Abstract

QRIS is a non-cash payment instrument in the form of a QR code developed by Bank Indonesia and the Indonesian Payment Association. With the existence of QRIS, Bank Indonesia hopes to facilitate public transactions and not be left behind by technology. As a Muslim community, especially in Pasar Atas, Bukittinggi, we must understand how the law uses QRIS. because everything we do must be based and not deviate from the teachings of Islam. The aim of this research is to find out how the effectiveness of using the Quick Response Code Indonesian Standard (QRIS) in buying and selling transactions at Pasar Atas Kota Bukittinggi is viewed from an Islamic economic perspective. This type of research is a qualitative descriptive method by collecting data through interviews with traders and buyers who shop at Pasar Atas Kota Bukittinggi. The results of this study indicate that QRIS users receive many benefits, such as facilitating transactions, not having difficulty finding small money, reducing the spread of counterfeit money, not reducing the value of money and there are still many benefits received by QRIS users. Therefore it can be said that QRIS is more effective.

Abstract

This research aims to find out what the description of cattle buying and selling transactions using the marosok system is in the Muaro Paneh market, and what is the perspective of sharia business ethich in buying and selling cattle using the marosok system in the Muaro Paneh market. This research uses qualitative methods with interviews and observations with cattle sellers at the Muaro Paneh market. The research results show that. Description of cattle buying and selling transactions using the marosok system are carried out only on Mondays from dawn to dusk. The cattle seller there always carries a cloth or sarong on his shoulder. The seller’s way of determining the price is by touching the buyer’s hand, and when bidding the buyer also touches the seller’s hand using the code of his fingers. Where the index finger can be worth hubdreds of thousands, one million, up to ten million rupiah. The perspective of sharia business ethich in buying and selling cattle using the marosok system at MuaroPaneh market is in accordance with the principles of sharia business ethics such as customer satisfacarion, fairness and trust in the process of buying and selling livestock.

Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan pendistribusian zakat produktif di BAZNAS Pasaman dan bagaimana dampak zakat produktif terhadap perkembangan usaha mikro penjual lontong pecal di Nagari Languang, Kecamatan Rao Utara. Jenis penelitian kualitatif bersifat deskriptif dengan pengumpulan data melalui observasi, wawancara, dan dokumentasi. Teknik analisis data reduksi data, penyajian data penarikan kesimpulan yang dilakukan setelah wawancara terhadap 2 karyawan kantor BAZNAS dan mustahik usaha mikro penjual lontong pecal yang mendapatkan zakat produktif sebagai sampel untuk memperoleh data yang dibutuhkan. Zakat produktif yang disalurkan oleh BAZNAS Pasaman kepada mustahik usaha mikro penjual lontong pecal di Nagari Languang telah memberikan dampak terhadap perkembangan usaha mustahik. Perkembangan usaha mustahik dapat dilihat dari peningkatan pendapatan yang dirasakan oleh mustahik meskipun pendapatan mustahik berbeda-beda dan belum tergolong besar, tetapi bersumber dari yang halal. Peningkatan kualitas produk yang di mana kualitas bahan mustahik sekarang lebih bersih dan halal, bertambahnya jumlah pelanggan berkat pelayanan yang lebih baik, serta peningkatan kualitas sumber daya manusia, mustahik yang kini mampu menjalankan usaha secara mandiri, jujur, adil, dan bertanggung jawab sesuai dengan syariat. Akan tetapi, pelaksanaan zakat produktif ini masih menghadapi beberapa tantangan yang perlu diatasi yaitu masih ada sebagian kecil mustahik yang belum memiliki etalase tempat bahan jualan dikarenakan masih kurang modal yang diberikan dan sebagian mustahik juga masih membutuhkan pendampingan, pelatihan dalam manajemen keuangan dan pemasaran. Program zakat produktif harus diperbaiki agar dapat berfungsi sebagai alat peningkatan ekonomi semua umat agar sesuai dengan tujuan pokok zakat dalam Islam, yaitu menciptakan kesejahteraan semua umat manusia.

Abstract

The criminal act of livestock theft is one form of crime that causes unrest and losses for rural communities because livestock has high economic value and serves as a primary source of livelihood. In Indonesian positive law, livestock theft committed jointly is regulated under Article 363 paragraph (1) of the Criminal Code, whereas in Islamic criminal law theft is included as a jarimah that is, in principle, punishable by hudud sanctions if certain conditions are fulfilled. This study aims to examine a court decision concerning the criminal act of livestock theft from the perspective of Islamic criminal law, particularly the Decision of the Pasaman Barat District Court Number 150/Pid.B/2021/PN Psb. This study employed a normative legal method with statutory, scientific journal, and case approaches. The research data were derived from primary and secondary legal materials collected through library research and then analyzed qualitatively. The results show that the panel of judges based its decision on the fulfillment of all elements of the criminal act of aggravated theft as regulated under Article 363 paragraph (1) points 1 and 4 of the Criminal Code, by considering the facts of the trial, witness testimonies, the defendant’s confession, and evidence, so that the defendant was sentenced to seven months’ imprisonment. From the perspective of Islamic criminal law, the defendant’s act constitutes the jarimah sariqah, but because the conditions for the application of hudud were not fully met, the appropriate sanction is categorized as ta’zir. These findings contribute to strengthening comparative studies between positive criminal law and Islamic criminal law and show that the judge’s decision is in line with the principles of justice and the objectives of punishment in Islamic criminal law.

Abstract

Women’s leadership in customary structures remains a debated issue in society, including in the context of ancestral property management among the Minangkabau community. Mamak kepala waris is an informal figure within a clan who is responsible for managing the distribution of ancestral property and various matters related to the clan’s inheritance, with the appointment process based on the agreement of clan members, either directly or implicitly. This study aimed to analyze the position of women as mamak kepala waris in Tiakar Urban Village and to examine this role from the perspective of Maqashid Syariah. This study used a descriptive qualitative approach with a field research design. Data were collected through observation and interviews with relevant informants and then analyzed descriptively and qualitatively. The results showed that the position of women as mamak kepala waris had been customarily recognized through a clan agreement letter and supported by the Kerapatan Adat Nagari, and was also in line with the Supreme Court decision. From the perspective of Maqashid Syariah, women’s leadership in customary structures can be accepted if it fulfills the five objectives of sharia, namely preserving religion, intellect, life, lineage, and property. The conclusion of this study emphasizes that Minangkabau women have an important position and contribution in customary structures, particularly in the management and preservation of the clan’s harta pusaka tinggi. These findings imply the strengthening of understanding regarding the flexibility of customary leadership based on clan agreement and its relevance to the principle of public benefit in Maqashid Syariah.
