Abstract

Penelitian bertujuan untuk menjawab urgensi mekanisme kontrol terhadap Sertipikat Tanah Elektronik sebagai upaya yuridis meningkatkan kepastian hukum dalam jaminan kredit; dan bentuk optimalisasi mekanisme kontrol pada Sertipikat Tanah Elektronik sebagai upaya yuridis meningkatkan kepastian hukum dalam jaminan kredit. Perubahan kebijakan transisi sertipikat tanah konvensional menjadi sertipikat elektronik membutuhkan mekanisme kontrol. Hal ini bertujuan menjaga kepastian hukum dari sertipikat tanah dalam proses konversi maupun implikasinya dalam jaminan kredit. Penelitian ini normatif menggunakan pendekatan kasus, pendekatan peraturan perundang-undangan serta pendekatan komparatif yang selanjutnya dianalisis dengan cara berpikir induktif. Hasil penelitian, yaitu urgensi diperlukan mekanisme kontrol terhadap Sertipikat Tanah Elektronik sebagai upaya yuridis meningkatkan kepastian hukum dalam jaminan kredit disebabkan konversi sertipikat tanah elektronik, belum tersedianya mekanisme pengawasan, sosialisasi dan pendampingan penggunaan sertipikat elektronik dalam jaminan kredit. Sedangkan, bentuk optimalisasi mekanisme kontrol pada Sertipikat Tanah Elektronik sebagai upaya yuridis meningkatkan kepastian hukum dalam jaminan kredit meliputi optimalisasi mekanisme kontrol melalui formulasi petunjuk teknis konversi sertipikat elektronik, optimalisasi melalui pemberdayaan mutu dan kompetensi pelaksana serta optimalisasi melalui sosialisasi dan pendampingan secara komperehensif.

Abstract

Land and Building Acquisition Duty (BPHTB) is one of the significant sources of local revenue for the Government of Madiun City. However, the implementation of BPHTB value determination in land and building sale and purchase transactions often causes problems, especially related to the transparency and accuracy of the assessment conducted by the Regional Revenue Agency (Bapenda). These obstacles can affect public trust and the efficiency of local tax administration. This study aims to analyze the application of BPHTB value by Bapenda Madiun City in land and building sale and purchase transactions. This study also aims to identify the obstacles faced and provide recommendations to improve the transparency and accuracy of BPHTB valuation. This research uses a qualitative approach with a case study method. Data were collected through in-depth interviews with relevant parties, including Bapenda officers, notaries, and communities involved in land and building sale and purchase transactions. The study analyzed official documents related to the determination of BPHTB. The results show that the application of BPHTB values by Bapenda Madiun City still faces several obstacles, such as the lack of transparency in the valuation process and the difference between the market value and the value determined by Bapenda. Nevertheless, improvement efforts such as training for appraisal officers and the use of information technology in the appraisal process have begun to be implemented. This study concludes that to improve the effectiveness of BPHTB implementation in Madiun City, it is necessary to improve transparency and accuracy in the valuation process. Suggestions in the research are increasing the capacity of appraisal officers, using more sophisticated information systems, and increasing socialization to the public regarding the procedures and basis for determining BPHTB.

Abstract

The research aims: (i) to provide an answer as to why the reconstruction of the electronic mortgage supervision system is needed to ensure legal certainty in the era of land digitization; and (ii) to formulate the form of reconstruction of the electronic mortgage supervision system to ensure legal certainty in the era of land digitization. This research is normative, using a case approach, statutory approach, and conceptual approach, which are then analyzed using inductive reasoning. The research results indicate that an analysis is needed for the reconstruction of the electronic mortgage supervision system to ensure legal certainty in the era of land digitization due to the need for increased inclusive and responsive supervision in the transition from conventional mortgage registration to electronic, as well as the unavailability of measurable socialization and assistance mechanisms and the optimization of digital technology in the application of the electronic mortgage system. The form of reconstruction of the electronic mortgage supervision system to ensure legal certainty in the era of land digitization includes the formulation of technical guidelines regulating inclusive and responsive supervision of electronic mortgage registration application, empowerment of the quality and competence of implementers within the National Land Agency Office and Land Deed Officials, as well as the injection of policies for measurable socialization and assistance in the application of the electronic mortgage system by optimizing digital technology.
