Abstract

AbstractBoth Indonesia and the Netherlands have a civil law system, with Dutch law serving as the foundation for Indonesian law. However, the role of jurisprudence differs significantly between the two countries, which impacts legal certainty. The author employs a normative juridical method and a comparative law perspective to examine the role of jurisprudence in Indonesia and the Netherlands, as well as its usage and influence on court decisions. This study aims to understand and analyze the role of jurisprudence in Indonesia and the Netherlands, the quality and quantity of the use of jurisprudence in both countries, and the influence of jurisprudence on the formation of court decisions based on the principle of legal certainty. The author finds that the influence of jurisprudence in Indonesia is minimal because the country adheres strictly to civil law, and jurisprudence is not a recognized source of law. In contrast, the Netherlands integrates jurisprudence into its legal system, as seen in the Zwolsman case, where jurisprudence influenced law-making. This approach ensures legal certainty in the Netherlands. Nonetheless, in Indonesia, judges act only as enforcers of the law, and the criminal law system does not yet support the use of jurisprudence.Abstrak  Indonesia dan Belanda merupakan pengguna konsep civil law serta hukum Belanda merupakan induk dari hukum Indonesia. Namun, peran yurisprudensi di kedua negara tersebut sangatlah berbeda. Perbedaan ini menjadi penting karena peran yurisprudensi berkaitan dengan kepastian hukum. Penulis menggunakan metode yuridis normatif yang bersifat deduktif dengan pendekatan komparasi hukum, penerapan hukum oleh hakim, dan analisis putusan pengadilan yang dianalisis secara deskriptif analitik. Penelitian ini bertujuan untuk mengetahui serta menganalisis peran yurisprudensi di Indonesia dan Belanda, kualitas kuantitas penggunaan yurisprudensi di Indonesia dan Belanda, dan pengaruh yurisprudensi dalam pembentukan putusan pengadilan berdasarkan asas kepastian hukum. Penulis menemukan bahwa pengaruh peran yurisprudensi Indonesia masihlah minim karena Indonesia masih menerapkan civil law secara murni dan yurisprudensi bukanlah sumber hukum. Selain itu, di Belanda pengaruh peran yurisprudensi sudah sangat kentara. Pengaruh peran tersebut terlihat di kasus Zwolsman. Pemerintah Belanda membuat hukum yang bersumber dari kasus Zwolsman. Belanda pun sudah tidak lagi menerapkan civil law secara murni. Hal tersebut menjadikan kepastian hukum sudah terjamin di Belanda. Sayangnya, hal tersebut masih belum dapat direalisasikan di Indonesia karena hakim indonesia hanya berperan sebagai corong undang-undang. Meskipun sudah terdapat bunyi peraturan yang mengatur eksistensi yurisprudensi, tetapi sistem hukum pidana Indonesia dan sumber hukum Indonesia masih belum mendukung penggunaan yurisprudensi.

Abstract

In January 2023, the Indonesian government passed Law No. 4 of 2023 on the Development and Strengthening of the Financial Sector (P2SK Law). Replacing more than 30 provisions, the law covers lots of topics including digital financial services (DFS) and consumer protection. A big contributing factor to this is the prevalence of the financial technology (FinTech) industry that utilises DFS. Digital financial literacy (DFL) is an important component to consumer protection in DFS since P2SK Law and other legal instruments recognize the importance of the consumer’s own awareness when using DFS. The Alliance for Financial Inclusion (AIF) and ASEAN Working Committee on Financial Inclusion (WC-FINC) issued a policy note in 2020 on DFL in the region. Expected to guide ASEAN member states in formulating their policies through a framework that includes four key actions. This research aims to inspect the direction in which the Indonesian government is heading with regard to its consumer protection in DFS after the enactment of the P2SK Law from ASEAN’s DFL-leaning standpoint. It can be concluded that Indonesia, mainly through Bank Indonesia and the Financial Services Authority (OJK) has been a big advocate of financial literacy, including DFL, as a proponent of consumer protection in recent years. Among other things, P2SK Law further affirms this by connecting stakeholders and embedding DFL at the core of Indonesia’s national strategies.

Abstract

The paralysis of the World Trade Organization’s (WTO) Appellate Body (AB) in 2019 created a significant gap in the organization’s Dispute Settlement Mechanism (DSM), undermining its ability to enforce fair and timely resolutions for trade disputes. In response, the Multi-Party Interim Appeal Arbitration Arrangement (MPIA) emerged as a temporary, voluntary solution for WTO members seeking an alternative appellate mechanism. This paper explores the structure, processes, and implications of the MPIA, comparing it to the AB system to assess whether it offers a viable, efficient substitute. The study examines how MPIA’s arbitration-based approach and voluntary membership differ from AB’s mandatory, judicial review framework. Findings suggest that while MPIA provides flexibility, timeliness, and procedural efficiency, its limited membership and provisional nature present challenges to achieving consistency in dispute resolution. As WTO members continue to negotiate a path forward for the DSM, the MPIA serves as a testament to multilateral adaptability and highlights the potential role of arbitration in global trade governance. This analysis contributes to the ongoing discourse on WTO reform, emphasizing the need for a durable, balanced mechanism that meets both current efficiency demands and long-term objectives for fairness and consistency in international trade.
