menace of internet fraud.

This article examines the importance of state power in regulating religion in a limited scope. This is intended to solve classic problems, such as the state immediately fulfilling the constitutional rights of local religious adherents. Even though the Constitutional Court partially recognizes the existence of local religions through decision No.97/PUU-XIV/2016, this decision does not change the legal status of local religions, which are not considered official state religions. This research contributes to efforts to fulfill the right to freedom of religion for followers of Indigenous religions through policy design that does not restrict local religions from becoming official state religions. This study employed a normative legal research method, which concludes that the state's involvement in limiting local religions is by issuing various rules that distinguish religion from belief and standardizing religion, which closes the opportunity for local religions to be recognized as an official state religion. Limitations on state power can be carried out by issuing state regulations in religion, which limits to regulate fostering harmony of religious life and upholding the freedom of religion and avoiding regulatory patterns that classify religions and standardize religion because it will hinder the fulfilment of the constitutional rights of belief adherents
