Abstract

In Madura, a number of Sharia and / or sharia nuances Regional Regulations were born. Whereas, Indonesia is not a religious state. The emergence of such Regional Regulations is believed to cause a lot of conflict in the society. Therefore, it is necessary to know How is the legal politics of values absorption or Sharia legal provisions in the Regional Regulations of Madura Regency? This research is a normative legal research. This research includes a conceptual approach, a statutory approach, and a case approach. The finding shows that the application and / or absorption of Sharia in Madura are due to the religious values that attached in the societies' daily life. So after conducting the research, it is found that the application and / or absorption of the Islamic values in regional legal products in Madura are divided into two types; firstly; direct absorption and / or application of regional legal products, in the form of Perda or Perbup. Secondly, the absorption and / or application of Islamic legal values to regional legal products do not directly manifest the sharia legal products, but substantially, the material contained in the legal products has absorbed the Islamic values into it.

Abstract

The re-examination of the Job Creation Law in 2023 highlights a serious issue in the national legislative system, specifically the follow-up to the Constitutional Court’s (MK) decisions in judicial review cases (PUU) concerning the Omnibus Law. The urgency of this research stems from the high demand among lawmakers for drafting laws in the omnibus format and the potential for judicial review of such laws. This research contributes to addressing the follow-up to the Constitutional Court’s decisions by focusing on the choice of legislative forms as a response to these rulings. The research employs normative legal methods with conceptual, legislative, and case-based approaches. The findings emphasize the need to standardise the type of regulation to ensure the executability of the Constitutional Court’s decisions. The ideal regulatory form for implementing the Court’s rulings on the Omnibus Law is a law. Therefore, it is necessary to legitimise the use of laws as the standard form of follow-up to the Constitutional Court’s decisions on the Omnibus Law to maximise the executability of these rulings.

Abstract

A government system based on people's sovereignty can be called a democratic government system. Democracy itself is realized by a government based on representatives of the people who are democratically elected by means of general elections. General elections or elections are a logical consequence of a country that adheres to a democratic system, and democracy is a safe way to maintain control over the rule of law. article 3 of Law NO. 7 of 2017 concerning ELECTIONS states that ELECTIONS must be held based on the principles of being effective and efficient. Therefore, the separation of national elections and local elections is to represent the existence of this article. Simultaneous elections to be held in 2024, namely elections on a national and local scale, will bring various negative impacts. If the 2022 and 2023 Regional head elections are postponed and held in 2024, the Jakarta-centric issue is very dominant and local issues or agendas are sidelined. Meanwhile, the regulation related to the postponement of the Regional head election is contained in Article 201 paragraph (9), (10), and (11) of Law no. 1 of 2015 concerning Stipulation of Government Regulation into Law no. 1 of 2014 concerning the Election of Governors, Regents, and Mayors into Law.

Abstract

The role of Islamic boarding schools in realizing a halal lifestyle through halal certification as an effort for a better life in the future is a fact. Under certain conditions, Islamic boarding schools can also function as an element that can solve community legal problems. This study is intended to optimize the existence of a halal centre at Trunojoyo University Madura by conducting halal certification through institutional synergy with Islamic boarding schools, which have an essential role in realizing a halal lifestyle in the Madurese community. With empirical legal research methods, it is found that Islamic boarding schools (kiai) have cultural, religious, and legal legitimacy to realize a halal lifestyle in the Madurese community.

Abstract

Salah-satu tujuan penting didirikannya Halal Centre di Universitas Trunojoyo Madura ialah untuk mengusahakan terciptanya pola kehidupan masyarakat yang bergaya hidup halal. Salah-satu upaya untuk mencapai hal itu ialah dengan cara menjalin Kerjasama kelembagaan dengan pondok pesantren di Madura. Persoalan penting yang ingin dijawab dalam penelitian ini ialah terkait peran strategis kiai pesantren dalam upaya mendukung pelaksanaan gaya hidup halal di Madura melalui kerjasama dengan lembaga perguruan tinggi. Penelitian ini menggunakan metode penelitian hukum empiris dengan metode pendekatan yuridis sosiologis dan legal antropologis. Hasil dan pembahasan dalam penelitian ini ialah bahwa faktor strategisnya peran kiai pesantren dalam kehidupan sosial masyarakat Madura disebabkan oleh ajaran tradisi, budaya, dan agama yang sama-sama memposisikan figur guru sebagai panutan dalam melaksanakan kehidupan di dunia. Strategisnya figur kiai ini nantinya akan dimanfaatkan untuk menciptakan tatanan kehidupan masyarakat yang bergaya hidup halal melalui optimalisasi peran kiai pesantren, dengan cara menggencarkan gerakan pendidikan gaya hidup halal, baik Gerakan yang sifatnya internal ataupun eksternal. (One of the important goals of establishing the Halal Center at Trunojoyo University, Madura, is to strive to create a pattern of community life that has a halal lifestyle. One of the efforts to achieve this is by establishing institutional partnerships with Islamic boarding schools in Madura. An important issue to be answered in this study is related to the strategic role of Islamic boarding schools in an effort to support the implementation of a halal lifestyle in Madura through collaboration with higher education institutions. This study uses an empirical legal research method with a sociological juridical and anthropological legal approach. The results and discussion in this study is that the strategic factor of the role of kiai pesantren in the social life of the Madurese community is due to the teachings of tradition, culture and religion which both position the teacher figure as a role model in carrying out life in the world. Strategically, this kiai figure will later be used to create a community life order that has a halal lifestyle through optimizing the role of the Islamic boarding school kiai, by intensifying the halal lifestyle education movement, both internal and external movements.)

Abstract

This study examines the importance of ethics as a formal parameter in assessing the validity of Constitutional Court (MK) decisions in Indonesia. The final and binding nature of MK decisions often raises debates regarding absolute power without adequate control mechanisms, especially in the context of ethical violations. This research explores deontological ethics and procedural justice as the basis for analysis, as well as several controversial MK decisions related to ethical issues. This research is a normative legal study that emphasizes a conceptual and statutory approach. The results show that integrating ethics into the assessment of MK decisions can enhance the legitimacy of constitutional justice and ensure more substantive justice. Therefore, this study recommends reformulating the legal framework to incorporate ethics as a key component in the validity assessment process.

Abstract

The discuss about PPHN, it is closely related to its legal product, because the success or failure of the PPHN concept is very influential by what legal product is the basis for the rules. This research focuses on finding the ideal format for setting up PPHN in the Indonesian legal system. The formulation of the problem in this research are: First, what are the supporting and inhibiting factors for the implementation of PPHN in Indonesian laws and regulations?; Second, what is the ideal model for implementing PPHN in Indonesian laws and regulations? This study uses normative legal research which results in the conclusion that there are several potential supporters and obstacles in implementing this PPHN, both in the 1945 Constitution of the Republic of Indonesia, TAP MPR, and the legislative act. The ideal format for setting up the PPHN is through a legislative act based on the existence of the TAP MPR which specifically sets the boundaries of the direction of development (the direction of the state) as implicitly stated in the constitution. The affirmation of the boundaries of the direction of the country's direction is intended to ensure the achievement of the concept and direction of sustainable national development.
