Abstract

: In reality, not all marriages can produce offspring, so various methods are used to obtain offspring, one of which is artificial insemination from sperm donated by another person. This then raises a big question mark regarding the inheritance status of children born from sperm donation. The research method used is normative juridical with a statutory approach and also a conceptual approach. The results of this study show that children resulting from artificial insemination using a sperm donor have full rights to inherit from their parents on the basis of mutual agreement between the husband and wife to include the child resulting from insemination via a sperm donor into their marriage, so that the child is considered a biological child. (legitimate child). Apart from that, children resulting from artificial insemination also have the right to inherit from their biological father, but this must be done by obtaining recognition and approval first.

Abstract

Abstract—Migrant workers have certain vulnerabilities and risks in the place where they work. Her status as a migrant certainly puts her in a vulnerable and risky situation, especially if it is related to the specific sector where she works, especially the informal one, where labor law protection is often excluded. Problems that often occur with Migrant Workers stem from a low understanding of the rules and requirements for working abroad, as well as the forgery of workers' documents. Regarding the placement of prospective Migrant Workers, of course it cannot be done haphazardly, especially if the placement of Indonesian Migrant Workers does not go through document processing procedures or other important matters required. Because the placement of workers abroad is the implementation of the expansion and placement of workers by sending Indonesian workers abroad. The placement and protection of Indonesian workers is carried out with conditions, procedures and mechanisms based on existing and currently applicable laws and regulations. One example of the placement of Indonesian Migrant Workers abroad which cannot be carried out haphazardly as mentioned above is that Indonesian Migrant Workers may not be placed in certain countries that are declared closed, one of the criteria being countries experiencing armed conflict. Keywords: protection of indonesian migrant workers, closed country, state of armed conflict Abstrak—Pekerja Migran mempunyai kerentanan dan berbagai risiko tertentu di tempat di mana ia bekerja. Statusnya yang sebagai migran ini tentu meletakkannya ke dalam keadaan yang rentan dan berisiko, terlebih jika dikaitkan dengan sektor spesifik tempatnya bekerja, khususnya yang informal, yang perlindungan hukum ketenagakerjaannya acapkali dikecualikan. Permasalahan yang sering terjadi terhadap Pekerja Migran bersumber dari rendahnya pemahaman pada aturan dan persyaratan untuk bekerja di luar negeri, serta adanya pemalsuan dokumen para tenaga kerja. Mengenai penempatan terhadap calon Pekerja Migran pun tentunya tidak boleh dilakukan secara sembarangan, apalagi bila penempatan Pekerja Migran Indonesia tersebut tidak melalui prosedur pengurusan dokumen maupun hal- hal penting lain yang diperlukan. Sebab penempatan tenaga kerja ke luar negeri merupakan pelaksanaan dari perluasan dan penempatan tenaga kerja dengan cara pengiriman tenaga kerja Indonesia ke luar negeri. Penempatan dan perlindungan tenaga kerja Indonesia ini dilaksanakan dengan persyaratan, tata cara, dan mekanisme yang berdasarkan pada aturan perundang-undangan yang ada dan yang sedang berlaku. Salah satu contoh penempatan Pekerja Migran Indonesia di luar negeri yang tidak boleh dilakukan secara sembarangan sebagaimana disebutkan diatas adalah Pekerja Migran Indonesia tidak boleh ditempatkan ke negara tertentu yang dinyatakan tertutup, yang salah satu kriterianya adalah negara yang mengalami konflik bersenjata.
