Abstract

In the writers’ opinion, there are two types of novel: those which are made for fun and leisure, and those which are compiled to deliver an idea(s). Based on that, the writers think that the novel used in this study, Eragon, is a novel which is such an attractive one to keep up with in addition to the moral values about life intended to deliver. Christopher Paolini, the author, has demonstrated every effort to write such a highly valued novel in the age of fifteen. This paper discusses the symbols in Paolini’s Inheritance: Eragon. There are two main points that this paper attempts to answer: (1) the symbols which are used in this novel and (2) how the theme is reflected by the symbols. Although there are many standpoints to observe in the novel, this paper only focuses on the work itself and the internal characteristics that build the story. Key words: symbol, theme, setting

Abstract

Penelitian hukum atas tindakan promosi yang menyesatkan oleh PT. ADMS dilakukan karena banyak dijumpai pelaku usaha yang mengiklankan usahanya tidak sesuai dengan kenyataannya sehingga dapat menimbulkan kerugikan antara konsumen, hal itu melanggar ketentuan pasal 26 huruf d UU Kepariwisataan dimana pelaku harus memberikan informasi yang akurat dan bertanggung jawab sehingga mengurangi resiko terjadinya kesalah pahaman diantara konsumen dan pelaku usaha. Esensi pelaku usaha dalam melakukan aktivitas usahanya adalah untuk mendapatkan keuntungan, namun harus tetap mempertimbangkan resiko yang akan diterima oleh konsumen. Dalam menyelenggarakan kegiatan pariwisata berisiko tinggi, pelaku usaha wajib memberikan perlindugan asuransi bagi wisatawan. PT. ADMS merupakan pengusaha wisata berisiko tinggi. Wisatawan yang sedang menyelam menggunakan jasanya mengalami kecelakaan yang mengakibatkan kematian. Wisatawan yang meninggal seharusnya mendapatkan asuransi sebagaimana tertera dalam brosur, pada kenyataannya PT. ADMS tidak memberikan klaim asuransi korban dengan alasan tidak memenuhi prosedur administratif. PT. ADMS dengan sengaja tidak memberikan klaim asuransi kepada keluarga korban dikarenakan tidak membayarkan tagihan premi kepada perusahaan asuransi.

Abstract

: In reality, not all marriages can produce offspring, so various methods are used to obtain offspring, one of which is artificial insemination from sperm donated by another person. This then raises a big question mark regarding the inheritance status of children born from sperm donation. The research method used is normative juridical with a statutory approach and also a conceptual approach. The results of this study show that children resulting from artificial insemination using a sperm donor have full rights to inherit from their parents on the basis of mutual agreement between the husband and wife to include the child resulting from insemination via a sperm donor into their marriage, so that the child is considered a biological child. (legitimate child). Apart from that, children resulting from artificial insemination also have the right to inherit from their biological father, but this must be done by obtaining recognition and approval first.

Abstract

Spatial planning is a system of spatial planning processes, space utilization and space utilization control. Spatial planning is carried out to be able to realize spatial order and provide welfare for the entire community. However, often there are many violations of the use of space committed by the community. O ne of them is the violation of space utilization by the Islamic Boarding School Manager for the existence of a boarding school building in the form of a special flat located in Purwobinangun Village, Pakem District, Sleman Regency without being equipped with a permit. The location is included in the Disaster-Prons Area III, where this area is very dangerous because of its location very close to the volcano. Through the Jurifical Normative Research method by conducting a literature study on legal materials, the results obtained that the management can be charged with legal responbility in the form of imposing administrative sanctions relatrd to violations of space use because it was built in Disaster Prone Area III. Abstract

State finances have an important role in realizing people's welfare. The parties involved in the management of state finances have obligations and responsibilities in accordance with their respective authorities which have been regulated in the laws and regulations. It should be noted that the management of BUMN and BUMD are also managers of state finances because they receive capital participation from the state. It becomes a problem when BUMD directors as BUMD financial managers cause state financial losses. The problem in question is related to accountability. This study aims to examine whether the directors of Pt. X is responsible for state financial losses that occur when he carries out his duties as a BUMD manager when carrying out the procurement of goods in the form of stones and sand. Through research conducted using the statute approach and conceptual approach, it was found that the consequences of actions in the financial management of BUMDs that are detrimental to state finances can be in the form of positional accountability and personal responsibility. Position accountability can be given if the person concerned has good intentions. However, in this case the directors of Pt. X did not have good intentions, it was found that there was an element of abuse of power which is one of the benchmarks for an act to be held personally accountable. Therefore, personal responsibility in the form of criminal sanctions and also compensation for state financial losses can be imposed on him. Abstract

This study is to examine the relationship between the implementation of good financial government with unqualified opinion. The type of research method used in this study is a normative juridical method by conducting a literature study on related legal materials. The results of this study are that there is a relationship between Unqualified Opinion issued by the Supreme Audit Agency and the principle of good financial government, one of the benchmarks of which is based on Government Accounting Standards regulated in Article 32 of Law Number 17 of 2003 concerning State Finance in order to present the results of the technical performance of the State Audit Board of the Republic of Indonesia on the examination of financial statements in accordance with the standards and laws and regulations. Unqualified Opinion is a manifestation of the values of good governance, namely accountability, participation, and transparency, but this does not rule out the possibility that there are irregularities that cannot be detected during the audit process and do not guarantee the absence of corruption by government administrators. Abstract

This thesis raises a case regarding the actions and implementation of a cartel agreement between the President Director of PT X and the President Director of PT Y with the object of a 110 cc & 125 CC automatic scooter that does not meet the statutory provisions, namely article 1320 number (4), 1338 paragraph (3) and 1365 of the Criminal Code in conjunction with Article 5 paragraph (1), Article 11, and 47 of Law No. 5 of 1999 in conjunction with Article 4 and Article 45 paragraph (1) of Law No. 8 of 1999, which resulted in unlawful acts. The non-compliance with the statutory provisions was because the automatic scooter motorcycle was motivated by the existence of a cartel agreement between the President Director of PT X and the President Director of PT Y in violation of Article 5 paragraph (1). So that the price fixing agreement made has violated the legal requirements of an agreement, namely "a lawful cause" where as a result the agreement is null and void. For their actions, the two PTs violating the provisions of the law can be said to be an unlawful act in accordance with Article 1365 of the Criminal Code, in which all elements of unlawful acts have been fulfilled. Based on Article 1365 of the Criminal Code, then PT X and PT Y as business actors producing motorized vehicles obliged to be responsible for an act against the law that brings harm to the consumers as buyers. Abstract

Abstract—Cultural heritage is a country's historical heritage which is fragile and rare so its existence must be preserved because it has important value for history, science, religion and education. One example of cultural heritage in Indonesia is a cultural heritage building. Cultural heritage buildings have their own characteristics, one of which is that they are more than 50 years old and have historical value as stated in Law Number 11 of 2010 concerning Cultural Heritage. Law Number 11 of 2010 is legal protection for cultural heritage in Indonesia. One of the cultural heritage buildings in Padang City is the Ema Idham House. However, currently the cultural heritage building Ema Idham House has collapsed and been razed to the ground because Soehinto Sadikin, as the owner of the house, has carried out the demolition without permission from the Padang City government. The Padang City Public Works and Spatial Planning (PUPR) Department only provided City Plan Information to Soehinto Sadikin, so he had no right to demolish the cultural heritage building. Therefore, so that the cultural heritage building is not lost, the Padang City Government must carry out reconstruction of the building. Ownership rights to the land owned by Soehinto Sadikin must first be transferred to the Padang City Government through land procurement for development in the public interest. This thesis aims to analyze whether the Padang City government has the authority to request the takeover of privately owned land that has cultural heritage status. Keywords: building reserve culture, padang city government, land acquisition Abstrak—Cagar budaya merupakan warisan bersejarah suatu negara yang bersifat rapuh dan langka sehingga wajib dilestarikan keberadaannya karena memiliki nilai penting bagi sejarah, ilmu pengetahuan, agama, dan pendidikan. Salah satu contoh cagar budaya yang ada di Indonesia yakni bangunan cagar budaya. Bangunan cagar budaya memiliki ciri khas tersendiri salah satunya yaitu memiliki umur lebih dari 50 tahun dan memiliki nilai sejarah sebagaimana termaktub dalam Undang-Undang Nomor 11 Tahun 2010 tentang Cagar Budaya. Undang-Undang Nomor 11 Tahun 2010 merupakan perlindungan hukum bagi cagar budaya yang ada di Indonesia. Salah satu bangunan cagar budaya yang ada di kota Padang adalah Rumah Ema Idham. Namun, saat ini bangunan cagar budaya Rumah Ema Idham tersebut telah runtuh dan rata dengan tanah dikarenakan Soehinto Sadikin sebagai pemilik bangunan rumah telah melakukan pembongkaran tanpa izin dari Pemerintah Kota Padang. Dinas Pekerjaan Umum dan Penataan Ruang (PUPR) Kota Padang hanya memberikan Keterangan Rencana Kota kepada Soehinto Sadikin, sehingga ia tidak berhak untuk melakukan pembongkaran terhadap bangunan cagar budaya tersebut. Oleh sebab itu, agar bangunan cagar budaya tersebut tidak hilang Pemerintah Kota Padang harus melakukan rekonstruksi terhadap bangunan tersebut. Hak milik atas tanah yang dimiliki oleh Soehinto Sadikin harus dialihkan terlebih dahulu kepada Pemerintah Kota Padang melalui pengadaan tanah bagi pembangunan untuk kepentingan umum. Skripsi ini bertujuan untuk menganalisa apakah Pemerintah Kota Padang berwenang meminta pengambilalihan tanah milik pribadi yang berstatus cagar budaya.
