Abstract

Abstract: The purpose of this study is to examine the implementation of the Istishna' contract in clothing orders at Al-Zaytun Garment, the legal principles of sale and purchase in the Istishna' contract, and the practice of ordering clothing at Al-Zaytun Garment. This research employs a qualitative approach with field research as its type. Data collection was carried out through field observations, documentation, and in-depth interviews with the field coordinator of Al-Zaytun Garment and several employees involved in the clothing ordering process. The research findings indicate that the ordering process at Al-Zaytun Garment operates under strict internal controls. The process involves several stages, starting from placing the order to the retrieval of the finished goods. The implementation of the Istishna' contract in the ordering process follows Sharia principles, ensuring clarity between the buyer and the seller, where the garment staff is responsible for fulfilling the order criteria, while the buyer specifies the criteria and makes the payment. Abstract

The aim of this study is to analyze in depth the clothing ordering practices at the Al-Zaytun Garmen, specifically focusing on the contract, product specifications, and payment methods, as well as their compliance with the Istisna' contract principles according to Sayyid Sabiq's perspective. This research employs a descriptive qualitative method with techniques including in-depth interviews, observation, and documentation. The results indicate that the Al-Zaytun Garmen offers two ordering options: individual and mass orders. Regarding the contract aspect, there is clarity between the ordering party and the Garmen regarding transaction terms. Product specifications are also clearly outlined to ensure the final product meets customer requirements. For individual orders, payment methods involve a down payment and settlement upon product pickup, whereas mass orders use a non-cash payment system. From Sayyid Sabiq's perspective, this practice generally aligns with the principles of the Istisna' contract, particularly in terms of mutual consent and fair pricing. However, there are challenges in ensuring delivery timelines, which may reduce compliance with Sharia principles. Therefore, it is recommended that Al-Zaytun Garmen implements a digital system for real-time production tracking to ensure delivery timelines and specification compliance. Abstract

Join operation is a cooperation between two or more business entities to complete a temporary project. Syirkah is one of the cooperation between two or more people in a business where both are responsible for profits and losses and are based on mutual assistance. Join Operation between KSU and LKM in the Procurement of Heavy Equipment can be considered as cooperation between institutions. The purpose of this study is to determine the practice of joint operations between KSU and LKM in the procurement of heavy equipment and the practice of joint operations between KSU and LKM in the procurement of heavy equipment according to sharia economic law. The method used in this research is a qualitative approach with the type of field research. Data collection techniques in the form of observation, interviews with the secretary, treasurer, KSU financial administration staff with LKM and supplemented with documentation. The results showed, first, that the practice of joint operations between KSU and LKM begins with the LKM surveying the prices and specs of heavy equipment needed in building a project to the manufacturer, after the survey the two parties meet to deliberate and negotiate so that there is a mutual agreement, this is an MOU agreement between KSU and LKM in the procurement of heavy equipment and there are contributions from each party. After the MOU, KSU releases funds in cash to be given to LKM, then LKM buy heavy equipment and provide benefits to KSU in installments. Second, the practice of joint operation between KSU and LKM in the procurement of heavy equipment according to sharia economic law in its implementation has fulfilled the pillars, conditions and principles of syirkah according to Islamic teachings. So, both parties do not appear to have elements that are prohibited by Islamic law in cooperating (syirkah) but in practice there are similarities with murabahah in terms of financing and musyarakah mutanaqisah in terms of operations. This is because both parties in the cooperation are mutually consensual, mutual help and mutual openness, because both parties want to help each other in the procurement of this heavy equipment. Abstract

This research examines the practice of ordering chicken carcasses between Kitchen units and Chicken Slaughterhouses in Al-Zaytun based on the perspective of sharia economic law. The main focus is the salam contract mechanism and the conformity of ordering practices with the pillars, terms and principles of sharia. This research aims to identify and evaluate the mechanisms and suitability of ordering practices with sharia economic law. The method used is descriptive qualitative research with a field approach. Data was collected through interviews, observation and documentation studies, then analyzed through data reduction, data presentation and drawing conclusions. The research results show that the greeting contract mechanism for ordering chicken carcasses between the Kitchen and the Chicken Slaughterhouse in Al-Zaytun is procedurally appropriate, from submission to delivery. However, evaluation of the suitability of practices based on the pillars, terms and principles of the salam contract revealed several discrepancies, especially regarding the official halal certification of the slaughterhouse. However, chicken slaughterhouses have implemented sharia standards which include halal, fairness, freedom from maysir, gharar and usury, as well as transparency in the implementation of contracts.
