Abstract

This research aims to analyze political dynamic behind the prohibition of Islamic Defender Front (FPI) phenomenon, especially from Unitary State of Indonesia and Islamic Defender Front's perspective as a two main actor on this phenomenon, with the usage of competitive authoritarianism theory. Reflect on this phenomenon, this research uses the competitive authoritarianism by Steven Levitsky as analytical tool to explain government's authoritarian tendency from this prohibition. This research uses explanatory qualitative method with data collection technique carried out by in-depth interview and observation, meanwhile the secondary data obtained from media studies and literature review. The results of this research reveal that state's interest on banning FPI lies on conducting the policing of societal organizations. As government's annotation regarding law violations by the FPI, the government needs to take firm action against FPI to protect freedom of association of other civil groups. However, this prohibition intersected with competitive authoritarianism thesis due to prohibition mechanism has abolished the role of judiciary power on review this decision and this prohibition practically shrinking the civil space which can be used by FPI to become an extra-parliamentary opposition on supervising state's policy.

Abstract

This study examines the reconstruction of the State’s constitutional responsibility in financing primary education in Indonesia following Constitutional Court Decision No. 3/PUU-XXII/2024. The ruling corrected the narrow interpretation of Article 34(2) of Law No. 20 of 2003 on the National Education System (Sisdiknas Law), which had limited free education to public schools and caused discrimination against students in private schools. Using a normative juridical method with statutory and conceptual approaches, the study analyzes two issues: the Court’s reasoning in expanding the meaning of “free primary education” to include private schools, and the constitutional implications of the decision for realizing the right to education. The findings show that the Court’s decision rests on five key grounds: the constitutional guarantee of primary education under Article 31(2) of the 1945 Constitution; misinterpretation of the Sisdiknas Law conflicting with justice; the strategic role of private schools; the principles of non-discrimination and equality before the law; and consistency with Article 13 of the ICESCR. The decision strengthens equitable access to education, expands State funding to private schools, and redefines the State’s role as the guarantor of every citizen’s constitutional right to education. Keyword: Financing; Primary Education; Constitutional Court

Abstract

Penelitian ini bertujuan untuk meninjau peran partisipasi masyarakat dalam mengawal kebijakan pendidikan di Kota Malang, khususnya menghadapi permasalahan pungutan liar. Metode penelitian kualitatif dengan pendekatan deskriptif digunakan untuk memberikan gambaran mengenai partisipasi masyarakat dalam pengawasan anggaran pendidikan. Pengumpulan data dilakukan dengan wawancara mendalam kepada Malang Corruption Watch dan beberapa warga yang tergabung dalam FMP3D dalam melakukan advokasi pendidikan sipil dan observasi tersebut didukung dengan telaah pustaka dari berbagai sumber. Hasil penelitian ini menunjukkan bahwa partisipasi masyarakat memiliki dampak yang signifikan terhadap kinerja pemerintah untuk membenahi kebijakan pendidikan di Kota Malang yang masih bermasalah, khususnya mengenai pungli di beberapa sekolah. Selain itu, peran dari pengawalan partisipasi masyarakat oleh Malang Corruption Watch menunjukkan bahwa advokasi MCW dengan kelompok masyarakat memberikan dorongan yang signifikan untuk mencapai partisipasi publik yang utuh dalam penyelenggaraan pendidikan. Hasilnya, advokasi oleh MCW bersama warga memberikan dampak besar terhadap penindakan dugaan kecurangan dalam kebijakan pendidikan – terutama mengenai pungutan liar yang masih marak di beberapa sekolah – yang kemudian menjadi sinyal yang penting ditindaklanjuti untuk melakukan perbaikan total dalam penyelenggaraan pendidikan di Kota Malang.Kata kunci: Advokasi Pendidikan; Masyarakat Sipil; MCW; Pungutan Liar.
