Abstract

This article discusses child custody rights after divorce from the perspective of Islamic law and civil law. The provisions regarding child custody are contained in Law no. 1 of 1974, stated in article 54 paragraph (2) "That parents are obliged to look after their children until they marry or can stand on their own". In the system that has prevailed in many communities, the responsibility for caring for children is more suited to a woman. Because this is because most women with a "feminine" temperament tend to care, as if this care is natural for a woman. And based on a hadith from the Prophet sallallaahu'Alaihi wa Sallam, he said: "You have the right to take care of him as long as you have not remarried." (HR. Abu Dawud). This hadith shows that a woman (mother) has the most right to care for her child when her husband divorces her. However, the right to hadhalah does not always fall to the mother, the husband also has the right to have the same rights as the mother, if the conditions for determining the mother do not meet the criteria for providing for the child's interests, such as being apostate, having no noble character, being crazy, and so on. Because when it comes to raising children, the first thing that must be considered is the interests of the child and having the ability and ability to provide a sense of security to children who are victims of divorce.

Abstract

Desa Bremi adalah salah satu desa yang mayoritas penduduknya beragama islam yang beraliran Nahdlatul Ulama, dengan melestarikan adat istiadat yang ada mampu menjadikan hubungan antar masyarakat sangatlah harmonis dan saling melengkapi. Dilihat dari pemiluh yang terjadi kemarin pada tanggal 14 Februari 2024 masyarakat Bremi lebih menjaga ketentraman dan keharmonisan antar sesama walaupun memiliki perbedaan dalam pemilihan tersebut . Dengan memberikan pemahaman kepada masyarakat tentang islam moderat mampu meningkatkan keharmonisan masyarakat di Desa Bremi. Pendampingan kami terhadap islam moderat di desa Bremi ini dengan melihat adanya perbedaan yang membuat kami ingin mengedukasi representasi islam moderat dalam fanatisme politika dikarenakan kami menemukan kelebihan di Desa Bremi, yakni dalam satu Aliran atau satu ormas Nahdlatul Ulama’ memiliki perbeda pilihan namun masih menjaga ketentraman, keharmonisan antar sesama. Dalam pendampingan ini kami memiliki suatu program seminar ke-NU’an bersama masyarakat sekaligus pengedukasian terkait islam moderat. Dengan adanya cara mengedukasi masyarakat Desa Bremi Selatan terkait islam moderat kami berharap masyakatat desa bermi dan dalam satu Ormas Nahdlatu Ulama’ lebih toleransi antara masyarakat yang satu dengan yang lainnya meskipun berbeda dalam menentukan pilihannya. Kami sangat berharap ketika menjelang terjadinya pemilu di tahun mendatang mampu menjadikan satu Ormas Nahdlatul Ulama’ dan yang lainnya saling menjaga tolerangsi dan kerarmonisannya yang telah menjadi program kami sebelumnya.

Abstract

The phenomenon of growing philanthropy, especially in sub-districts, Krejengan, Probolinggo Regency is an interesting study and requires assistance to increase its assets and potential. The aim of implementing this service is to explore asset potential, find asset development strategies, ensure the continuity of the Santri Philanthropy program, and expand partnerships based on the results achieved in the NU Care-LAZISNU MWCNU Krejengan community, Probolinggo Regency. In its implementation, this assistance uses an Asset - Based Community Development approach. Where the steps of discovery, dream, design, define, and destiny are carried out. In the context of this service, based on strategic analysis and how the ABCD method works, the general description of the implementation of mentoring includes the preparation stage, implementation stage, and reporting stage. As a result of the mentoring, the Santri Philanthropy Program is a potential asset for the NU Care-LAZISNU community in developing the KOIN NU movement. The NU Coin movement has been formed since 2020, and residents are enthusiastic about taking part because the majority of local residents are Nahdiyin residents, and the results obtained will be felt to be more beneficial given the existing potential. The strategy for developing assets in the NU Care - LAZISNU community from the Santri Philanthropy program is: planning, organizing, methods, and supervision. And the results achieved include uniform and organized program Standard Operating Procedures (SOP), control and management, scheduled reporting, and scheduled and planned tasharruf activities.
