Abstract

The tradition of inheritance of Javanese people has a peculiarity that combines Islamic values and local customs. Allah Almighty in the Qur'an regulates and explains in detail about the division of inheritance, as in QS: An-Nisa verses 7-12, verses 33 and verse 176. Allah the Just does not neglect and does not neglect the rights of every heir with very clear and perfect rules. God determines the rights of every heir with justice and wisdom. Because wealth is a milestone enforcer of life for both individuals and community groups. This study aims to analyze the inheritance tradition of Javanese society in the perspective of Islamic Inheritance Law and Customary Inheritance Law. The Javanese tradition of inheritance has several main principles, namely: a) Equality: All children are entitled to receive inheritance, both male and female, b) Wisdom: Heirs can give more inheritance to certain children based on certain considerations, such as needs, achievements, or filial piety, c) Deliberation: The distribution of inheritance is carried out by consensus between heirs. The Javanese tradition of inheritance is basically in line with Islamic Inheritance Law, although there are some differences in the technicalities of inheritance distribution. This research uses normative research methods by conducting a positive legal approach to laws and regulations and case studies using qualitative data types. The data sources used are secondary data obtained from sources in the form of official documents, books, journals, the internet and other sources related to this research. This study recommends that socialization and education be carried out to the Javanese people about Islamic Inheritance Law and Customary Inheritance Law to avoid disputes in inheritance.

Abstract

Amicus Curiae, or friends of the court, is an important instrument in constitutional proceedings in Indonesia even though it does not yet have a standard legal basis. This study discusses the authority of Amicus Curiae in providing additional information, enriching the judge's consideration, and supervising the proceedings of the Constitutional Court. The method used is the literature study approach, which is a research method whose series of research is related to the method of collecting library data, or research whose object of research is studied through various literature information, such as: books, journals, articles and documents. Amicus Curiae is filed in the form of a written document containing legal arguments and other relevant analysis. The Constitutional Court has the authority to reject Amicus Curiae that are judged irrelevant or filed with improper motives. On the other hand, a quality Amicus Curiae can have a positive influence on the decisions of the Constitutional Court and contribute to law enforcement and democracy in Indonesia. Amicus Curiae has not been clearly regulated in Indonesia, but in principle it is accepted under article 5 paragraph 1 of the Law on Judicial Power "Judges and constitutional judges are obliged to explore, follow and understand the legal values and sense of justice that live in society. Furthermore, the confession of the Amicus Curiae can be found in article 180 paragraph 1 of the Code of Criminal Procedure which states that "In the event that it is necessary to clear up the sitting of the matter arising in court, the presiding judge of the trial may request expert testimony and may also request to submit new material by the interested person.

Abstract

Kosmetik merupakan salah satu produk konsumen yang populer dan banyak diminati dalam perdagangan elektronik (e-commerce). Namun, keberadaan penjualan kosmetik ilegal melalui platform e-commerce semakin meningkat, menimbulkan risiko bagi konsumen terkait dengan kualitas, keamanan, dan keaslian produk. Riset ini bertujuan untuk menganalisis perlindungan hukum yang tersedia bagi konsumen dalam konteks jual beli kosmetik ilegal secara online. Penelitian hukum normatif dilakukan menggunakan pendekatan perundang-undangan dan konsep hukum perlindungan konsumen. Data yang dikumpulkan diperiksa secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa berbagai peraturan perundang-undangan yang mengatur perlindungan konsumen dapat melindungi konsumen dari penjualan kosmetik ilegal melalui e-commerce. Peraturan Pemerintah Nomor 7 Tahun 2019 tentang Perlindungan Konsumen dalam Perdagangan Melalui Sistem Elektronik, Undang-Undang Nomor 8 Tahun 1999, Pasal 4 huruf c, Pasal 8 dan Pasal 9. Upaya perlindungan konsumen diimplentasikan melalui pencegahan dengan cara sosialisasi edukasi kepada konsumen tentang bahaya kosmetik illegal dan melalui penindakan dengan cara pemberian sanksi kepada pelaku usaha yang menjual kosmetik illegal. Perlindungan konsumen dalam jual beli kosmetik online ilegal merupakan tanggung jawab bersama pemerintah, platform e-commerce, dan konsumen. Konsumen perlu cermat dalam berbelanja online dan memastikan produk yang dibeli memiliki izin edar dari BPOM. Penjualan kosmetik ilegal online di Indonesia dapat dikenakan sanksi pidana yang tegas, sesuai dengan beberapa peraturan perundang-undangan salah satunya UU Nomor 8 Tahun 1999 tentang Perlindungan Konsumen Pasal 8 ayat (1) huruf a: Melarang pelaku usaha untuk memproduksi, memperdagangkan, atau mengedarkan barang dan/atau jasa yang tidak memenuhi standar mutu, keamanan, kesehatan, dan keefektifan.
